FINANCIAL STATEMENT: There is no cost associated with the filing of the grant application. DESCRIPTION: The City of Dublin has been working jointly with the East Bay Regional Park District (EBRPD), the City of Pleasanton, Caltrans and Zone 7 in constructing the Alamo Canal Trail under I-580. This gap closure project will connect the Alamo Canal Trail north of the freeway (adjacent to the City Library) with the Pleasanton trail south of the freeway in order to transform it into a regional trail. In 2008, EBRPD (in collaboration with the Cities of Dublin and Pleasanton) obtained funds from the Alameda County Transportation Improvement Authority (ACTIA) to complete the design plans and acquire the necessary permits to construct the project. Design plans are now 95% complete and approval of the permits is pending. In the last project coordination meeting attended by the City, EBRPD indicated its desire to turn over construction management to either Dublin or Pleasanton. Construction management includes bidding of COPY TO: EBRPD City of Pleasanton Page 1 of 2 ITEM NO. • G:\CIP\Alamo Canal Trail under I-580\agst Approve Cal River Parkways Grant Appli.doc ~ i ~/ the project and contract award; inspection; coordination with Caltrans, Zone 7, and Bay Area Rapid Transit (BART); compliance with environmental permits; and processing any federal and state grant funds acquired for construction. Subject to the City Council's approval, Dublin Staff expressed willingness to act as the lead agency in managing the construction as it would best serve the City's interest to provide direct oversight of the project. The cost of construction is estimated at $2,652,000. While funding for construction is currently unavailable, EBRPD, Dublin and Pleasanton have been seeking federal, state and regional funds for the project. One funding opportunity is the California River Parkways Grant Program, administered by the State Resources Agency. As a component of the funding application, the project sponsor is required to submit a resolution approving the application, and appointing a designated position as agent to conduct all negotiations, and execute and submit all documents which may be necessary for the completion of the project. The amount in State funds being requested on this funding application is $1,600,000. RECOMMENDATION: It is recommended that the City Council 1) Adopt the resolution approving the California River Parkways Grant Program Application for the Alamo Canal Trail Under I-580 Project; and authorizing the Public Works Director, or designee, as agent to conduct all negotiations, and execute and submit all documents necessary for the completion of the Project; and 2) Authorize Staff to manage construction of the Project. a~~ i ~~ RESOLUTION NO. - 08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDER THE SAFE DRINHING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) WHEREAS, the Legislature and Governor of the State of California have provided funds for the program California River Parkways Grant Program (Grant Program); and WHEREAS, the State Resources Agency has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the State Resources Agency require a resolution certifying the approval of application by the Applicant's governing board before submission of said application to the State; and WHEREAS, the Applicant, if selected, will enter into an agreement with the State of California to carry out the project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin: 1. Approves the filing of an application for the Alamo Canal Trail Under I-580 Project; and 2. Certifies that Applicant understands the assurances and certification in the application; and 3. Certifies that Applicant or title holder will have sufficient funds to operate and maintain the project consistent with the land tenure requirements, or will secure the resources to do so; and 4. Certifies that it will comply with all provisions of Section 1771.5 of the California Labor Code; and 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), legal requirements for building codes, health and safety codes, disabled access laws, and that, prior to commencement of construction, all applicable permits will have been obtained; and 6. Appoints the Public Works Director of the City of Dublin, or .designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project.
