HomeMy WebLinkAboutPC Minutes 04-02-1984 . # ~ Regular Meeting - April 2, 1984 A regular meeting of the City of Dublin Planning Commission was held on April 2, 1984, in the Meeting Room, Dublin Library. The meeting was called to order at 7:30 p.m. by Cm. Vonheeder, Vice- Chairman. ~r * * * ROLL CALL PRESENT: Commissioners Alexander, Vonheeder, Petty, and Mack, Thomas P. DeLuca, Associate Planner, and Laurence L. Tong, Planning Director. ABSENT: Commissioner Tenery * * * * PLEDGE OF ALLEGIANCE Cm. Vonheeder led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * MINUTES OF PREVIOUS MEETING The minutes of the continued meetings of November 29, 1983; March 13, 1984; and March 19, 1984, were approved as written. • ~ * * ~ * ORAL COMMUNICATION None * * * * WRITTEN COMMUNICATION Comments had been received from various Dublin residents and local agencies regarding the City of Dublin Draft General Plan. The correspondence was reviewed and briefly discussed by the Commissioners, and Staff was directed to forward the information to the City Council, as well as to respond, directly, to Valley Christian Center regarding its comments. Cm. Vonheeder noted that the letter from Cal-Trans indicated that they (CalTrans) claimed no financial responsibility for recommended improvements in the City of Dublin. Mr. Tong clarified that financial responsibility for improvements recommended in the General Plan would be better addressed at a later date. * * * * PUBLIC HEARING PA 84-010 ST. PHILIP LUTHERAN SCHOOL CONDITIONAL USE PERMIT Mr_ DeLuca introduced the item, which was a request to operate an elementary school within the existing church facilities, at 8850 Davona Drive. He noted that, after a meeting on this date with the applicant, several modifications to the Conditions of Approval had been mutually agreed upon. They are as follows: Condition No.: 2 Change to read: comply with the requirements of the DSRSD Fire Department, City Public Works Division, and City Building Inspection Department." 3 Change to read: during the two-year period shall not exceed 75." 4 Change to read: "The typical school activities shall be limited to the hours between 7:00 a.m. and 6:00 p.m., however no outside activities shall be conducted prior to 7:30 a.m." . ~ Condition No.: 7 Eliminate 11 Change to read: "This approval is effective beginning September l, 1984, and shall terminate on July 31, 1986; and is revocable for cause in accordance with Section 8-90:3. Mr. Henry Aschbrenner, representing St. Philip Lutheran School, spoke briefly, indicating agreement with all of the Conditions of Approval as related by Staff. He noted, however, that according to experience at their Walnut Creek facility, the traffic counts provided by their traffic engineer were, in their opinian, not understated, as Staff might believe. After closing the public hearing, Cm. Mack made the motion to adopt the resolution approving the Conditional Use Permit, with the modifications to the Conditions of Approval as indicated by Staff. Cm. Alexander seconded the motion, and it carried by unanimous vote of the Commissioners present. RESOLUTION NO. 84-13 APPROVING PA 84-010 ST. PHILIP LUTHERAN CHURCH CONDITIONAL USE PERMIT TO OPERATE AN ELEMENTARY SCHOOL WITHIN THE EXISTING CHURCH FACILITIES * * * * PA 84-009 BLANCARTE REZONING FROM AN H-1 DISTRICT TO A C-1 DISTRICT Mr. DeLuca briefly explained the application to rezone a parcel within H-1 (Highway Frontage District) to C-1 (Retail Business District), noting that a Negative Declaration was prepared in accordance with law. It was Btaff's recommendation that the rezoning application be approved. Mr. Mark Blancarte, applicant, was present in the audience, and agreed with all Conditions of Approval. He noted that he envisioned a great improvement to the downtown property and intended to begin construction this Spring. After the close of the public hearing, Cm. Alexander made the motion, along with Cm. Mack's second, to adopt the resolution adopting the Negative Declaration. The motion passed unanimously. i ~ RESOLUTION NO. 84-14 RECOMMENDING ADOPTION OF A NEGATIVE DECLARATION CONCERNING PA 84-009 BLANCARTE REZONING Cm. Alexander then motioned, with a second from Cm. Mack, to adopt the resolution recommending approval of the rezoning. The motion was passed by unanimous vote of the Commissioners present. RESOLUTION NO. 84-15 RECOMMENDING APPROVAL OF A REZONING CONCERNING PA 84-009 BLANCARTE REZONING * * * * NEW BUSINESS REPORT FROM PLANNING DIRECTOR ON USING FINDINGS Mr. Tong explained that, in response to the Planning Commission's previously expressed interest and concern regarding findings in making land use decisions, he felt it appropriate to review excerpts from the State of Caifornia Office of Planning and Research pamphlet, Bridging the Gap: Using Findings in Local Land Use Decisions. Staff and the Commissioners discussed the material presented and expressed interest in the information. * ~ * * OTHER BUSINESS Cm. Petty questioned Staff regarding the status of the widening of various streets throughout the City. Mr. Tong responded that Phase I, on San Ramon Road, is scheduled to get underway soon, and that public hearings regarding Dublin Blvd. are scheduled for later in the month, while studies are now underway regarding several other streets. Mr. Tong distributed a notification of UC Berkeley Extension courses offered regarding Planning and Zoning. Mr. Tong also reminded the Planning Commissioners of the special City Council meeting to be held on April 5, 1984, regarding the Draft General Plan, and he encouraged their attendance. Cm. Vonheeder wished to go on record, at this time, offering an apology to the City Council regarding a mistaken interpretation of the Planning Commission recommendations at the November 29, 1983, meeting regarding establishment of parks within the City of Dublin. ~ ~ * * * * ADJOURNMENT There being no further business, the meeting was adjourned at 9:00 p.m. Respectfully submitted, v.~ C~,w~, C`.w ~ P1, ning Commission Chairman ~ Laurence L.
