HomeMy WebLinkAboutPCReso00-16 PA99-036 Enterprise CUP RESOLUTION NO. 00 - 16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 99-036 ENTERPRISE RENT-A-CAR CONDITIONAL USE PERMIT TO ALLOW THE ESTABLISHMENT OF A SATELLITE CAR RENTAL FACILITY WITHIN THE EXISTING FACILITY LOCATED AT 6077 DUBLIN BOULEVARD, MAGNUSSEN CAR WEST. WHEREAS, the Applicant, Daniel Friedman, of the Enterprise Rent-A-Car Company has filed a Conditional Use Permit application to allow a satellite car rental location within the existing facility located at 6077 Dublin Boulevard, in a C-2 Retail/Office & Automotive Zoning District; and WHEREAS the Planning Commission held a properly noticed public hearing on said application on April 11, 2000; and WHEREAS, the California Environmental Quality Act (CEQA), together with the State guidelines and City environmental regulations require that certain projects be reviewed for environmental impact and that environmental documents be prepared; and WHEREAS, the project has been found to be Categorically Exempt from the California Environmental Quality Act (CEQA), according to Section 15301(a), Class 1; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used his independent judgment to make a decision; and WHEREAS, the Planning Commission has found that the proposed project is appropriate for the subject site. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does find that: The proposed use is and related structures are compatible with other land uses, transportation and service facilities in the vicinity. The use will not adversely affect the health or safety of persons residing or working in the vicinity, or be detrimental to the public health, safety, and welfare. The use, under all circumstances and conditions of this permit, will not be injurious to property or improvements in the neighborhood. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use and related structures would not be detrimental to the public health, safety and welfare. The subject site is physically suitable for the type, density and intensity of the use and related structures being proposed. The approval of this Conditional Use Permit is consistent with the Dublin General Plan and any applicable Specific Plans. BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does hereby approve PA 99-036 Conditional Use Permit to allow an Enterprise-Rent-A-Car satellite office as generally depicted on Exhibit A, stamped approved and on file, subject to compliance with the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of buildin? permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the Conditions of Approval: [PL.] Planning, lB1 Building, [PO] Police, [PW] Public Works [ADM] Administration/City Attorney, [FIN] Finance, IF1 Alameda County Fire Department. [DSR] Dublin San Ramon Services District, [CO] Alameda County Department of Environmental Health. This Conditional Use Permit approval for PA 99-036 allows the establishment of a satellite car rental office within an existing commercial building. [PL] The activities associated with the satellite car rental office shall exclusively consist of a. Administrative and management operations; b. One parking (1) space for an employee; c. The following operating hours: Monday to Friday: 7:30 a.m. - 6:00 p.m. Saturday: 9:00 a.m. - 12:00 p.m. [PL] No rental vehicles shall be stored or parked on or at the site as Enterprise Rent-A-Car staff will pick up and deliver customers to the vehicle storage site located at 6867 Dublin Boulevard. [PL] The servicing or washing of rental vehicles or equipment shall not be permitted. [PL] No loudspeakers or amplified music shall be permitted outside of the enclosed buildings. [PL] Any signage on site shall be subject to the Sign Requirements established in the Resolution No. 97- 03. [PL] The proposed customer counter must be accessible per Section 1122B.4 of the 1998 California Building Code. The height of the customer counter shall be 28 inches to 34 inches from the floor. [B] Equivalent facilitation must be provided between the upper and lower levels if the existing second floor level is not accessible. The Applicant may request, in writing, that the requirement be waived if an "unreasonable" hardship exists in complying with this requirement per Section 1123B. 1 of the 1998 California Building Code. [BI The Applicant shall comply with all applicable Planning, Building, Alameda County Fire Authority, and Police Department regulations and ordinances. [PL, B, F, PO] 2 10. 11. 12. On an annual and as needed basis, this Conditional Use Permit shall be subject to Planning Department review and determination as to compliance with the Conditions of Approval. [PL] This Conditional Use Permit shall be null and void in the event the approved use ceases to operate for a continuous one-year period. [PL] This permit shall be revocable for cause in accordance with Section 8.96.020.I of the Dublin Zoning Ordinance.
