EXECUTIVE SUMMARY:
Staff is seeking City Council authorization to award Fallon Sports Park - Fencing Contract #11-
08. The project entails the installation of fencing on the south side of the parking lot and wood
bollards on the north side to manage vehicular and pedestrian access.
FINANCIAL IMPACT:
The Fiscal Year 2010-2011 Budget for Park Maintenance included $27,000 for fence installation
at the Fallon Sports Park. The bid proposal of $19,919 from Golden Bay Fence Plus Iron
Works Incorporated, including a 10% contingency, is $21,910.90. Since the work was not
completed in Fiscal Year 2010-2011, the funding will be included in the Fiscal Year 2010-2011
Budget Carryovers.
RECOMMENDATION:
Staff recommends that the City Council adopt the resolution awarding Contract #11-08 Fallon
Sports Park - Fencing to Golden Bay Fence Plus Iron Works Incorporated.

DESCRIPTION:
Fallon Sports Park was completed and opened to the public in July 2010. After several months
in operation it was noted that there were areas of the park that needed additional barriers to
manage public access. Specifically, on the north side of the parking lot, unauthorized vehicles
have entered into the undeveloped portions of the park and on the south side pedestrians have
traversed down the hill to the soccer fields causing erosion. The Site Plan (Attachment 1)
identifies the two areas. In order to address those problems the project entails the installation
of wood bollards along the north side of the parking lot and a 6 foot chain link fence along the
south side of the parking lot. These measures are being taken to ensure public safety and to
protect the park from further damage.
Bids for Fallon Sports Park - Fencing were opened on Wednesday, August 3, 2011 and the
results are shown in Attachment 2. Although California Fence Supply submitted the lowest
apparent bid, upon review it was deemed that they were non-responsive since the proposal did
not include all of the required documents (Attachment 3). Among other items, the California
Fence Supply bid was not accompanied by a bidder's security. Public Contract Code section
10167 prohibits the consideration of bids that lack such security. In that regard, Staff
recommends that the City Council adopt the proposed resolution (Attachment 4) awarding the
contract to Golden Bay Fence Plus Iron Works Incorporated, as their bid proposal was deemed
responsive and responsible.
The schedule for the project is as follows:
1) Award Contract August 16, 2011
2) Project Construction September 2011
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Upon City Council award of contract, Staff will notify Dublin United Soccer League of the
construction. The work will not impact field use.

NOTICE AND OPPORTUNITY TO SUBMIT MATERIALS CONCERNING
RESPONSIVENESS OF BID

Pursuant to Section 6.A in the Instructions to Bidders for this project, which provides in pertinent part that "the City.
reserves the right to reject any or all bids" please be advised that City of Dublin staff intend to recommend that the
bid received from California Fence Supply for this project be found non-responsive and rejected due to the failure of
Califomia Fence Supply to submit a bid bond, list of subcontractors, non-col~usion affidavit, references and signature
page at the time of bid opening in accordance with Section 4 C of the Instructions to Bidders. . In addition, with
respect to the failure to submit a bid bond, Public Contract Code section 10167 provides that a bid "shall not be
considered unless one of the forms of bidder's security is enclosed with it."
The purpose of this letter is to afford California Fence Supply notice and opportunity to submit any materials .
California Fence Supply wishes concerning the responsiveness of its bid.
The City Council may make a decision concerning award of the project at its meeting on Tuesday, August 16,
2011. Failure to provide information that establishes the responsiveness of the bid by 5:00 p.m. on Friday,
August 12, 2011, may resuft in rejection of the bid as non-responsive and award of the project to the next- .
lowest, responsive bidder. This notice antl opportunity to submit materials is provided in accordance with the
requirements of Ghilotti Construction Co., v. Richmond (1996).45 Cal. App 4~ 897. ,

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

AWARDING CONTRACT NO. 11-08
FALLON SPORTS PARK - FENCING
TO
GOLDEN BAY FENCE PLUS IRON WORKS INCORPORATED
WHEREAS, the City of Dublin did, on August 3, 2011, publicly open, examine and
declare all sealed bids for doing the work described in the approved Plans and Specifications for
Contract No. 11-08, which Plans and Specifications are hereby expressly referred to for a
description of said work and for all particulars relative to the proceedings under the request for
bids; and
WHEREAS, the apparent lowest bid for the Project was the bid of California Fence
Supply in the amount of twelve thousand dollars ($12,000); and
WHEREAS, California Fence Supply failed to submit a bid bond at the time of bid
opening and Public Contract Code section 10167 provides that a bid "shall not be considered
unless one of the forms of bidder's security is enclosed with it"; and
WHEREAS, California Fence Supply also failed to submit a list of subcontractors, a non-
collusion affidavit, references or signature page with its bid, as required by the bid solicitation
materials; and
WHEREAS, by the letter dated August 5, 2011 Staff notified California Fence Supply of
such failure and of Staff's intent to recommend that the City Council reject the bid of California
Fence Supply as non-responsive and afforded California Fence Supply an opportunity to submit
materials concerning the responsiveness of its bid in accordance with the case of Ghilotti
Construction Co. v Richmond (1996) 45 Cal.App. 4th 897, and
WHEREAS, the apparent next lowest bid for the Project was submitted by Golden Bay
Fence Plus Iron Works Incorporated in the amount of nineteen thousand, nine hundred and
nineteen dollars ($19,919).
NOW, THEREFORE, the City Council of the City of Dublin does RESOLVE as follows:
1. The City Council of the City of Dublin, hereby finds the bid submitted by California
Fence Supply in the amount of $12,000 to be non-responsive due to the failure of
California Fence Supply to submit a bid bond and other required materials at the
time of bid opening and rejects such bid.
2. The City Council of the City of Dublin, hereby finds the bid submitted by Golden
Bay Fence Plus Iron Works Incorporated in the amount of $19,919 to be the
lowest, responsive bid.
3. The City Council of the City of Dublin, does hereby award Contract No. 11-08 to
the lowest responsible bidder therefor, to wit, Golden Bay Fence Plus Iron Works
