The cost to furnish and install signs is estimated to be $425. This work would be covered by gas tax (206) available in the Street Maintenance Budget (30200). No additional costs are expected. DESCRIPTION: This is the second reading of an ordinance establishing a bus stop on Kohnen Way. The first reading was waived and the ordinance introduced at the City Council meeting on December 2, 2008. BACKGROUND: Fallon Middle School is located on the north side of Kohnen Way west of Grafton Street. Although it is designated as a middle school, it also serves kindergarten through the fifth grade until some time in the future when a new elementary school is built in eastern Dublin. The school has separate ingress and egress driveways for access to the pick-up/drop-off loop and primary parking lot, as well as an additional driveway further west on Kohnen Way for access to a secondary parking lot. When the improvements associated with constructing Kohnen Way were adopted by the City Council on June 6, 2006, a no parking zone on the north side of Kohnen Way between the Fallon Middle School egress driveway and Grafton Street was included in the resolution. A portion of the no parking zone includes a bus pullout along the school frontage. LAVTA started using the pullout in summer 2007 for Bus Route lE, which connects the BART station with Dublin Ranch via Central Parkway, Tassajara Road, North Dublin Ranch Road, Grafton Street, Kohnen Way and Brannigan Street. Not only does the route accommodate demand to and from the BART station, it is regularly used by students of Fallon Middle School. Even though LAVTA has been using this pullout for over a year, parents continue to park inside the bus pullout during the morning and afternoon drop-off and pick-up periods, respectively. For this reason, LAVTA has requested that the City implement and enforce the no parking restriction within the pullout. Staff investigated the request by conducting a field review of the existing signage, completed a vehicle operations study during the peak periods, and contacted the Dublin Unified School District (District). The field review of existing signage revealed that there could be some confusion about whether parking is allowed within the pullout. Therefore, Staff recommends that three new signs be installed immediately adjacent to the pullout indicating there is no stopping allowed. The sign would be a standard white sign with red text reading, "No Stopping Any Time." In order to determine what impact implementation of this dedicated no stopping zone would have on traffic operations, Staff observed vehicle operations in and around the school during the drop-off (8:15 a.m. to 8:50 a.m.) and pick-up (2:45 p.m. to 3:15 p.m.) periods on Thursday, October 16, 2008. During the morning period, a maximum of 8 vehicles were observed in the pullout at one time. Some parents pull into the area to drop off children while others park in the pullout and walk children into the school. During the afternoon period, a maximum of 7 vehicles were observed in the pullout at one time. If fully occupied, the pullout can accommodate a maximum of 11 vehicles. During both time periods, Staff observed that more than sufficient parking was available on-site to accommodate all of the vehicles that used the pullout. There is a primary parking lot located south of the School's main driveway loop, as well as a secondary lot located to the west and accessible via Kohnen Way. The primary lot provides adequate capacity to accommodate the vehicles using the pullout. Even with the future expansion of the student population, the secondary lot provides sufficient parking to accommodate any overflow that may occur. On the same day, 20 students were observed getting onto the bus at the end of the school day, indicating that Route lE provides a useful service to Fallon School. Following Staff's review of the situation, Staff contacted the Principal of Fallon Middle School and the Facilities Manager for the District, and it was confirmed that both are in support of the implementation of the no stopping zone. Because the City supports and encourages the use of public transportation, recognizes that Route lE is regularly used by students of Fallon School, and has established that the requested no stopping zone would not result in circulation or parking problems at Fallon Middle School, it is recommended that the previously-approved no parking zone be enforced. Staff would recommend that this be done by installing additional signage. Because the no stopping zone is being used for bus service, the location should be designated as a bus stop. According to Dublin Municipal Code Section 6.04.360, the City Council may establish bus stops by ordinance. Once established and marked accordingly, vehicles cannot stop, stand or park within the Page 2 of 3 designated area. Many bus stops that became active over the last several years, particularly in eastern Dublin within new neighborhoods and on new roadways, were not formally adopted by ordinance prior to becoming active. Most of these locations were retroactively designated by the City Council in June 2008 based on a database of stop locations provided by LAVTA. This specific location was inadvertently left off of LAVTA's database. Staff is requesting that the City Council adopt the Ordinance (Attachment 1) to designate the bus turnout on the north side of Kohnen Way as a bus stop. The District has indicated that an announcement was made via a newsletter that parents received around December 5. Staff plans to have the signs in place starting Wednesday, December 17, without ticketing for the first week. The following two weeks are winter break (December 22 through January 2), so enforcement would begin after the break. RECOMMENDATION: Staff recommends that the City Council waive the reading and adopt the Ordinance establishing a bus stop on Kohnen Way. Page 3 of 3 i~g ORDINANCE NO. - 08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING A BUS STOP ON KOHNEN WAY Pursuant to the provisions of Section 6.04.360 of the City of Dublin Municipal Code, and in the interest of public convenience and safety, the City Council of the City of Dublin does hereby RESOLVE as follows: Section 1: A bus stop shall be established on the north side of Kohnen Way within the bus pullout. Section 2: The provisions of this Ordinance shall be added to Chapter 6.44 of the City of Dublin Traffic Code. Section 3: This Ordinance shall take effect immediately upon its enactment because the adoption and immediate effect thereof is necessary in order to protect vehicular and pedestrian safety.
