Santa Rita; Summerglen; Jefferson at Dublin; Emerald Pointe; Casterson Property (Tassajara Meadows I), Dublin Ranch Area A- H; Dublin Ranch Phase I; General Motors; Koll Development; Micro Dental; Tassajara Meadows II; Dublin Ranch — Supplemental Areas F, G & H; FINANCIAL STATEMENT: The fiscal impacts of these projects were addressed as part of a fiscal analysis performed for the approved projects. Al D1401 BACKGROUND: The Annual Review of Development Agreements is required by State law and Chapter 8.56 of the City' s Municipal Code. During the review period the City Council has the opportunity to review the compliance of the parties of the Agreement and either determine the parties are in compliance and conclude the review; or, if the City Council determines that parties have not complied in good faith, the City Council may modify or terminate the Agreement. The burden of proof of good faith compliance is on the developer. The various City Departments have reviewed the fifteen Development Agreements, and comments were returned to the Community Development Director. Many of the larger improvements are either bonded or scheduled to be completed as the projects proceed. Staff has concluded that the developers for these 15 projects are proceeding in good faith with the terms of the Development Agreements. If any Council member has concerns about the compliance of a particular developer, that Development Agreement will be set for a public hearing at a future City Council meeting. The following Development Agreements are due for annual review at this time: Santa Rita Commercial Center (formally known at Homart, now known as Hacienda Crossings Retail/Entertainment Commercial Center) - In compliance - This project is nearly complete. The issue of Fire Station land dedication has been resolved. The negotiations for this are taking place, and the City is confident the station site will be acquired shortly. Opus has recently sold this property. California Creekside/Brookside - In compliance - This project is almost complete. The houses have been completed and occupied; however, the City is holding bonds to assure the successful completion of the remaining items to be done. Kaufman & Broad has been working to complete the landscaping and hardscape improvements along Dublin Boulevard and Central Parkway. The landscaping has been completed, but much work is still to be done to repair sagging soundwalls, place lamps, repair paving and curbs, repair a metal gate at the end of Pheasant Court and other minor issues. Staff is confident these items will be completed to the City' s satisfaction. Hansen Ranch - In compliance - Most of the items have been completed. The trail along the creek has not yet been accepted. The contractor is currently completing a punch list and is moving forward towards the completion of this project. In addition, Staff is working with the Alameda County Fire Department regarding weed abatement and firebreaks. Staff is confident these items will be completed to the City' s satisfaction. Villas at Santa Rita - In compliance - This project is nearly complete, except for one right turn lane on northbound Hacienda Drive to eastbound Central Parkway that can be constructed when determined it is warranted by the Public Works Director. Summerglen - In compliance - Units are being completed at this time. Improvements required under the Development Agreement are being constructed currently. The recreation center and landscape improvements required by the Development Agreement will be constructed in the near future. The final striping and landscaping of Gleason Road between Tassajara Creek is being completed at this time. There has been no indication from Alameda County of any problems regarding future compliance with the Agreement. Jefferson at Dublin - In compliance - All items have been completed. EmeraldPointe - In compliance - All items have been completed or are currently being constructed. The property has recently been sold. Casterson Property (known as Tassajara Meadows D - In compliance - The improvements of Tassaj ara Road are bonded, but are not fully complete. Dublin Ranch Area A-H - In compliance Dublin Ranch Phase I- In compliance General Motors - In compliance - All improvements have been bonded, but are not fully complete. Koll Development - In compliance - All improvements have been bonded, but are not fully complete. Micro Dental - In compliance - All items have been completed and separate funding agreements for Tassajara 1-580 interchange improvements have been signed. Tassajara Meadows H - In compliance - All improvements have been bonded, but are not fully complete. Dublin Ranch - Supplemental Areas F, G & H - In compliance Conclusion: Staff has determined that all of the Developers for the above mentioned Development Agreements have complied in good faith and/or progressing toward full conformance with the terms and conditions of the Development Agreements during the past year. Staff will continue monitoring the projects to assure that the Developers are continuing to move toward full compliance. RECOMMENDATION: Staff recommends that the City Council, by motion, make a determination that the developers of the fifteen (15) Development Agreements Santa Rita Commercial Center; California Creekside~rookside ;. Hansen Ranch; Villa's at Santa Rita; Summerglen; Jefferson at Dublin; Emerald Pointe ; Casterson Property (Tassajara Meadows I), Dublin Ranch Area A-H; Dublin Ranch Phase I; General Motors; KoIl Development; Micro Dental; Tassajara Meadows II; and Dublin Ranch - Supplemental Areas F, G & t! have complied in good faith with the terms and conditions of the Agreements during the pastyear and conclude the period of review.
