The Tract Improvement Agreement for Parcel Map 9827, Fallon Gateway, with Stanforth
Holding Company, LLC, and Whiting-Turner Contracting Company, is for roadway
improvements to provide frontage and access to the Stanforth Holding Company's Fallon
Gateway retail center located on the southwest corner of Fallon Road and Dublin Boulevard
(Attachment 1). These improvements include traffic signals for the Fallon Gateway entrances
on Dublin Boulevard and Fallon Gateway, Dublin Boulevard widening and frontage
improvements, and landscaping the Dublin Boulevard median.
Whiting-Turner Contracting Company has constructed the improvements for the Stanforth
Holding Company in accordance with the Improvement Agreement for Parcel Map 9827, Fallon
Gateway. Staff is recommending that the City Council adopt the proposed Resolution
(Attachment 2) accepting those improvements and regulatory traffic control devices.
Whiting-Turner Contracting Company provided a Performance Bond, and a Labor and Materials
Bond furnished by the Fidelity and Deposit Company of Maryland in the amount of $755,000.00
(Bond No. 9010398) for the improvements associated with the Tract Improvement Agreement
for Parcel Map 9827, Fallon Gateway. These bonds may now be released in accordance with
the authority contained in §66499.7 of the Government Code. Whiting-Turner Contracting
Company has provided a Warranty Bond (Attachment 3) issued by Fidelity and Deposit
Company of Maryland in the amount of $189,000.00 (Bond No. 9010398) to guarantee, for one
year, the improvements associated with the Tract Improvement Agreement for Parcel Map
9827, Fallon Gateway.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
No public noticing is required for accepting these improvements. A copy of Staff Report was
sent to Jim Tong, Stanforth Holding Company.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING ACCEPTANCE OF IMPROVEMENTS FOR
PARCEL MAP 9827, FALLON GATEWAY,
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the Stanforth Holding Company, LLC, and the City of Dublin entered into an
Tract Improvement Agreement for Parcel Map 9827, Fallon Gateway, on December 15, 2009,
Resolution 181-09, and amended to include Whiting-Turner Contracting Company as a party to
the Agreement on July 20, 2010, Resolution 105-10, to construct roadway improvements in
accordance ~with plans on file with the City Engineer; and
WHEREAS, the improvements associated with Parcel Map 9827, Fallon Gateway are
complete in accordance with said plans, and any approved modifications thereto, to the
satisfaction of the City Engineer; and
WHEREAS, certain regulatory traffic control devices have been installed as part of these
improvements; and
WHEREAS, the Performance Bond, and the Labor and Materials Bond can be released,
in accordance with the authority contained in §66499.7 of the Government Code of the State of
California, and replaced with a Warranty Bond to guarantee the completed work for a one-year
period following acceptance; and
WHEREAS, Whiting-Turner Contracting Company, has provided a Warranty Bond to
guarantee the improvements for a one-year period;
NOW, THEREFORE, BE IT RESOLVED that:
The improvements associated with Parcel Map 9827, Fallon Gateway are hereby
approved and accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by Fidelity and Deposit Company of
Maryland in the amount of $ 755,000.00 (Bond No. 9010398) for the
improvements identified as "Dublin Boulevard, Phase II Improvements, Dublin
Boulevard, Phase II Landscaping, and Fallon Gateway Entry Traffic Signals"; and
3. The original Labor and Materials Bond issued by Fidelity and Deposit Company of
Maryland in the amount of $ 755,000.00 (Bond No. 9010398) for the
improvements identified as "Dublin Boulevard, Phase II Improvements, Dublin
Boulevard, Phase II Landscaping, and Fallon Gateway Entry Traffic Signals"; and

4. The submitted Warranty Bond issued by Fidelity and Deposit Company of
Maryland in the amount of $189,000.00 for the improvements identified as "Dublin
Boulevard, Phase II Improvements, Dublin Boulevard, Phase II Landscaping, and
Fallon Gateway Entry Traffic Signals" (Bond No. 9010398) be accepted as
security for the aforesaid one-year warranty period, said period to commence on
this date and terminate on the 19th day of July, 2012.
5. The traffic regulatory devices installed by the developer are hereby included in the
City of Dublin Traffic Code, said regulatory devices to include the following:
a) Traffic signal control on Fallon Road at the Fallon Gateway entrance.
b) Traffic signal control on Dublin Boulevard at the Fallon Gateway entrance.
