The subject property is currently occupied by the Heritage Park Office Complex at 11875 Dublin Boulevard and is located south of Dublin Boulevard between San Ramon Road and Donlon Way. FINANCIAL IMPACT: No financial impact to the City. All costs associated with preparing the General Plan and Dublin Village Historic Area Specific Plan Amendment Study, if authorized by the City Council, would be borne by the Applicant. RECOMMENDATION: Staff recommends that the City Council: 1) Receive Staff presentation; 2) Take testimony from the Applicant and the public; 3) Deliberate; and 4) Either Adopt a Resolution approving the initiation of a General Plan and Specific Plan Amendment Study to change the land use designation on approximately 5.85 acres at 11875 Dublin Boulevard from Retail /Office to Medium Density Residential; OR 4) Adopt a Resolution denying the initiation of a General Plan and Specific Plan Amendment Study to change the land use designation on approximately 5.85 acres at 11875 Dublin Boulevard from Retail /Office to Medium Density Residential. Submitted By Director of Community Development DESCRIPTION: Reviewed By Assistant City Manager Page 1 of 4 ITEM NO. 8.1 Background Bates Stringer Ventures has entered into a Purchase Agreement with Cranbrook Realty Investment Fund LP to acquire the 6.6 acre Heritage Park Office Complex located at 11875 Dublin Boulevard. Bates Stringer Ventures intends to develop the site with approximately 55 -60 small -lot single - family homes on approximately 5.85 acres and a 15,000 square foot office building for Challenge Dairy on the remaining 0.75 acres of the site. The project site is shown in the Vicinity Map below: Figure 1: Project Vicinity The property currently has a General Plan land use designation of Retail /Office. The Retail /Office land use designation allows for a variety of commercial uses including shopping centers, stores, restaurants, business and professional offices, motels, service stations, and sale of auto parts. Residential uses are not permitted. The current General Plan land use designation for the subject property and the surrounding properties are shown in the figure on the following page. Page 2 of 4 Bates Stringer Ventures is requesting that the City Council initiate a General Plan and Dublin Village Historic Area Specific Plan Amendment Study to examine changing the land use designation for a large portion of the subject parcel from Retail /Office to Medium Density Residential. The Medium Density Residential land use category allows for the development of residential uses in the range of 6.1 to 14.0 units per acre. This density range permits residential unit types including small -lot single - family homes, duplexes, townhomes, and garden apartments. ANALYSIS: It is the City Council's policy to initiate all General Plan and Specific Plan Amendment Studies prior to Staff accepting an application and beginning work on such projects. The Applicant's letter of request to initiate the General Plan and Specific Plan Amendment Study is included as Attachment 1. An exhibit illustrating the proposed area to be changed to residential uses and the proposed area to remain commercial is included as Attachment 2. The consideration of a General Plan Amendment Study for this project will include examining site - specific issues such as proximity to Interstate 580, compatibility with the City's adjacent Heritage Park, and addressing the earthquake fault zone that underlies the site. Should the City Council initiate a General Plan and Dublin Village Historic Area Specific Plan Amendment Study, Staff would- 1 . Determine the associated impacts from the land use change including examining the consistency of the proposed change with the Historic Overlay Zoning District; 2. Conduct the appropriate level of environmental review and documentation including an analysis of noise and air quality impacts; 3. Perform any additional studies that may be required including an analysis of the impacts of the underlying earthquake fault zone; and 4. Prepare an analysis for consideration by the Planning Commission and the City Council. Page 3 of 4 Work on the General Plan and Dublin Village Historic Area Specific Plan Amendment Study would be completed concurrently with processing any other entitlements that are requested by the Applicant, including a Rezone, Tentative Subdivision Map, and Site Development Review for the proposed residential neighborhood and adjacent office building. Once the General Plan and Dublin Village Historic Area Specific Plan Amendment Study is complete, Staff would then bring the application to the Planning Commission for their recommendation to City Council. The City Council could then take action on the General Plan and Specific Plan Amendments. Staff has prepared draft Resolutions approving and denying the initiation of a General Plan and Dublin Village Historic Area Specific Plan Amendment Study to evaluate changing the land use designation of a majority of the subject property from Retail /Office to Medium Density Residential. Both Resolutions are included with this Staff Report as Attachments 3 and 4. NOTICING REQUIREMENTS /PUBLIC OUTREACH: Public noticing is not required to review a request to initiate a General Plan Amendment Study. Although not required, the City mailed notices to all property owners and tenants within 300 feet of the subject property. A notice was also published in the Valley Times and posted in the designated posting places. A copy of this Staff Report was provided to the Applicant. ENVIRONMENTAL REVIEW: Staff recommends that the initiation of the General Plan and Dublin Village Historic Area Specific Plan Amendment Study be found exempt from the California Environmental Quality Act (CEQA) under Section 15306, Class 6 of the State CEQA Guidelines (Information Collection). The property consists of approximately 6.6 acres and is located within the Dublin Village Historic Area Specific Plan. Bates Stringer Ventures proposes building a residential community on the site comprised of approximately 55 -6o single family homes ranging in size from approximately 2,100 square feet to approximately 2,650 square feet. Additionally, a small office building of approximately 15,000 square feet will be built, which is anticipated to be the new home of Challenge Dairy Products. The proposed project will be thoughtfully designed with respect to the guidelines set forth in the Dublin Village Historic Area Specific Plan. We therefore request that the City of Dublin initiate a General Plan and Specific Plan Amendment Process for the property. The City of Dublin General Plan will require amendment to change approximately 5.85 acres of the site from "retail /office" to "Medium Density Residential ", with corresponding Specific Plan and Planned Development (PD) Amendments. Approximately o.73 acres of the site will remain zoned "retail /office ". This amendment to the land use will support and enhance the recently adopted Dublin Downtown Specific Plan by providing housing opportunities adjacent to the City of Dublin Downtown, as well as to sustain the longtime occupancy of Challenge Dairy Products within the City of Dublin. Over the past few months we have had discussions with the tenants of Heritage Park to introduce'our proposed plan and anticipated timing, as well as to provide preliminary information regarding suitable relocation provisions. for each of them. We will continue to work with the tenants throughout the entitlement process in a mutually beneficial manner.
