FINANCIAL IMPACT: No financial impact to the City. All costs associated with preparing the General Plan and Eastern Dublin Specific Plan Amendment Study, if authorized by the City Council, would be borne by the Applicant. RECOMMENDATION: Staff recommends that the City Council: 1) Receive Staff presentation, 2) Deliberate; and either 3) Adopt a Resolution approving the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to change the land use designations for a 14.32 acre parcel at the southwest corner of Dublin Boulevard and Hacienda Drive from Campus Office to General Commercial /Campus Office; OR 4) Adopt a Resolution denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to change the land use designations for a 14.32 acre parcel at the southwest corner of Dublin Boulevard and Hacienda Drive from Campus Office to General Commercial /Campus Office. Submitted By Director of Community Development Reviewed By Assistant City Manager Page 1 of 4 ITEM NO. 8.1 DESCRIPTION: Background Caruso Affiliated has recently completed a Purchase Agreement to acquire the 14.32 - acre parcel of land (known as Site 16A) from the Alameda County Surplus Property Authority. The site is further identified as 5054 Hacienda Drive and Assessor Parcel Number 986 -0033- 007-00. The project site is shown in the Vicinity Map to the right. Caruso Affiliated has the intention of developing a retail center on the project site. 135 Vicinity Map The property currently has a General Plan and Eastern Dublin Specific Plan land use designation of Campus Office. The Campus Office land use designation allows for non - retail commercial uses such as professional and administrative offices. Retail uses are permitted in the Campus Office category, but only as ancillary to the primary office -based uses. The current General Plan and Eastern Dublin Specific Plan land use designations for this property and the surrounding properties are shown below: Page 2 of 4 fl c fl 136 Land Use Designations owFNC, nR Z, 1, Caruso Affiliated and the Alameda County Surplus Property Authority are requesting that the City Council initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to change the land use designation for the subject parcel from Campus Office to General Commercial /Campus Office. The General Commercial /Campus Office land use category allows for a variety of regional- and community- serving retail and service uses as well as professional and administrative offices. ANALYSIS: It has been past practice for the City Council to initiate all General Plan and Specific Plan Amendment Studies prior to Staff accepting an application and beginning work on such projects. Page 3 of 4 137 The Applicant's letter of request to initiate the General Plan and Eastern Dublin Specific Plan Amendment Study, also signed by the current property owner, is included as Attachment 1. Should the City Council initiate a General Plan and Eastern Dublin Specific Plan Amendment Study, Staff will: 1. Determine the associated impacts from the land use change; 2. Conduct the appropriate level of environmental review and documentation; 3. Perform any additional studies that may be required; and 4. Prepare an analysis for consideration by the Planning Commission and the City Council. Work on the General Plan and Eastern Dublin Specific Plan Amendment Study would be completed concurrently with processing any other entitlements that are requested by the Applicant, including a Planned Development Rezone and Site Development Review for the proposed retail center. Once the General Plan and Eastern Dublin Specific Plan Amendment Study is complete, Staff would then bring the application to the Planning Commission for their recommendation to City Council. The City Council could then take action on the General Plan and Eastern Dublin Specific Plan Amendment. Staff has prepared draft Resolutions approving and denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate changing the land use designation of the subject property from Campus Office to General Commercial /Campus Office. Both Resolutions are included with this Staff Report as Attachments 2 and 3. NOTICING REQUIREMENTS /PUBLIC OUTREACH: Public noticing is not required to review a request to initiate a General Plan Amendment Study. Although not required, the City mailed notices to all property owners and tenants within 300 feet of the subject property. A notice was also published in the Valley Times and posted in the designated posting places. A copy of this Staff Report was distributed to the Applicant. ENVIRONMENTAL REVIEW: Staff recommends that the project be found exempt from the California Environmental Quality Act (CEQA) under Section 15306, Class 6 of the State CEQA Guidelines because initiation of a General Plan Amendment study, in and of itself, will not result in disturbance to an environmental resource.
