A proposed purchase price will be submitted to the City Council for approval at a later date. DESCRIPTION: Mr. Dick Jeha of Stroud's Plaza has approached Staff regarding purchase of a small 120-square-foot piece of excess right of way along San Ramon Road for the purpose of locating a new shopping center sign. The sign is proposed to be located in the median of the shopping center's San Ramon Road driveway and would replace the existing sign which is set further back from the roadway. Stroud's Plaza previously purchased a piece of excess right of way in order to meet the earthquake fault setback for the building at the southwest comer of San Ramon Road and Amador Valley Boulevard. Similar purchases of excess right of way have also occurred at the frontages of the Petco, Public Storage, Fishery, and Sleep Shop properties, as well as on the east side of the street for the Starward development. Section 54222 of the Government Code requires that the City offer this property to any housing authorities, redevelopment agencies, local park and recreation departments, and the State Resources Agency prior to committing to sell to a private party. If the property is declared to be surplus and Staff is authorized to enter into negotiations with Stroud's Plaza for sale of the property, these agencies will be notified in writing and will have 60 days to respond. If all agencies decline to purchase the property or have not responded within 60 days, the City may proceed to sell the property under the provisions of the Dublin Municipal Code. Staff additionally notifies all public utilities of a proposed right of way sale in the event that existing facilities may require reservation of easements. Stroud's Plaza has taken the step of locating all of the public utilities in the area and is positioning the proposed sign so that the utilities would not be affected. This property is not needed for roadway purposes. Staff recommends that the City Council adopt the resolution declaring the property surplus and authorize Staff to begin the process for sale of the excess right of way. g:\agenmisc\Strouds Plaza RW Sale COPIES TO: Dick Jeha, Stroud's Plaza ITEM NO. 4.4 RESOLUTION NO. - O0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING SURPLUS PROPERTY AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES WHEREAS, Stroud's Plaza has requested that the City enter into negotiations to sell approximately 120 square feet of City property along the westerly side of San Ramon Road, southerly of Amador Valley Boulevard, in conjunction with location of a new shopping center sign; and WHEREAS, the City does not require the property for roadway purposes; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that approximately 120 square feet of vacant right of way along the westerly side of San Ramon Road, southerly of Amador Valley Boulevard, as illustrated in the attached Exhibit A is surplus land and determined to be no longer necessary for the City's use. BE IT FURTHER RESOLVED that Staff is authorized to notify the appropriate agencies of the City's proposed sale of the property and is authorized to enter into negotiations with the adjacent landowner regarding the purchase.
