N.. _..~.__.~~..6~,......~~. .~.w~_~~,__.~.,~~._.....w,,~~.9.~.~e~.~.~.w.~a....M.~..~..~....n.,~...~ RECOMMENDING CITY COUNCIL ADOPTION OF A NEGATIVE DECLARATION FOR THE 2009-2014 HOUSING ELEMENT UPDATE CITY-WIDE WHEREAS, the State of California requires that Cities and Counties adopt a comprehensive, long-term General Plan for the physical development of the City; and WHEREAS, the Housing Element is one of seven mandated elements of the General Plan and must address the existing and projected housing needs for all economic segments of the community; and WHEREAS, State law currently requires that Housing Elements be updated and certified every five years; and WHEREAS, the City of Dublin has contracted with Veronica Tam & Associates to assist Staff in preparing the Draft 2009-2014 Housing Element; and WHEREAS, in accordance with the California Environmental Quality Act certain projects are required to be reviewed for environmental impacts and when applicable, environmental documents prepared; and WHEREAS, in accordance with CEQA, updated Housing Elements are subject to environmental review; and WHEREAS, an Initial Study was prepared for the 2009-2014 Housing Element; and WHEREAS, upon completion of the Initial Study it was determined that a Negative Declaration should be prepared; and WHEREAS, an Initial Study/Negative Declaration was prepared and circulated for public review from December 12, 2009 to January 11, 2010; and WHEREAS, two comment letters were received on the Negative Declaration. One comment letter from the California Department of Transportation (Cal Trans) and the other from the [_ivermore/Amador ValCey Transportation Authority (LAVTA}; and WHEREAS, response to comments have been prepared; and WHEREAS, the Planning Commission held a properly noticed public hearing on the Housing Element update and Negative Declaration on February 9, 2010; and WHEREAS,.. a Staff Report was submitted recommending that the Planning Commission adopt a Resolution recommending that the City Council adopt the Negative Declaration; and WHEREAS, the Planning Commission did hear and consider the Initial Study/Negative Declaration and related comments and responses, all said reports, recommendations .and testimony herein above set forth and used ~s independent judgment to evaluate the Negative Declaration. NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this Resolution. BE IT FURTHER RESOLVED that the City of Dublin Planning Commission des hereby recommend that the City Council adopt a Resolution adopting a Negative Declaration for the 2009-2:014- Housing Element Update, with the City Council Resolution attach~l as Exhibit... Declaration and related comments and responses, all said reports, recommendations and testimony herein above set forth and used its independent judgment to evaluate the Negative Declaration; and WHEREAS, the location and custodian of the documents or other material which constitute the record of proceedings for the Housing Element Update is the City of Dublin. NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this Resolution. BE IT FURTHER RESOLVED that the Dublin City Council does hereby adopt the Negative Declaration attached as Exhibit ,based on the following findings. 1. The City Council considered the Negative Declaration together with the comments received during the public review process prior to taking action on the Housing Element Update. 2. The City Council finds on the basis of the whole record before it that there is no substantial evidence that the Housing Element Update will have a significant effect on the environment. 3. The Negative Declaration reflects the City's independent judgment and analysis as to the potential environmental effects of the Housing Element Update.
