(Braddock and Logan), has constructed the off -site street improvements on Fallon Road for Parcel Map 10049, Neighborhoods "D" and "E," Positano /Fallon Village in accordance with their Improvement Agreement. It is now appropriate for the City to accept these improvements. FINANCIAL IMPACT: Braddock and Logan has provided a warranty bond (Bond No. 724215M, in the amount of $112,170), issued by Insurance Developers Surety and Indemnity Company, to guarantee the off -site street improvements on Fallon Road associated with Parcel Map 10049 for one year. Upon acceptance of the street improvements, the City will incur additional annualized maintenance costs estimated to be $4,400 for slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years) of the additional paved roadway width on Fallon Road. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting the Off -Site Improvements on Fallon Road for Parcel Map 10049. Submitted By Director of Public Works DESCRIPTION: Reviewed By Assistant City Manager Dublin RE Investors, LLC, by Braddock and Logan Services, Inc. (Braddock and Logan), entered into an Improvement Agreement with the City of Dublin on July 19, 2011, for the construction of off -site street improvements on Fallon Road associated with Parcel Map 10049. Parcel Map 10049 created Neighborhoods "D" and "E" of the Positano development within the area covered by the Fallon Village Specific Plan. These improvements included widening of Page 1 of 2 ITEM NO. 4.10 Fallon Road to provide two lanes of travel in each direction between Dublin Boulevard and Central Parkway. Braddock and Logan provided a Performance Bond and Labor & Materials Bond to guarantee construction of the off -site improvements on Fallon Road. The improvements are now complete and the developer is requesting that the bonds for this work be released. Braddock and Logan has provided a warranty bond in the amount of $112,170 (Bond No. 724215M) by Developers Surety and Indemnity Company. The bond amount is equal to twenty five percent (25 %) of the full cost of completion of the improvements. (Braddock and Logan), the developer of Parcel Map 10049, previously entered into an Improvement Agreement dated July 19, 2011, for the construction of off -site street improvements on Fallon Road associated with Parcel Map 10049; and WHEREAS, the developer provided a performance bond and labor and materials bond, each in the amount of $448,680 for the Off -Site Improvements on Fallon Road to guarantee the installation of these improvements; and WHEREAS, the improvements are complete in accordance with said plans, and any approved modifications thereto, to the satisfaction of the City Engineer, and WHEREAS, the performance bonds and labor and materials bonds can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, "Manner of Release of the Security," and replaced with a warranty bond to guarantee the completed work for a one -year period; and WHEREAS, Braddock and Logan, has provided a warranty bond in the amount of $112,170 issued by Developers Surety and Indemnity Company (Bond No. 724215M) to guarantee the improvements for a one -year period. NOW, THEREFORE, BE IT RESOLVED that: 1. The off -site improvements on Fallon Road for Parcel Map 10049 are hereby approved and accepted subject to a one -year guarantee period. 2. The original Performance Bond issued by Developers Surety and Indemnity Company (Bond No. 724215S) in the amount of $448,680 for the off -site improvements on Fallon Road be released. 3. The original Labor and Material Bond issued by Developers Surety and Indemnity Company (Bond No. 724215S) in the amount of $448,680 for the off -site improvements on Fallon Road be released. 1 vote PASSED, APPROVED AND ADOPTED this 19th day of March, 2013, by the following AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk Mayor
