The meeting was called to order at 7:00 p.m. by Cm. Barnes, Chairperson. ~ ~ ~ ~ ROLL CALL PRESENT: Commissioners Barnes, Burnham, Mack, Okun, and Zika, Laurence L. Tong; Planning Director, La.ura Hoffineister, Associate Planner; and Gail Adams, Planning Secretary. ~ ~ ~ ~ PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Barnes led the Commission, Staff, and those present in the pledge of allegiance to the flag. , ~ ~ ~ ~ ADDITIONS OR REVISIONS TO THE AGENDA None * ~ ~ ~ MINUTES OF PREVIOUS MEETING The minutes of November 21, 1988 were approved. ~ ~ ~ ~ ORAL COMMUNICATIONS Mr. Tong advised that the Planning Comrnission Rules of Procedures provide that officers be elected at the first meeting of the Commission in December of each year and that unless a vacancy occurred, the new terms of office would be ' until December of 1989. Cm. Zika nominated Valerie Barnes for Chairman, seconded by Cm. Okun. With a unanimous vote of 5-0, Valerie Barnes was elected Chairman. Cm. Mack nominated Bill Burnham for Vice-Chairman, seconded by Cm. Zika. With a unanimous vote of 5-0, Bill Burnham was elected Vice-Chairman. Cm. Mack nominated Laurence Tong as Secretary, seconded by Cm. Burnham. With an unanimous vote of 5-0, Laurence Tong was eleeted Secretary. ~~~~*~~c~~~~~~~~~*~~r~~~c~~~~~~~r~c~~~~c~~~~~~~~~t~~~~~~~c~~~~~t~~~~~~~~~~~c~~~~~~~ Regular Meeting PCM-7-216 December 5, 1988 , , . • ~ ~ ~ * * WRITTEN CONIl~IUNICATIONS Mr. Tong advised that the Commission had received 20 action letters. ~ ~ ~ ~ PUBLIC HEARINGS SUBJECT: PA 88-123 Gordon Auto Sales Conditional Use Permit request to allow wholesale and retail auto sales of new and used automobiles within an enclosed existing building in an M-1 (Li~ht Industrial) District at 6979 Sierra Court Cm. Barnes opened the public hearing and called for the Staff Report. Ms. Hoffineister indicated that this application was for a Conditional Use Permit to allow wholesale auto sales and retail sales of new and used automobiles at 6979 Sierra Court. Ms. Hoffineister indicated that on July 10, 1980 the Alameda County Planning Department approved a Site Development for an approximate 53,000 square foot building. Ms. Hoffineister indicated that about 30 vehicles could be stored in the building. There would be no large delivery trucks involved as the Applicant would be driving the cars in and out of the building. There would be mostly wholesale business activities with some retail and used car sales. Ms. Hoffineister indicated that the impacts to adjoining businesses, noise, traffic and parking were some concerns related to this project. The adjoining businesses were somewhat similar; traffic and parking problems were non- existent because the use would involve fewer employees than most other businesses with the same amount o£ space; and there would be no auto servicing or repair being done on the premises so noise was not a factor. Ms. Hoffineister stated that all concerned departments were notified and some minor improvements (security locks, extra ventilation and fire extinguishers) would be necessary. Ms. Hoffineister stated that Staff was recommending approval of the application. Cm. Burnham asked if there would be any suto repair work or service being done on the premises. Okun asked where would the line be drawn on the maintenance of the cars. Mr. Tong indicated that it would strictly be limited to washing the car and maintaining the fluids. Mark Gordon, Applicant, 11476 Cresta La.ne, indicated that he was in agreement with the Staff's report and recommendations. Cm. Zika asked if he specialized in certain car models. Mr. Gordon indicated that the cars would be in the price range of $4,000 - $8,000. Cm. Zika asked how the cars were being transported. Mr. Gordon indicated that the cars would be driven by hirnself. A car transporter was not economically feasible. Cm. Mack asked if Mr. Gordon had more in mind regarding auto repair than washing and maintaining fluids in the car. Mr. Gordon stated no, that minor maintenance was all that would be done. Cm. Burnham asked if there would be accessories for sale and what type of people would be interested in his cars. Mr. Gordon indicated that there would not be any accessories and wholesalers would be selling to retailers. Cm. Barnes closed the public hearing. On motion from Cm. Mack, seconded by Cm. Zika, with a vote of 5-0, the Planning Commission adopted RESOLUTION N0. 88-070 APPROVING CONDITIONAL USE PERMIT CONCERNING PA 88-123 GORDON AUTO SALES SUBJECT: PA 87-031 East Dublin General Plan Amendment/Specific P1an Studies and EIR. Review of the Administrative Draft Goals, Policies and Objectives of the East Dublin General Plan Amendment (to he continued) Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Tong indicated that this item was originally scheduled for the Planning Commission's last meeting and continued to this meeting. Mack asked Mr. Tong to look into a letter she had received regarding ground water projects. ~ ~ ~ ~ OTHER BUSINESS Cm. Barnes asked if a date had been scheduled for the Planning Commission Institute. Mr. Tong indicated that the dates were April S, 6, and 7, 1989 and would be held in Monterey. Cm. Barnes welcomed Cm. Okun to the Planning Commission. Cm. Okun indicated that he was happy to part of the Planning Commission. ~ ~ ~ ~ PLANNING COMMISSIONERS' CONCERNS Cm. Barnes had concerns on illegal signage and how the signs were being put up on the weekends only, when they wouldn't be noticed. Mr. Tong indicated that the real estate agents were being over zealous. He indicated that the Zoning Investigator was not available after regular working hours. Mr. Tong indicated that he could coordinate with the Police Department and the police could issue a citation if the correct Ordinance number is cited. Cm. Barnes and Cm. Zika asked if a Condition of Approval could be established in the Directional Tract Sign resolutions making the developer responsible for these signs. Mr. Tong indicated that a condition requiring a cash deposit to pay for a Zoning Investigator on irregular working hours could be added to the Resolution of Approval. Cm. Burnham asked if the posters on telephone poles could be maintained. Mr. Tong indicated that the maintenance crew tried to keep up with this problem. Cm. Cm. Zika asked about the vehicles that were definitely stationary. Mr. Tong indicated that these were taken care of on a case-by-case basis. Cm. Zika asked if the Police Department had authority to chalk mark the tires on these vehicles. Mr. Tong indicated that the Zoning Investigator had the sutharit~ tg do this and the police would have to call the City stating the appropriate;section of the Zoning Ordinance. ~ ~ ~ ~ ~ .
