This proposed assessment includes the use of existing reserves to offset a part of the estimated 2000-2001 maintenance cost and is therefore less than the 1999-2000 assessment. The proposed annexation area, Tract 7067, is included in the above figure and at the same rate as the lots in the existing District. Based on the projected total number of lights in Dublin Ranch Phase I plus Tract 7067, the proposed assessment for the ultimate improvement is $29,566, or $34.22 per single family lot (subject to inflationary and utility rate increases). DESCRIPTION: Back~round: This is the second year of assessments for Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch Phase I). At the May 16th meeting, the City Council received a petition from Taylor-Woodrow Homes, the developer of Tract 7067, Clifden Parc, requesting annexation to this assessment district. Tract 7067 was~ originally proposed to be annexed as Zone II, with funds and assessments calculated independently of COPIES TO: Dublin Randh Property Owners Taylor Woodrow ITEM NO. ~ g:\ad\99-1 \agstfnv.2&pre991 Zone I; however, after reviewing the budget figures and the effect of the addition of only 13 lights and 17 lots on both the total and per-lot assessments, Staff is recommending that Tract 7067 simply be annexed into the District, and the creation of the separate zone is not necessary. Under Proposition 218, the annexation of an additional area requires a 45-day hearing notice and holding a public meeting and a public hearing prior to the levy of assessments. As indicated in the description below, as well as in the Engineer's Report itself, the assessment for the existing District is not proposed to increase beyond the limits set up in the original Engineer' s Report. Annexation to Assessment District: As with formation of a new assessment district, annexation to an existing District requires the following actions: 1) 2) 3) 4) Adoption of a resolution initiating proceedings. The City Council adopted a resolution initiating proceedings at the May 16, 2000, meeting. Approval of Preliminary Engineer' s Report. The proposed Resolution Approving Preliminary Engineer's Report (Attachment 1) is before the Council for adoption tonight. Adoption of a Resolution of Intention The Proposed Resolution of Intention (Attachment 2) is before the Council for adoption tonight. Adoption of a Resolution Ordering the Improvements and Formation of the District, Approving the Final Engineer's Report, and Confirming the Assessment and Diagram. This resolution can be adopted following 45 days'notice to the property owners and a public meeting and public hearing, which will be scheduled for July 18th and August Ist, respectively. Engineer's Report and Calculation of Proposed Assessment: As noted in the Financial Statement above, Staff has calculated the proposed assessment based on the preliminary budget for Fiscal Year 2000-2001. This budget assumes the acceptance of a total of 288 lights among the several Dublin Ranch subdivisions, plus Tract 7067. The addition of the 13 lights and 17 lots in Tract 7067 does not have an appreciable effect on the per-lot assessment. Given that recordkeeping for a separate zone would add to the Staff cost, it is now recommended that Tract 7067 be annexed into the existing District without creating the separate zone. At the time the budgeting was done for this District for Fiscal Year 1999-2000, it was assumed that several of the Dublin Ranch subdivisions would be accepted and maintained during the course of Fiscal Year 1999-2000. This did not occur, and a negligible amount of the funds collected in 1999-2000 were actually spent. It is therefore recommended that $12,187 of the existing reserve be used to offset a part of the estimated cost for Fiscal Year 2000-2001. As noted in the Engineer's Report, funds are being set aside for future pole painting expenses. The reserve that is anticipated to remain in this District at the end of Fiscal Year 2000-2001 is allowable under Proposition 218. It is expected that the remainder of the Dublin Ranch Development (the Lin property) will be annexed to this District, possibly prior to establishing the 2001-2002 assessment. At that time, the method of spread to be applied to commercial and multiple residential properties will be determined. Staff recommends that the City Council adopt the Resolution approving the Preliminary Engineer's Report and the Resolution Setting a Public Meeting and Public Hearing Date and Time (regular City Council meetings of July 18 and August 1, 2000). Page 2 RESOLUTION NO. -00 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING PRELIMINARY ENGINEER'S REPORT, CONFIRMING DIAGRAM AND ASSESSMENT CITY OF DUBLIN STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT 99-1 (DUBLIN RANCH and TRACT 7067) WHEREAS, by its Resolution No. 46-00, a Resolution Directing Preparation of Annual Report for City of Dublin Street Lighting Maintenance Assessment District No. 99-1 (the "District"), this Council designated the City Engineer as Engineer of Work and ordered said Engineer to make and file a report in writing in accordance with and pursuant to the Landscaping and Lighting Act of 1972; and WHEREAS, said Engineer of Work has made and filed with the City Clerk a preliminary report in writing as called for in said Resolution No. 46-00 and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, said Council has duly considered said report and finds that each and every part of said report is sufficient; and that said report neither requires nor should be modified in any respect; NOW, THEREFORE, BE IT RESOLVED a) That the Engineer's estimate of the itemized and total costs and expenses of the acquisition of improvements and maintaining said improvements and of the incidental expenses in connection therewith, as contained in said report be, and each of them are hereby preliminarily approved and confirmed; b) That the diagram showing the assessment district, description of the improvements to be acquired and maintained, and the boundaries and dimensions of the respective lots and parcels of land within said District, as contained in said report be, and it is hereby preliminarily approved and confirmed; c) That the assessment of the total amount of the cost and expenses of the proposed acquisition and maintenance of said improvements upon the several lots and parcels of land in said District in proportion to the estimated benefits to be received by such lots and parcels, respectively, from said acquisition and maintenance, and of the expenses incidental thereto, as contained in said report be, and they are hereby preliminarily approved and confirmed. The City Council intends to order the annexation to an assessment district and to levy and collect assessments for Fiscal Year 2000-2001 pursuant to the Landscaping and Lighting Act of 1972. 