HomeMy WebLinkAboutPC Reso 10-02 Scarlett Ct GPA RESOLUTION NO. 10-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THE CITY COUNCIL APPROVE A RESOLUTION AMENDING THE GENERAL PLAN TO DESIGNATE THE WESTERNMOST AND EASTERNMOST PORTIONS OF THE RIGHT-OF-WAY OF SCARLETT COURT AS BUSINESS PARK/INDUSTRIAL AND OUTDOOR STORAGE PA 09-042 WHEREAS, the City Council adopted Resolution .165-09 vacating the westernmost .portion of the right-of-way of Scarlett Court and Resolution 166-09 vacating the easternmost portion of the right-of-way of Scarlett Court; and WHEREAS, the vacated right-of-way of Scarlett Court is currently a .road and therefore does not have a land use designation in the General Plan; and WHEREAS, the City proposes to designate the vacated right-of-way of Scarlett Court as Business Park/Industrial and Outdoor Storage in the General Plan; and WHEREAS, the Dublin General Plan was originally adopted on February 11, 1,985 and has been amended several times since then; and WHEREAS, the California Environmental Quality Act (CEQA), .together with State guidelines and City environmental regulations .require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, the Planning Commission hereby finds that the Project is Categorically Exempt from .the California Environmental Quality Act- (CEQA), pursuant to Section 15332, In- Fill Development because the site is within city limits, is currently developed and is less than five acres in size; and WHEREAS, the City of Dublin Planning Commission held a public hearing on said Project on January 12, 2010 for which proper notice of the public hearing was given at all respects as required by law; and WHEREAS, a Staff Report was submitted to the Planning Commission on January 12, 2010 recommending approval of said Project; and WHEREAS, the Planning Commission did hold a public hearing on said application; and WHEREAS, proper notice of said hearing was given in all respects as required by law. WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used its independent judgment to evaluate the Project. NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this resolution. BE IT FURTHER RESOLVED that the Planning Commission recommends that the City Council adopt. the Resolution attached as Exhibit A, which approves a General Plan Amendment to designate the westernmost and easternmost portions of Scarlett Court as Business Park/Industrial and Outdoor Storage. XX -10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING THE GENERAL PLAN TO DESIGNATE THE WESTERNMOST AND EASTERNMOST PORTIONS OF THE VACATED RIGHT-OF-WAY OF SCARLETT COURT AS BUSINESS PARK/INDUSTRIAL AND OUTDOOR STORAGE PA 09-042 WHEREAS, the City Council adopted Resolution 165-09 vacating the westernmost portion of the right-of-way of Scarlett Court and Resolution 166-09 vacating the easternmost portion of the right-of-way of Scarlett Court; and WHEREAS, the vacated portion of the right-of-way is a roadway and therefore does not have a land use designation in the General Plan; and WHEREAS, the City proposes to designate the vacated right-of-way of Scarlett Court as Business Park/industrial and Outdoor Storage; and WHEREAS, the Dublin General Plan was originally adopted on February 11, 1985, and has been amended a number of times since that date; and WHEREAS, the General Plan currently identifies land use designations, densities and policies related to density calculations, and includes a General Plan Land Use Map (Figure 1- 1 a) that shows the location of land uses within the City of Dublin; and WHEREAS, the California Environmental Quality Act (CEQA), together with State guidelines and City environmental regulations require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, pursuant to the California Environmental Quality Act, the City Council has found the Project to be Categorically Exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15332, In-Fill Development because the site is currently developed and is less than five acres in size; and WHEREAS, the Planning Commission held a properly noticed public hearing on the General Plan Amendment on January 12, 1010, at which time interested parties had the opportunity to be heard; and WHEREAS, on January 12, 2010 the Planning Commission adopted Resolution 10- incorporated herein by reference, recommending that the City Council approve the General Plan Amendment; and WHEREAS, a Staff Report dated was submitted to the City Council recommending that the City Council approve the General Plan Amendment and Zoning of the subject area; and WHEREAS, on , 2010, the City Council held a properly noticed public hearing on the General Plan Amendment and Zoning action, at which time all interested parties had the opportunity to be heard; and EXHIBIT A TO ATTACHMENT I WHEREAS, the City Council did hear and consider all said reports, recommendations and testimony herein above set forth and used its independent judgment to evaluate the project. NOW, THEREFORE, BE IT RESOLVED that the foregoing recitals are true and correct and made a part of this resolution. BE IT FURTHER RESOLVED that the Dublin City Council does hereby find that the proposed amendments to the Dublin General Plan are in the public interest and will not have an adverse effect on health or safety or be detrimental to the public welfare or be injurious to property or public improvement and that the Dublin General Plan as so amended will remain internally consistent. BE IT FURTHER RESOLVED that the Dublin City Council does hereby approve the following amendments to the Dublin General Plan: Section I. General Plan Amendments. All provisions of the General Plan not amended by this resolution shall remain in full force and effect. 2 BE IT FURTHER RESOLVED that this Resolution shall take effect thirty (30) days after the date of adoption.
