HomeMy WebLinkAboutPCReso 96-30 PA96-023 Shell ND RESOLUTION NO. 96 - 30 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE FOR PA 96-023 DOUGHERTY SHELL SERVICE STATION/FOOD MART/CAR WASH WHEREAS, the Applicant, Craig L. Schwab of C & J Cox Corporation, has filed a Conditional Use Permit and Site Development Review application requesting approval to construct a new service station facility, located at 5933 Dougherty Road, at the northeast corner of Dublin Boulevard. The project will include a new 2,340 square foot 'ETD' food mart store with an attached 900 square foot automatic drive-through car wash; a 60' x 78' fuel island canopy with new landscaping and signage; and sidewalk and driveway improvements along the Dougherty Road and Dublin Boulevard frontages. Additional off-site access and driveway improvements will be made on the City owned remnant parcel adjacent to the project site. WHEREAS, the California Environmental Quality Act (CEQA), State CEQA guidelines and City Environmental Guidelines require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Negative Declaration has been prepared for this project as it will not have a significant effect on the environment; and WHEREAS, the Planning Commission did hold a public hearing on said application on August 6, 1996; did review and consider the Negative Declaration; and did adopt Resolution No. 96-30, adopting the Negative Declaration, Resolution No. 96-31 approving the Conditional Use Permit, Resolution No. 96-32 approving the Site Development Review; and WHEREAS, public notice of Negative Declaration was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Dublin does hereby find that: 1. The project will not have a significant effect on the environment; and The Negative Declaration has been prepared and processed in accordance with State and local laws and guideline regulation; and 3. The Negative Declaration is complete and adequate. BE IT FURTHER RESOLVED THAT THE Planning Commission of the City of Dublin does hereby adopt the Negative Declaration for PA 96-023 Dougherty Shell Service Station Conditional Use Permit and Site Development Review. PASSED, APPROVED AND ADOPTED this 6th day of August, 1996.
