Adopt the Resolution accepting the improvements and approving the traffic control devices installed for Tract 6964, "The Courtyards", ~ Dublin Ranch Phase I, Neighborhood M-3 FINANCIAL STATEMENT: Standard Pacific Corporation has provided a Maintenance Bond in the amount of $307,075 to guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for City street improvements on Tassajara Road. All internal streets are private with maintenance to be performed by a Neighborhood Homeowners Association. Street light maintenance costs will be paid by the Street Lighting Maintenance Assessment District 99-1. Maintenance of landscaping along the Tassajara Road frontage and within the common and open space areas will be performed by the Community and Neighborhood Homeowner's Associations of Dublin Ranch. DESCRIPTION: Dublin Ranch Phase I, Neighborhood M-3 (Tract 6964) is located in the Eastern Dublin Specific Plan area, generally bounded by South Dublin Ranch Drive, Tassajara Road, and an Open Space Corridor. Tract 6964 consists of 123 residential lots, as well as 18 parcels for open space, private recreation, landscaping and common areas. The project included widening Tassajara Road along the tract frontage and installation of northbound right-turn lanes on Tassajara Road at Georgetown Circle and South Dublin Ranch Drive. The internal streets, utilities and landscaping are private and will be maintained by the Homeowners Association. Subdivision improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the City Engineer, and should now be accepted by the City for permanent maintenance. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: COPIES TO: Steve Melander, Standard Pacific ITEM NO. ~ G:\DEVELOP\Dublin RanchWl3-Std Pacific 'Courtyards'XAgstacpt_6964.doc A. East Chesterfield Circle, Foxcroft Way, Georgetown Circle, Hartwick Drive, Londonderry Drive, and West Chesterfield Circle are designated as "Private Streets." B. No Parking Restriction on the south side of South Dublin Ranch Drive between Tassajara Road and easterly tract boundary (Traffic Code Section 6.28.010). At the time the City and Standard Pacific Corporation executed the agreement for tract improvements, the developer provided a Performance Bond in the amotmt of $1,228,300 and a Labor and Materials Bond in the amount of $614,150 to guarantee performance of the work. Now that the work is complete, the bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $307,075, which is 25% of the original Performance Bond amount, and which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements and approving the regulatory traffic control devices installed for Tract 6964, "The Courtyards", Dublin Ranch Phase 1, Neighborhood M-3. Page 2 RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR TRACT 6964 (DUBLIN RANCH PHASE 1, NEIGHBORHOOD M-3) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 6964, filed on August 5, 1999, in Book 247 of Maps at Pages 44 - 50, previously entered into an agreement with the City of Dublin to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: a) Subdivider: Standard Pacific Corporation b) Tract Location: Southeast comer of South Dublin Ranch Drive and Tassajara Road c) Tract Size: 123 Single-Family Lots d) Resolution Approving Agreement: 102-99, City of Dublin City Council e) city Streets Affected: Tassajara Road WHEREAS, improvements associated with Tract 6964 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the Tract improvements; and WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in accordance with the authority contained in §66499.7 of the Govermnent Code of the State of California, and replaced with a Maintenance Bond to guarantee maintenance of the completed work for a one-year period following acceptance. NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and 2. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) East Chesterfield Circle, Foxcroft Way, Georgetown Circle, Hartwick Drive, Londonderry Drive, and West Chesterfield Circle are designated as "Private Streets." b) "No Parking Anytime" restriction on the south side of South Dublin Ranch Drive between Tassaj ara Road and easterly tract boundary; and 3. The original Performance Bond issued by American Insurance Company (Bond No. 111-3344-7117) in the amount of $1,228,300.00 be released; and 4. The original Labor and Materials Bond issued by American Insurance Company (Bond No. 111-3344-7117) in the amount of $614,150.00 be released; and 5. The submitted Maintenance Bond issued by American Insurance Company (Bond No. 111-3344-7117-M) in the amount of $307,075.00 be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 18th day of February, 2004.
