The meeting was called to order at 7:00 p,m, by Cm. Barnes, Vice Chairperson. ~ ~ ~ ~ ROLL CALL PRESENT: Commissioners Barnes, Burnham, Mack, Barnes, Tempel and Zika, Laurence L. Tong, Planning Director, Rod Barger, Seniar Planner, and Kevin Gailey, Senior Planner. ~ ~ ~ ~ PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Barnes led the Commission, Staff, and those present in the pledge of allegiance to the flag. ~ ~ ~ ~ ADDITIONS OR REVISIONS TO THE AGENDA Cm. Barnes requested that the Oath of Office, be administered at this point of the Agenda. ORAL COMMUNICATIONS Kay Keck, Deputy City Clerk, administered the Oath of Office to George Zika and Pat Teinpel, newly appointed Planning Commissioners. There were no other Oral Communications. ~ ~ ~ ~ ~ MINUTES OF PREVIOUS MEETING ~I The minutes of the meeting of October 5, 1987, were accepted as presented. ~ * ~ ~ WRITTEN COMMUNICATIONS Mr. Tong advised that the Commissioners had received three Action Letters and a memorandum regarding State Bar Committee professional responsibilities. He indicated that the letters and memorandum were provided for informational purposes. Regular Meeting PCM-7-170 October 19, 1987 • , , • • * ~ ~ ~ PUBLIC HEARINGS SUBJECT: PA 87-125 Al1 Creatures Veterinary Hospital Conditional Use Permit, 6612 Dublin Boulevard. Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Barger indicated that on September 12, 1979, the Alameda County Zoning Administrator approved a Conditional Use Permit request establishing the Hackler Veterinary Hospital at 6612 Dublin Boulevard. He said that approval expired September 12, 1982. Additionally, Mr. Barger said on November 4, 1982, the Planning Director/ Zoning Administrator approved a subsequent Conditional Use Permit request extending the period of the permit to September 12, 1987. Mr. Barger advised that the owner of the veterinary hospital, which is now called All Creatures, filed a Conditional Use Permit application on September 11, 1987, requesting that she be permitted to continue the operation of the hospital for a period of 10 years. He stated that the City had no record of zoning violations associated with the hospital and that no complaints had been filed with the City by other tenants in the center. Because no problems have occurred related to the veterinary hospital use, Mr. Barger said Staff was recommending the Conditional Use Permit be approved for a period of five years, ending October 29, 1992. He said the Applicant's request for a ten-year approval would not be consistent with the City's policy, which typically allows Conditional Use Permits for a duration of three to five years. In response to an inquiry by Cm. Zika, Mr. Barger said that Staff felt the five year permit period would be acceptable as the hospital has been in operation for a number of years, has received approval both by the Alameda County Zoning Administrator and the City of Dublin Planning Commission, and has complied with the City's regulations. The Applicant, Margaret Roberts, was present but did not have any comments. Cm. Barnes closed the public hearing. On motion by Cm. Burnham, seconded by Cm. Zika, and by a unanimous vote, a Resolution was adopted approving PA 87-125, All Creatures Veterinary Hospital Conditional Use Permit, for a five-year period expiring on October 19, 1992. RESOLUTION N0. 87 - 071 APPROVING PA 87-125, ALL CREATURES VETERINARY HOSPITAL'S REQUEST FOR A CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF A VETERINARY HOSPITAL AT 6612 DUBLIN BOULEVARD Regular Meeting PCM-7-171 October 19, 1987 ~ ~ . . . * ~ ~ ~ SUBJECT: PA 87-129 Margo's Dance Studio/Bedford Properties Conditional Use Permit request, 6591 Sierra Lane, Suites B and C. Cm. Barnes opened the public hearing and called for the Staff Report. Mr. Gailey advised that the Zoning Ordinance requires approval of a Conditional Use Permit prior to establishment of a Commercial Recreational Facility within an M-1 District. He said the subject application was a request to establish a dance studio within the existing light industrial structure at 6591 Sierra Lane, Suites B and C. Mr. Gailey indicated that on February 21, 1980, the Alameda County Planning Director had approved a Site Development Review request, allowing the development of a 30,500+ square foot light industrial building over the 1.9+ acre property. He stated that the subject portion of the property fronts on the north side of Sierra Lane and abuts to the east side of the Sierra Trinity Business Park, and that the property is awned by Bedford Properties. He also said that the proposed tenant space would occupy one-sixth of the structure. Mr. Gailey said a Conditional Use Permit request was submitted in 1983 for a Commercial Recreational Facility (health club - weight training), but that the request was withdrawn prior to any action being taken on the request. Mr. Gailey advised that Staff supports the proposed land use and does not envision any conflicts between existing or future land uses. He referred to Exhibit B, a draft Resolution for the Conditional Use Permit request, which contains Conditions of Approval which would be applied to the subject proposal. Mr. Gailey discussed Condition #10, requiring the completion of miscellaneous site work, and Condition #19, which would establish a three-year approval period, with a possible two-year administrative extension. He said it was Staff's recommendation that the Commission adopt Resolutions approving the Negative Declaration of Environmental Significance and the Conditional Use Permit request for PA 87-129. Cm. Mack expressed concern regarding Buster McCurtain's letter dated October 6, 1987, in which the School District stated they believe the subject project would have a negative impact on Dublin High School. Mr. Gailey discussed the Ordinance recently adopted by the School District, establishing a fee schedule which would involve any new residential or commercial developments within the District. He said Mr. McCurtain's letter implies that fees may be applied to this project by the School District. He advised that the subject letter was a form letter, which has been sent to the City for other projects as well. Mr. Tong indicated that it may be possible that the subject project may not be subject to the fees, but that the School District would have jurisdiction over that decision. II Regular Meeting PCM-7-172 October 19, 1987 ' 8 • , • • In response to an inquiry by Sharon Slater, Representative of Bedford Properties, Mr. Gailey advised that it would be necessary for her to work directly with Amador-Pleasanton School District to determine whether or not the subject project would involve impact fees. Cm. Barnes closed the public hearing. On motion by Cm. Mack, seconded by Cm. Tempel, and by a unanimous vote, a Resolution was approved adopting a Negative Declaration of Eneironmental Significance for PA 87-129. RESOLUTION N0. 