A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
CONSENT TO CANCELLATION OF UNCOLLECTED
CITY TAXES, PENALTIES AND COSTS BASED
ON THE CONSENT OF THE COUNTY LEGAL ADVISER
WHEREAS, Section 4986 of the Revenue and Taxation Code of the State
of California provides that all or any portion of any uncollected taxes,
penalties or costs shall be cancelled by the Board of Supervisors on
the grounds enumerated therein with the written consent of the county
legal adviser; and
WHEREAS, Section 4986.2 of said Revenue and Taxation Code provides
that any uncollected city taxes, penalties and costs shall be cancelled
on the grounds enumerated in Section 4986 except that the consent of
the City Attorney in lieu of the consent of the County Legal Adviser
is required;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Dublin that the consent of the County Legal Adviser to cancel any
uncollected taxes, penalties or costs under the provisions of Revenue
and Taxation Code Section 4986 shall also be deemed the consent of
the City Attorney to the cancellation of any uncollected city taxes,
penalties or costs as provided in Section 4986.2 of the Revenue and
Taxation Code; and
BE IT FURTHER RESOLVED that a certified copy of this resolution
shall be filed with the Board of Supervisors of the County of Alameda;
and shall remain effective until rescinded by this City Council.
PASSED, APPROVED AND ADOPTED this 16th day of February, 1982, by
the following vote:
AYES: Councilmembers Burton, Hegarty, Jeffery, Moffatt and Mayor Snyder
NOES: None
