SUBJECT: Acceptance of Offer of Dedication for Positano Hills Park Site, Parcel 3, Parcel
Map 10049, Positano/ Fallon Village

EXECUTIVE SUMMARY:
Parcel Map 10049 dedicated a 4.60-acre Neighborhood Park Site to the City of Dublin. The City
Council accepted the offer of dedication on June 21, 2011, subject to completion of grading and
other infrastructure improvements to be completed as part of the adjoining Neighborhood "D" in
Positano/Fallon Village. These improvements are now complete and it is appropriate for the City
to accept the offer of dedication.
FINANCIAL IMPACT:
Maintenance of the park site will be limited to vegetation and weed abatement until development
of the park site in spring 2012. Maintenance costs will be minimal during that time.
RECOMMENDATION:
Staff recommends that the City Council approve the Resolution Accepting the Offer of
Dedication for Positano Hills Park Site, Parcel 3, Parcel Map 10049, Positano/Fallon Village.

Braddock and Logan Services, Inc., dba Dublin RE Investors, LLC, filed Parcel Map 10049,
encompassing Neighborhood "D" of the Positano/Fallon Village Development (Attachments 1
and 2) in June 2011. The parcel map dedicated in fee to the City for park purposes the 4.60-
acre Positano Hills Park site, Parcel 3. The City accepted the offer of dedication subject to
completion of grading and other infrastructure improvements.
Subsequently, Braddock & Logan sold Neighborhoods D-2 (Tract 8082) and D-3 (Tract 8083),
both adjoining the park site, to K. Hovnanian at Positano LLC and DR Horton BAY Inc., who

provided bonds securing the completion of the improvements. Braddock & Logan, as a condition
of the sales, has completed the necessary grading and infrastructure improvements to the park
site in conjunction with the tract improvements for these neighborhoods. The park has been
graded to accommodate the proposed Positano Hills Park design. Utilities have been stubbed to
the site, and the erosion control measures have been installed to stabilize the site throughout
the winter. Final acceptance by the City of the offer of dedication will allow the City to proceed
with development of the park site. Design for the park is underway and construction is expected
to begin in spring 2012.
Staff has prepared a Resolution Accepting the Offer of Dedication for Positano Hills Park Site,
Parcel 3, Parcel Map 10049, Positano/ Fallon Village (Attachment 3).
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Public noticing occurred as part of the Tentative Map process. Copies of this report have been
provided to Braddock and Logan.

RESOLUTION NO. - 11
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF OFFER OF DEDICATION FOR POSITANO HILLS PARK SITE,
PARCEL 3, PARCEL MAP 10049, POSITANO/ FALCON VILLAGE
WHEREAS, Parcel Map 10049, filed in Book 318 of Maps at Page 1, Records of
Alameda County, dedicates to the City of Dublin in fee Parcel 3 for park purposes; and
WHEREAS, the City Council accepted, subject to improvement, the offer of dedication
for Parcel 3 on June 22, 2011, Resolution No. 105-11; and
WHEREAS, K Hovnanian at Positano, LLC, and DR Horton BAY Inc., owners of Tracts
8082 and 8083, respectively, previously entered into Improvement Agreements dated
November 15, 2011, Resolution No. 190-11, and December 6, 2011, Resolution No. 230-11,
respectively, with the City of Dublin, to complete in-tract improvements associated with Tracts
8082 and 8083, including rough grading and other improvements for Parcel 3, the Positano
Hills Park site, in accordance with plans on file with the City Engineer; and
WHEREAS, the improvements are complete in accordance with said plans, and any
approved modifications thereto, to the satisfaction of the City Engineer;
NOW, THEREFORE, BE IT RESOLVED that:
1. The offer of dedication in fee for the Positano Hills Park Site, Parcel 3 of Tract
10049, is hereby accepted.
PASSED, APPROVED AND ADOPTED this 20t" day of December, 2011, by the
following vote:
