HomeMy WebLinkAboutPC Reso 11-16 Crossroads Office Ctr SDRRESOLUTION NO. 11-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING A SITE DEVELOPMENT REVIEW PERMIT FOR FACADE AND LANDSCAPE MODIFICATIONS AT CROSSROADS OFFICE CENTER 6375-6379 CLARK AVENUE (APN 941-1401-016, 941-1401-017 & 941-1401-018) PLPA-2011-00016 WHEREAS, the Applicant, Dave Johnson of Johnson Lyman Architects, on behalf of the Sleepy Hollow Investment Company, submitted an application for Site Development Review for facade and landscape modifications at the Crossroads Office Park; and WHEREAS, the Chapter 8.104 (Site Development Review) of the Dublin Zoning Ordinance establishes procedures for reviewing facade and landscape modifications in commercial zoning districts; and WHEREAS, the Community Development Director has the authority to review such modifications or may refer decision-making authority to the Planning Commission for review; and WHEREAS, the Community Development Director is referring decision making authority to the Planning Commission for review; and WHEREAS, the California Environmental Quality Act (CEQA), together with State Guidelines and City Environmental Regulations require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, pursuant to the CEQA, Staff is recommending that the Planning Commission find this project Categorically Exempt under Section 15301, Class 1 (minor alteration of an existing structure involving negligible or no expansion of the use) of the State of California Environmental Quality Act (CEQA) Guidelines; and WHEREAS, a Staff Report was submitted to the City of Dublin Planning Commission recommending approval of the Site Development Review request; and WHEREAS, the Planning Commission held a public hearing on said application on May 24, 2011; and WHEREAS, proper notice of said hearing was given in all respects as required by law; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations .and testimony herein above set forth and used its independent judgment to evaluate the project. NOW, THEREFORE, BE IT RESOLVED that the City of Dublin. Planning Commission does hereby make the following findings and determinations regarding the Site Development Review: A. The proposal is consistent with the purposes of Chapter 8.104, with the General Plan and with any applicable Specific Plans and design guidelines in that: 1) .the project will enhance the architectural character of the three existing office buildings through the addition of enhanced entry features with decorative sconces and the use of a variety of materials and colors on the existing buildings including stone veneer, horizontal and vertical siding, and three complementary color schemes; 2) the project is consistent with the General Plan Community Design and Sustainability Element .which encourages diverse, high quality, attractive and architecturally appealing buildings through the use of a variety of colors and materials to enhance the aesthetics of the existing buildings; and 3) the project is consistent with the Community Design &Sustainability Element policy of incorporating clear and identifiable entries in office areas. B. The proposal is consistent with the provisions of Title 8, Zoning Ordinance in that: 1) the project is subject to a Site Development Review permit as it includes fagade modifications in a commercial district and a complete application has been submitted. for Site Development Review; 2) the height of the new entry features (28-feet) is consistent with the building height and is below the maximum height allowed (35-feet) for the C-O (Commercial Office) Zoning District; and 3) the landscape modifications include infilling existing landscaped areas with groundcover, shrubs and cobblestone .and due to the limited scope of work is not subject to compliance with the Water Efficient Landscape Regulations. C. The design of the project is appropriate to the City, the vicinity, surrounding properties and the lot in which the project is proposed in that: 1) the project ..enhances the architecture of the three existing office buildings and uses a variety of building materials and colors that compliment other building improvements in the project vicinity including the Venture Commerce Center and Dublin Crossroads shopping center. D. The subject site is physically suitable for the type and intensity of the approved development in that: 1) the project consists of facade and landscape modifications .and would not alter the use of the property or increase the intensity of the existing use.. E. Impacts to existing slopes and topographic features are addressed in that.' 1) the project site is fully developed and relatively flat and the facade and landscape modifications will not alter the existing topography of the site. F. Architectural considerations including the character, scale and quality of the design, site layout, the architectural relationship with the site and other buildings, screening of unsightly uses, lighting, building materials and colors and similar elements result in a project that is harmonious with its surroundings and compatible with other development in the vicinity in that: 1) the project will enhance the three existing office buildings with Craftsman style architecture, the addition of enhanced entry features with decorative sconces and the use of a variety of materials and colors on the existing buildings including stone veneer, horizontal and vertical siding, and three complementary color schemes; and 2) the project enhances the architecture of the three existing office buildings and uses a variety of building materials and colors that compliment other building improvements in the project vicinity including the Venture Commerce Center and Dublin Crossroads shopping center. 2 of 9 G. Landscape considerations, including the location, type, size, color, texture and coverage of plant materials, and similar elements have been incorporated into the project to ensure visual relief, adequate screening and an attractive environment for the public in that: 1) the project includes minor landscape modifications to infill existing landscaped areas. with groundcover, shrubs and cobblestone utilizing plant material that is consistent and complimentary to the existing plant material on-site; and 2) the introduction of cobblestone into the landscaped areas addresses water intrusion at the base of the office buildings, reduces overall water usage within the existing landscaped areas and is interwoven with existing and proposed plant material to add design element within the existing landscape. H. The site has been adequately designed to ensure proper circulation for .bicyclists, pedestrians and automobiles in that: 1) the project site is fully developed and two existing driveways provide vehicular access from Clark Avenue and an existing sidewalk provides pedestrian access from Clark Avenue; 2) on-site vehicular circulation and parking is adequate and no modifications are proposed in these areas; and 3) existing pedestrian walkways connecting the three office buildings is existing and will be enhanced with the proposed landscape modifications. BE IT FURTHER RESOLVED that the City of Dublin Planning Commission does hereby approve a Site Development Review for facade and landscape modifications at the Crossroads Office Center as shown on the project plans date stamped received by Dublin Planning on March 28, 2011 subject to the following conditions: CONDITIONS OF APPROVAL Unless stated otherwise, all Conditions of Approval shall be complied with prior to establishment of use and shall be subject to Planning Division review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval: [PL] Planning; [B] Building; [PO] Police; [PW] Public Works; [ADM] Administration/City Attorney; [FIN] Finance; [PCS] Parks and Community Services; [F] Dublin Fire Prevention; [DSR] Dublin San Ramon Services District; [LDD] Livermore Dublin Disposal; [CO] Alameda County Department of Environmental Health; [Zone 7] Alameda County Flood Control and Water Conservation District, Zone 7; [LAVTA] Livermore Amador Valley Transit Authority; and [CHS] California Department of Health Services. NO, CONDITIONS OF APPROVAL Agency When Required Prior to: Source GEN ERAL 1. Approval. This Site Development Review approval PL Ongoing Standard for the Crossroads Office Center located at 6375- 6379 Clark Avenue (PLPA-2011-00016) establishes the detailed design concepts and regulations for exterior modifications to the. existing buildings and minor modifications to existing landscaping. Development pursuant to this Site Development Review shall generally conform to the project plans re ared b Johnson Lyman Architects dated March 3of9 tdO. CONDITIONS OF APPROVAL Agency When Source Required '.Prior to: 28, 2011 and the landscape plans prepared by Thomas Baak & Associates, LLP dated April 29, 2011 on file in the Community Development Department and other plans, text, and diagrams related to this Site Development Review, unless modified by the Conditions of A royal contained herein. 2. Effective Date. This Site Development Review PL Ongoing Standard approval becomes effective 10 days after action by the Planning Commission unless appealed in accordance with Chapter 8.136. (Appeals) of the Dublin Zonin Ordinance. 3. Permit Expiration. Construction or use shall PL 2 years of DMC commence within two (2) years of Permit approval or Permit 8.96.020. the Permit shall la se and become null and void. a royal D 4. Time Extension. The original approving decision- PL Permit Standard maker may, upon. the Applicant's written request for Expiration an extension of approval prior to expiration, and upon the determination that any Conditions of Approval remain adequate to assure that applicable findings of approval will continue to be met, grant a time extension of approval for a period not to exceed six (6) months. All time extension requests shall be noticed and. a public hearing or public meeting shall be held as required b the particular Permit. 5. Modifications. The Community Development PL On-going DMC Director may consider modifications or changes to 8.104 this Site Development Review approval. if the modifications or changes proposed comply with Chapter 8.104 (Site Development Review) of the Zonin Ordinance. 6. Revocation of Permit. The Site .Development PL On-going DMC Review approval shall be revocable for cause in 8.96.020.1 accordance with Section 8.96.020.1 of the Zoning Ordinance. Any violation of the terms or conditions of this ermit shall be sub'ect to citation. 7. Indemnification. The Developer shall defend, Various On-going Gov. indemnify, and hold harmless the City of Dublin and Code its agents, officers, and employees from any claim, Section action, or proceeding against the City of Dublin or its 66499.37 agents, officers, or employees to attack, set aside, void, or annul an approval of the City of Dublin or its advisory agency, appeal board, Planning Commission, City Council, Community Development Director, Zoning Administrator, or any other department, committee, or agency of the City to the extent such actions are brought within the time period 4 of 9 NO. CQNDITIONS OF APPROVAL Agency When Source Required Prior to: required by Government Code Section 66499.37 or other applicable law; provided, however, that The Developer's duty to so defend, indemnify, and hold harmless shall be subject to the City's promptly notifying The Developer of any said claim, action, or proceeding and .the City's full cooperation in the defense of such actions or roceedin s. 8. Fees. Applicant/Developer shall pay all applicable FIN Issuance Standard fees in effect, including, but not limited to, Planning of Building fees, Building fees, Traffic Impact Fees, TVTC fees, Permits Dublin San Ramon Services District fees, Public Facilities fees, Dublin Unified School District School Impact fees (per agreement between Developer and School District), Fire Facilities Impact fees, Noise Mitigation .fees, Inclusionary Housing In-Lieu fees, Alameda County Flood and Water Conservation District (Zone 7) Drainage and Water Connection fees; or any other fee that may be adopted and a licable. 9. Requirements and' Standard Conditions. The Various Building Standard Applicant/Developer shall comply with applicable City Permit of Dublin Fire Prevention Bureau, Dublin Public Issuance Works Department, Dublin Building Department, Dublin Police Services, Alameda County Flood Control District Zone 7, Livermore Amador Valley Transit Authority, Alameda County Public and Environmental Health, Dublin San Ramon Services District and the California Department of Health Services requirements and standard conditions. Prior to issuance of building permits or the installation of any improvements related to this project, the Developer shall supply written statements from each such agency or department to the Planning Department, indicating that all applicable conditions re uired have been or will be met. PLANNING 10. Colors, Materials and Finishes. All colors, PL Occupancy Planning materials and finishes on the exterior of the building and shall be installed and maintained consistent with this Ongoing Site Develo ment Review. 11. Wall Sconces. Wall sconces shall be installed at PL Ongoing Planning both renovated building entrances. Light fixtures shall be maintained in good working order at all times and bulbs re laced as needed in a time) manner. 12. Exterior Maintenance and Repair. Buildings which have faded, cracked, chipped or pealing exterior paint shall be repainted and maintained in good condition at all times. 13. Landscaping. All existing and new landscaping shall PL Ongoing Planning be maintained in good condition at all times. Irrigation shall be provided and utilized as needed to maintain healthy and viable plant material. Dead, decayed, diseased or other vegetation constituting an unsightly appearance shall be removed and replaced with viable plant material of the same or comparable t e. 14. Property Maintenance. The Applicant/Developer PL Ongoing Planning and property owner shall be responsible for maintaining the site in a clean and litter free condition during construction and through completion. Per the City of Dublin Non-Residential Property Maintenance Ordinance, DMC Section 5.64.050, the Applicant/ Property Owner shall maintain the building, site and all signage in good condition and shall keep the site clear of trash, debris and graffiti vandalism on a re ular and continuous basis. 15. Accessory/Temporary Structures and Uses. A PL Placement Planning Temporary Use Permit is required for all construction on site trailers, security trailers and storage containers used durin construction. 16. Master Sign Program. A Master Sign Program PL Ongoing Planning shall be submitted for review and approval prior to the installation of an ermanent wall si na e. 17. Temporary Signage. All temporary signage shall be PL Ongoing DMC subject to the regulations of Chapter 8.84 (Sign 8.84 Re ulations of the Zonin Ordinance. PUB LIC WORKS 18. Sitework Permit. All improvement work must be PW Issuance Public performed per aGrading/Sitework Permit issued by of Grading/ Works the Public Works Department. Said permit will be Sitework based on the final set of civil plans to be approved Permit once all of the plan check comments have been resolved. Please refer to the handout titled Grading/Site Improvement Permit Application Instructions and attached application (three 8-1/2" x 11" pages) for more information. The Applicant/Developer must fill in and return the applicant information contained on pages 2 and 3. The current cost of the permit is $10.00 due at the time of ermit issuance, although the 6of9 NO. Applicant/ PW Issuance of Public Developer shall include an Erosion and Sediment Sitework Works Control Plan with the Grading and Improvement plans Permit and for review and approval by the City Engineer/Public During Works Director. Said plan shall be designed, Construction implemented, and continually maintained pursuant to the City's NPDES permit between October 1st and April 15th or beyond these dates if dictated by rainy weather, or as otherwise directed by the City En ineer/Public Works Director. 20. Site Accessibility Requirements. All disabled PW Occupancy Public access ramps, parking spaces for the disabled, and Works other physical site improvements shall comply with current UBC Title 24 requirements and City of Dublin Standards for accessibility. Number of accessible parking stalls provided on site shall meet the current Title 24 re uirements Ch 11, Table 116-6 . 21. Temporary ~ Fencing. Temporary Construction PW During Public fencing shall be installed along perimeter of all work Construction Works under construction to separate the construction and operation from the public. Construction materials and/or equipment shall not be operated or stored outside of the fenced area or within the public right-of-way unless approved in advance b the Ci En ineer/Public Works Director. 22. Construction Hours. Construction and grading ' PW During Public operations shall be limited to weekdays (Monday Construction Works through Friday) and non-City holidays between the hours of 7:30 a.m. and 5:00 p.m. The Applicant/Developer may request permission to work on Saturdays and/or holidays between the hours of 8:30 am and 5:00 pm by submitting a request form to the City Engineer no later than 5:00 pm the prior Wednesday. Overtime inspection rates will apply for all Saturda and/or holida work. 23. Damage/Repairs. The Applicant/ Developer shall be PW Occupancy Public responsible for the repair of any damaged pavement, Works curb & gutter, sidewalk, or other public street facility resulting from construction activities associated with the develo ment of the ro'ect. 24. Water Quality/Best Management Practices. PW Issuance of Public Pursuant to the Alameda Countywide National Grading/ Works Pollution Discharges Elimination Permit (NPDES) No. Sitework 7 of 9 NO. CONDITIONS OF APPROVAL Agency When Source Required Prior to: CAS0029831 with the California Regional Water Permit Quality Control Board (RWQCB), the applicant shall design and operate the site in a manner consistent with the Start at the Source publication, and according to Best Management Practices to minimize storm water pollution. All storm drain inlets serving vehicle parking areas and connecting to the public storm drain shall be fitted with Filter Devices to remove Hydrocarbons and other contaminants, and all storm drain inlets shall have drain markers "No Dumping -Drains to Creek" using an approved marker available .from the Alameda Countywide Clean Water Pro ram. 25. Driveway. Applicant shall remove and replace the all PW Issuance of Public existing driveways on Clark Avenue per current City Grading/ Works of Dublin and ADA/Title 24 standards. Sitework Permit 26. Damaged Sidewalk. If required, the Applicant/ PW Issuance of Public Developer shall repair any damaged and/or Grading/ Works protruding sidewalk on Clark Avenue along the Sitework ro~ect fronta a Permit 27. Landscape Islands. The Applicant/Developer shall PW Issuance of Public replace the protruding island curbs and modify Grading/ Works parking stalls to install 12" concrete step out curbs. Sitework Permit 28. Bicycle Racks. Bicycle racks shall be installed near PW, PL Occupancy Public the entrances to the office and retail buildings at a Works ratio of 1 rack per 40 vehicle parking spaces. Bicycle and racks shall be designed to accommodate a minimum Planning of four bicycles per rack, and so that each bicycle can be secured to the rack. .The location of the bicycle racks shall not .encroach into any adjacent/adjoining sidewalks in a manner that would. reduce the unencumbered width of the sidewalk to less than 4'. Bicycle racks shall be placed in locations where they will have adequate lighting and can be surveilled by the buildin occupants. 29. Vehicle Parking. Applicant should repair .any PW Occupancy Public distressed areas of pavement within the existing Works parking field, then seal and re-stripe the entire parking field. All parking spaces shall be double striped using 4" white lines set approximately 2 feet { apart according to City standards and §8.76.070 (A) 17 of the Dublin Municipal Code. All compact-sized parking spaces shall have the word "COMPACT" stenciled on the avement within each mace. 12"- 8 of 9 NO. CONDITIONS OF APPROVAL Agency When Source. Non-Residential Security Requirements.