2. The improvements to be made in the assessment district are generally described as follows: The maintenance, operation, repair and replacement of all public street lighting facilities located within the public streets and within public easements within private streets within the District Boundaries, as shown on the approved improvement plans for Tract 7067, including, but not limited to, the lighting poles, .fixtures, conduits, conductors, service boxes, controllers, and appurtenances, and the furnishing of power, together with all incidental expenses for the maintenance, operation, and repair of the street lighting system. 3. This assessment district shall be known as "Street Lighting Maintenance Assessment District No. 99-1 Dublin Ranch Area and Tract 7067." The general location of the annexation is: the area consisting of Tracts 7067. 4. In accordance with Resolution No. 70-00, the Resolution Initiating Proceedings for Street Light Maintenance Assessment District No. 99-1 Annexation (Tract 7067) the City Engineer has filed with the City Clerk the report required by the Landscaping and Lighting Act of 1972. All interested persons are referred to that report for a full and detailed description of the improvements, the boundaries of the assessment district and the proposed assessments upon assessable lots and parcels of land within the assessment district. 5. The City Council will conduct one public meeting and one public hearing on the question of the annexation of territory to the assessment district and the levy of the proposed assessment for Fiscal Year 2000-2001. The meeting and hearing will be held, respectively, on July 18, 2000, and August 1, 2000, at 7:00 p.m. at the Dublin Civic Center, 100 Civic Plaza, Dublin, California. 6. The City Clerk is authorized and directed to give the notice of hearing required by the Landscaping and Lighting Act of 1972 and Government Code SectiOn 54954.6(c). The total assessment district area is 225.5 acres as shown in Part A (the Assessment Diagram and Boundaries Map) of this report. The "ultimate improvements" consist of: The maintenance, operation, repair and replacement of all public street lighting facilities located within the public streets and within public easements within private streets within the District Boundaries, as shown on the approved improvement plans for the following Tracts: Final Maps 6925 and 6956 through 6964 and Tract 7067, including, but not limited to, the lighting poles, fixtures, conduits, conductors, service boxes, controllers, and appurtenances, and the furnishing of power, together with all incidental expenses for the maintenance, operation, and repair of the street lighting system. This report consists of five parts as follows: Part A - Part B - Part C - Part D - Part E - An Assessment Diagram and Boundaries Map showing all of the real property within the Assessment District. An estimate of the annual maintenance costs for the planned "ultimate improvements" to be maintained. An Assessment Roll detailing the estimated cost of the maintenance on each residential parcel within the Assessment District. A statement of the method by which the undersigned has determined the amount proposed to be assessed against each parcel. A list of the names and addresses of the owners of real property within this Assessment District, as shown on the last equalized assessment roll for taxes, or as known to the Clerk. This District is being established to pay for maintenance, operation, and repair of the proposed street light fixtures, which differ from the City Standard. If the Bay Area Urban Wage Earner Consumer Price Index is unavailable or deemed by the City Council to be inappropriate, a comparable consumer price index, as approved by the City Council, shall be used to replace the Bay Area Urban Wage Earner Price Index. Page 6 PART D METHOD OF SPREAD OF ASSESSMENTS STREET LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. 99-1 DUBLIN RANCH AREA AND TRACT 7067 The maintenance of the street lighting within the boundaries of the Assessment District benefits each residential lot in the Distdct in the same manner and to the same extent. Therefore, the Assessment has been equally apportioned over the proposed 864 planned single-family residential lots contained within the District. The per lot assessment will be $13.34 per lot for Fiscal Year 2000-2001, increasing to $34.22 (subject to inflation and utility rate increases) at buildout for all residential lots within the boundaries of the District on a per lot basis. All non-residential lots within the District have been excepted and will have a zero assessment since they receive no special benefit with regard to the special light fixture proposed. The following Lots 114, 115, and 116 of Tract 6960 will be subdivided at a later date. The projected lot counts are: Tract 6960 Lot 114 - Lot 115 - Lot 116 - 92 lots (future Tract 6956) 91 lots (future Tract 6959) 117 lots (future Tract 6961) Until they are subdivided, the assessment for these lots shall be equal to the per-lot assessment each year times the number of proposed lots within each Tract listed above. With the recording of the future Tract maps, the new assessments will be reapportioned to each of the individual residential lots. As more street lights are installed each year, until all 349 are installed, the assessment each year will be based on the estimated cost of maintenance (using the numbers in Part B, adjusted for inflation as noted in Part B), divided by the number of lights to be installed that year, provided in no event will the per lot assessment be more than $33.59 (as adjusted for inflation).