87 - 072 ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE CONCERNING PA 87-129 MARGO'S DANCE STUDIO/BEDFORD PROPERTIES REQUEST FOR A COMMERCIAL RECREATIONAL FACILITY (DANCE STUDIO) - CONDITIONAL USE PERMIT REQUEST, 6591 SIERRA LANE On motion by Cm. Mack, seconded by Cm. Zika, and by a unanimous vote, a Resolution was adopted approving PA 87-129 Conditional Use Permit request. RESOLUTION N0. 87 - 073 APPROVING PA 87-129 MARGO'S DANCE STUDIO/BEDFORD PROPERTIES - REQUEST FOR A COI~~iERCIAL RECREATIONAL FACILITY (DANCE STUDIO) CONDITIONAL USE PERMIT REQUEST, 6591 SIERRA LANE ~ ~ ~ ~ NEW BUSINESS OR UNFINISHED BUSINESS Subject: Discussion of Planning Commissioners trainin~ sessions. Mr. Tong indicated that since the Commission is now fully staffed, it may be appropriate to schedule additional training sessions for the Commissioners. He reviewed the purposes of the training sessions and asked for a consensus regarding the best times to hold the sessions. The consensus was to hold the sessions on the second Wednesdays of the month, on an ad hoc basis. Since the second Wednesday in November happens to fall on a holiday, the first session was scheduled to be held on Thursday, November 12, 1987, at 6:00 p.m. in the Conference Room at the City Offices. Cm. Mack indicated that she would not be available for the first session. ~~c~~ OTHER BUSINESS None. ~ Regular Meeting PCM-7-173 October 19, 1987 . . ~ ~ ~ ~ ~ ~ PLANNING COMMISSIONERS' CONCERNS Cm. Mack requested that Staff communicate with the Amador-Pleasanton School District in regards to the form letter pertaining to impact fees, and discuss with them the possibility of rewording the letter so it would not seem so harsh to Applicants/Owners. Mr. Tong said he would pursue Cm. Mack's request. Mr. Gailey provided a brief background concerning the school distict impact fees, and explained that district administrators feel all but forced into implementing the fee schedule because if they don't, they may lose funding at a later date. He indicated that Staff had received a summary of some of the proposed amendments to the State Legislature regarding the fees, and noted that certain related issues need to be worked out at the State level. Cm. Zika requested clarification regarding the memo from Mr. Meyers which was provided to the Commissioners with their agenda packets. Mr. Tong said the purpose of the memo was to indicate that it would be unprofessional for an attorney of an applicant to contact the Planning Commissioners and lobby individually on matters which involve either a judicial or quasi-judicial decision. As an example, he cited items on which the Commissioners would need to make explicit findings, such as Variance applications which have been appealed to the Commission. He advised that it would not be a problem if attorneys lobbied for legislative actions, such as for items which the Commission make recommendations to the City Council. He said an example would be the Recreational Vehicle Ordinance. Cm. Barnes asked for clarification regarding the City Council Notice of Public Hearing for Corwood Car Wash, and asked if the Commission had the right to approach the Councilmembers regarding that and similar projects which were being appealed to the Council. Mr. Tong advised that as individuals, rather than as representatives of the Commission, the Commissioners were free to contact Councilmembers and present their opinions. In terms of communicating with the Councilmembers regarding action taken by the majority of the Commission, Mr. Tong indicated that a representative of the Planning Commission could speak before the Council at a Council meeting. He stated that copies of the minutes of Planning Commission meetings are given to the Councilmembers and that when Staff Reports are prepared for projects acted on by the Commission, complete packets are put together for the Council, which typically include the complete Staff Reports which had been provided to the Planning Commissioners. Mr. Tong explained that the Planning Commission's action concerning the Corwood Car Wash Conditional Use Permit request, Site Development Review, and Variance request had been appealed within the 10-day time frame, but that through a series of requests for abeyance, action was still pending on the appeal. Burnham, Mr. Tong indicated that almost the same plan as was presented to the Commission was being presented to the Council for Corwood Car Wash. He said one difference would be the R.V. wash would be performed either outside, between the existing car wash facility and the proposed new detailing facility, or inside the existing facility. He said the City Council has provided direction that they would look favorably on an extended time period for the Conditional Use Permit, as well as on the size and location of the proposed detail shop. He said they are still reviewing the third drive aisle situation. Mr. Tong stated that this item will be placed on the October 26, 1987, City Council agenda for further action. Cm. Burnham stated that he had received a number of comments from residents regarding the landscaping on San Ramon Road, Village Parkway, and Amador Valley Boulevard. He said residents have finally gotten used to the landscaping, but were expressing dissatisfaction with the unprofessional reflective painting on the end of the median strips. He said he agreed that the striping did not seem appropriate. Cm. Barnes and Cm. Mack concurred with Cm. Burnham.
