Thompson, Public Works Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: ~7/{~ Adopt Resolution accepting improvements and approving traffic  control devices installed for Parcel Map 7233 FINANCIAL STATEMENT: Opus West Construction Corporation has provided a Maintenance Bond in the amount of $730,554.20 to guarantee against defects for one year. Once the improvements are accepted, the City will incur maintenance and street sweeping costs for the City street improvements on Arnold Road, Central Parkway, Dublin Boulevard and Hacienda Drive. The cost of street light maintenance will be paid by the Citywide Street Light Maintenance Assessment District 83-1. Landscaping improvements in the planter strips fronting Arnold Road, Dublin Boulevard, Central Parkway, and Hacienda Drive will be maintained by the City via Landscape Maintenance Assessment District 97-1. Landscaping improvements in median islands on Dublin Boulevard and Central Parkway will be maintained through the City's General Fund. DESCRIPTION: Parcel Map 7233 is located in the Eastern Dublin Specific Plan area and is bordered by Arnold Road on the west, Hacienda Drive on the east, 1-580 on the south and Creekside Business Park on the north. This Parcel Map subdivided a portion of the Santa Rita property to create parcels for the Emerald Pointe Business Park, MicroDental site, and Sybase headquarters. The Parcel Map also dedicated public streets for Dublin Boulevard and Central Parkway from Arnold Road to Hacienda Drive, and for Hacienda Drive and Arnold Road from Dublin Boulevard to Central Parkway. The Conditions of Approval for Parcel Map 7233 required the developer, Opus West Construction Corporation, to design and construct public street improvements for Dublin Boulevard, Central Parkway, Arnold Road, and Hacienda Drive. As part of this project, the developer also extended Dublin Boulevard COPIES TO: Travis Baker, Opus West ITEM NO. ~~[ G:\DEVELOP\Emerald Pointe~Agstacpt PM 7233.doc across the frontage of the BART station between the railroad right-of-way and Hacienda Drive, and installed traffic signals at the following intersections: Dublin Boulevard at Arnold Road Dublin Boulevard at DeMarcus Drive Dublin Boulevard at Hacienda Drive Dublin Boulevard at Iron Horse Parkway Hacienda Drive at Digital Drive (now known as Martinelli Way) Hacienda Drive at Central Parkway Hacienda Drive at Summerglen Drive These improvements have been constructed pursuant to the Tract Developer Agreement and completed to the satisfaction of the City Engineer. It is now appropriate that the improvements should be accepted by the City for maintenance. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin's Traffic Code: A. Arnold Road, Central Parkway, and Dublin Boulevard are designated as "Through Streets" (Traffic Code Chapter 6.08). B. "No parking" restriction has been installed on both sides of Dublin Boulevard between Scarlett Drive and Hacienda Drive (Traffic Code Chapter 6.04.250). C. "No parking" restriction has been installed on both sides of Central Parkway between Arnold Road and Hacienda Drive (Traffic Code Chapter 6.04.250). The developer has provided a Maintenance Bond in the amount of $730,554.20, which is 10% of the original Performance Bond, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements and approving the regulatory traffic control devices installed for Parcel Map 7233, Opus West Construction Corporation. Page 2 RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS FOR ARNOLD ROAD, CENTRAL PARKWAY, DUBLIN BOULEVARD AND HACIENDA DRIVE FOR PARCEL MAP 7233 (OPUS WEST CONSTRUCTION CORPORATION) WHEREAS, the subdivider of Parcel Map 7233, filed on June 26, 1998, in Book 236 of Parcel Maps at Pages 7 - 13, -previously entered into a Tract Developer Agreement with the City of Dublin to construct improvements in accordance with plans and specifications on file with the City Engineer, said project identified as follows: a) Developer: Opus West Construction Corporation, a Minnesota Corporation b) Location: North ofi-580, East of Arnold Road, and West of Hacienda Drive c) Parcel Map Size 681.978 acres d) Resolution Approving Agreement: 81-98, City Council of Dublin e) City Streets Affected: Arnold Road, Dublin Boulevard, Central Parkway and Hacienda Drive; and WHEREAS, the improvements associated with Parcel Map 7233 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the improvements to Parcel 7233; and WHEREAS, a Maintenance Bond can be accepted to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed on Arnold Road, Central Parkway, Dublin Boulevard and Hacienda Drive within said Parcel Map 7233 are hereby approved and accepted subject to a one-year guarantee period. 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A. Arnold Road, Central Parkway, Dublin Boulevard, and Hacienda Drive and are designated as "Through Streets." B. "No parking' restriction along both sides of Dublin Boulevard between Scarlett Drive and Hacienda Drive. C. "No parking' restriction along both sides of Central Parkway between Arnold Road and Hacienda Drive. 3. The submitted Maintenance Bond issued by The Continental Insurance Company (Bond No. 929256003) in the amount of $730,554.20 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 6th day of May, 2004. PASSED, APPROVED AND ADOPTED this 6th day of May, 2003.
