DESCRIPTION: MCE has provided maintenance services to the City of Dublin since 1984. Those services which are provided by MCE are as follows: · Bike Path Maintenance · Building Management and Maintenance · Curb, Gutter, and Sidewalk (emergency or temporary repair) · Drainage Maintenance · Guardrail Repair · Park Maintenance · Sign Installation, Repair & MaintenanCe · Spill Cleanup · Storm Patrol/Cleanup · Street Landscaping Maintenance · Street Repair (emergency or temporary repair) · Street Tree Maintenance · Striping and Mar'king (emergency replacement) · Weed Abatement The agreement with MCE Corporation for maintenance services is a one year agreement with two optional one-year extensions. A new agreement was approved effective July 1, 1999, and it is proposed to extend the agreement for an additional one year period and amend the rate schedule as indicated below. As with COPIES TO: MCE Corporation g:\contractskmce\agst amend 2000 ITEM NO. previous years, MCE has submitted a budget proposal for FY 2000-2001. reviewed by Staffin conjunction with the budget process. This proposal has been Proposed Changes for 2000-2001 MCE is proposing an average 4% cost of living increase in labor rates for the permanent Dublin crew, as well as an average 4% increase in equipment rates. This is commensurate with the Consumer Price Index rate of increase. The labor rates for other MCE crews are proposed to increase an average of 6%; however, the equipment rates for the other MCE crews are NOT proposed to change. The other MCE crews are used infrequently in Dublin on an as-needed basis. Most rates for work performed by subcontractors are proposed to change by about 4%; the rates for subcontract tree trimming and fertilizing and broadleaf weed control in street turf would not change. Total expenditures under MCE's contract for FY 1999-2000 are anticipated to be over budget by $6,386, including the "extra work" category (Capital Project work and other unplanned or unbudgeted activities), and under budget by $34,324 not including "extra work." The activity under "extra work" in Fiscal Year 1999-2000 consisted largely of furniture moving and other work associated with the Civic Center expansion project,~ as well as administrative or associated work for other building- or park-related Capital Improvement Projects The overall budget for 2000-2001 is projected to be a total of $1,518,833 which represents an increase of $281,740 (22.77%) over the 1999-2000 budget, or an increase of $275,354 (22.14%) over projected 1999-2000 expenditures (including "extra work"). The primary reasons for the increase are MCE's proposed rate increase, the addition of Emerald Glen Park and Martin Canyon Creek for an entire year and the Tassajara Creek landscaping for a portion of the year, and other anticipated addkional street maintenance and street landscape maintenance in new development areas. Recommendation MCE Corporation has shown a consistent standard of excellence in performance and safety, as well as concern for the fiscal interests of the City. Staff recommends that the City Council adopt the resolution (Attachment 1) approving the amendment to the agreement. Page 2 RESOLUTION NO. - O0 A RESOLUTION OF ~ CITY COUNCIL OF TIlE CITY OF DUBLIN APPROVING AMENDMENT TO AGREEMENT WITH MCE CORPORATION FOR PUBLIC WORKS MAINTENANCE SERVICES WHEREAS, on June 24, 1999, the City Council approved an agreement with MCE Corporation for Public Works Maintenance Services; and WHEREAS, said agreement provided a detailed scope of work and labor rates for Fiscal Year 1999-2000; and WHEREAS, MCE Corporation is requesting a cost of living increase in labor, vehicle, and subcontract rates for Fiscal Year 2000-2001; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the amendment to the agreement with MCE Corporation attached hereto as "Exhibit A," with an effective date of July 1, 2000. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the amendment. PASSED, APPROVED AND ADOPTED this 20th day of June, 2000. AYES: 'NOES: ABSENT: ABSTAIN: ATTEST: Mayor City Clerk C :~eontracfimaint~resoamnd EXtt]Brr "A" OF RESOLUTION 4)0 AMENDMt;NT TO AGREEMENT BETWEEN CITY OF DUBLIN AND MCE CORPORATION FOR PUBLIC WORKS MAINTENANCE SERVICES WI-IEREAS, on June 24, 1999, the City of Dublin (hereinafter referred to as "CITY" and MCE Corporation (hereinafter referred to as "CONTRACTOR") entered into an agreement to provide Public Works Maintenance Services to CITY (hereinaRer referred to as "AGREEMENT); and WHEREAS, said AGREEMENT provided a rate schedule for Fiscal Year 1999-2000; and WHEREAS, MCE Corporation has requested a cost of living increase in labor, vehicle, and subcontract rates for Fiscal Year 2000-2001; NOW, THEREFORE, the parties hereto agree as follows: Section 1.~ Exhibit B, "Payment Schedule," of the Agreement shall be amended by replacing Attachment 1 in the current Agreement with Attachment 1 of this Amendment, said Attachment 1 being identified as "Exhibit B Payment Schedule 2000-2001." 2000. Section 2. Said revision in Exhibit B "Payment Schedule" shall be effective as of Juty 1, Section _3. The term of agreement shall be extended until June 30, 2001.
