HomeMy WebLinkAboutPC Reso 93-04 PA92-081 Dublin Honda CUPRESOLUTION NO. 93 - 004 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 92-081 DUBLIN HONDA CONDITIONAL USE PERMIT REQUEST TO ALLOW THE EXPANSION OF AN EXISTING AUTO DEALERSHIP WITH OUTDOOR STORAGE IN THE C-2, GENERAL COMMERCIAL DISTRICT, LOCATED AT 7099 AND 7159 AMADOR PLAZA ROAD WHEREAS, Ken Harvey, Applicant and owner of Dublin Honda auto dealership requests approval of a Conditional Use Permit/Site Development Review to expand the existing Dublin Honda auto dealership facility by locating additional service stalls, retail (parts), storage and office uses in the existing building located at 7159 Amador Plaza Road with parking lot and building modifications, and to voluntarily contribute traffic improvement funds in the amount of $5,750; and WHEREAS, the Planning Commission held a public hearing on said application on February 16, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Classl of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: The proposed project will serve a public need by providing additional auto sales and service to the general public in the City of Dublin. The proposed use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible when compared to the type and nature of operations typically found in the neighborhood. The proposed use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. The proposed use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. The approval of the Conditional Use Permit will be consistent with the Dublin General Plan and the Downtown Specific Plan. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby conditionally approve PA 92-081 Dublin Honda Conditional Use Permit application as generally shown on Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related Site Development Review and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL] Planning, [BI Building, [PO] Police, [PW] Public Works, [ADM] Administration/City Attorney, [FIN] Finance, IF] Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. This approval is for PA 92-081 Dublin Honda Conditional Use Permit to allow the expansion of the existing Dublin Honda auto dealership by locating 4 additional service stalls and 2 auto detail stalls, 1 wheel alignment area, a retail parts department, and additional office and storage space in the existing building located at 7159 Amador Plaza Road. This approval shall generally conform to the plans labeled Exhibit A, stamped approved and on file with the Planning Department, as modified by the following conditions of approval and associated Site Development Review, consisting of a Site Plan, Floor Plans, Building Elevations, Grading and Improvement Plans and Landscape Plans (9 sheets) prepared by James P. Gibbon, dated received by the Planning Department, February 8, 1993. [PL] This Conditional Use Permit approval shall supersede all previous Conditional Use Permit approvals for the site. [PL] Ail existing and proposed signs shall be subject to the requirements of the sign regulations within the Dublin Zoning Ordinance. [PL] The Applicant shall comply with all applicable Planning, Building, Public Works, Dougherty Regional Fire Authority, Police Department and Alameda County Department of Environmental Health codes, regulations and ordinances. [PL, PW, B, F, PO, CO] The Applicant shall provide and maintain at all times the required number of employee and customer parking spaces (55 parking spaces) for both buildings located at 7099 and 7159 Amador Plaza Road. [PL] - 2 - The Applicant shall be responsible for clean-up and disposal of project related trash to maintain a clean, litter-free site. [PA] No loudspeakers or amplified music shall be permitted outside the enclosed building. All activities associated with the use, except for the storage of outdoor vehicles, shall be conducted entirely within the enclosed buildings. [PL] Ail existing and proposed landscape areas shall be enhanced and properly maintained. [PL] On an annual basis, this Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. [PL] 10. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period· 11. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation. [PL] PASSED, APPROVED AND ADOPTED this 16th day of February, 1993.
