FINANCIAL IMPACT: No financial impact to the City. All costs associated with preparing the General Plan Amendment Study, if authorized by the City Council, would be borne by the Applicant. RECOMMENDATION: Staff recommends that the City Council: 1) Receive Staff presentation; 2) Deliberate; and either 3) Adopt a Resolution approving the initiation of a General Plan Amendment Study to change the General Plan land use designation fora 1.4 acre property at the northwest corner of Dublin Boulevard and Inspiration Drive from Public/Semi-Public to Medium/High-Density Residential; OR 4) Adopt a Resolution denying the initiation of a General Plan Amendment Study to change the General Plan land use designation fora 1.4 acre property at the northwest corner of Dublin Boulevard and Inspiration Drive from Public/Semi-Public to Medium/High-Density Residential. The Public/Semi- ~ ~ ~ Public Land Use Desi nation ~ , v.,'.. - g allows a range of public and r ~ ~ t~ quasi-public uses such as schools, community centers, _ ' . a~:. places of worship, post s"~~ . _ Project Site offices, etc. The Valley ; w'~:: _ Christian Center is comprised - _ - ~ of several buildings which ~ ~ _ ~ _ ~ ~ ~ - support the church and school that operate on the site. In 2008, The Valley Christian Center submitted a request to initiate a General Plan Amendment to change the General Plan Land Use Designation of a 1.4 acre parcel located at the northwest corner of Dublin Boulevard and Inspiration Drive from Public/Semi-Public to Medium/High- Density Residential. This request was reviewed and considered by the City Council, but it was ultimately denied due to concerns about traffic and queuing at the intersection of Dublin Boulevard and Inspiration Drive. At that time, it was anticipated that a future traffic signal would be installed at the intersection of Dublin Boulevard and Inspiration Drive to help alleviate the then current traffic concerns. The City Council indicated to the Applicant that they would reconsider a request in the future after the traffic signal at that intersection had been installed. A traffic signal was subsequently installed at the intersection of Dublin Boulevard and Inspiration Drive. The Applicant has resubmitted their request to initiate a General Plan Amendment Study to consider changing the General Plan Land Use Designation from Public/Semi-Public to Medium/High-Density Residential in order to allow the development of residential uses on the property. ANALYSIS: It has been past practice for the City Council to initiate all General Plan Amendment Studies prior to Staff accepting an application and beginning work on such projects. Page 2 of 4 The Applicant's letter of request to initiate the General Plan Amendment Study is included as Attachment 1. Another component of the Applicant's request is for the City to consider selling a portion of unutilized land within the Dublin Boulevard right of way to Valley Christian Center for the purposes of including the land in a future residential project. Declaring City property "surplus" is a multi-step process and Staff is requesting, if the General Plan Amendment Study is initiated, that the City Council also provide direction to Staff to begin a surplus analysis. The cost of this analysis will be borne by the Applicant. Should the City Council initiate a General Plan Amendment Study, Staff would: 1. Determine the associated impacts from the land use change; 2. Conduct the appropriate level of environmental review and documentation; 3. Conduct a surplus analysis for the portion of unutilized Dublin Boulevard right of way that the Applicant would like to include in a future residential development project; 4. Perform any additional studies that may be required; and 5. Prepare an analysis for consideration by the Planning Commission and the City Council. Work on the General Plan Amendment Study would be completed concurrently with processing any other entitlements that are requested by the Applicant, including a Rezone, Tentative Map, and Site Development Review for a proposed residential neighborhood. Once the General Plan Amendment Study is complete, Staff would then bring the application to the Planning Commission for their recommendation to City Council. The City Council could then take action on the General Plan Amendment. Staff has prepared draft Resolutions both approving and denying the initiation of a General Plan Amendment Study to evaluate changing the General Plan Land Use Designation fora 1.4 acre property at the northwest corner of Dublin Boulevard and Inspiration Drive from Public/Semi- Public to Medium/High-Density Residential. Both Resolutions are included with this Staff Report as Attachments 2 and 3. NOTICING REQUIREMENTS/PUBLIC OUTREACH: Public noticing is not required to review a request to initiate a General Plan Amendment Study. Although not required, the City mailed notices to all property owners and tenants within 500 feet of the four parcels that comprise the Valley Christian Center. A notice was also published in the Valley Times and posted in the designated posting locations throughout the City. A copy of this Staff Report was provided to the Applicant. ENVIRONMENTAL REVIEW: Staff recommends that the project be found exempt from the California Environmental Quality Act (CEQA) under Section 15306, Class 6 of the State CEQA Guidelines because initiation of a General Plan Amendment study, in and of itself, will not result in .disturbance to an environmental resource.
