FINANCIAL STATEMENT: None DESCRIPTION: At the City Council Meeting on December 18,2007, the City Council directed Staff to research and present recommendations for augmenting the City's Smoking Pollution Control policies and regulations. As part of this direction, Staff was to present recommendations for an increase in the reasonable distance footage within City parks to 100 feet from areas in which people congregate. Specifically, Staff was directed to analyze the Ordinance passed by the Livermore Area Recreation and Park District. In addition, Staff has researched creating a smoke free events ordinance. Staff is seeking direction from Council on its preferred options to incorporate into a Draft Ordinance. Current Law Smoking is prohibited in children's play areas and smoking is prohibited within a minimum of25 feet from a playground or a tot lot sandbox area. ------------------------------------------------------------------------------------------------------------- COPY TO: Janice Louie, ALCO Tobacco Coalition Page 1 of3 ITEM NO. 7. / F:\Council\Agenda Statements\2008-2009\as- 100 feet in parks and events.doc 100-foot Prohibition within Parks The Livermore Area Recreation and Park District has passed the following Ordinance for its parks: "Smoking or the disposing of any tobacco related waste is prohibited inside all LARPD managed buildings and swimming pool areas. Smoking is also prohibited within 100 feet of public entrances/exits to these facilities, and 1O0 feet from park playgrounds as well as outdoor youth-related events held on LARPD managed facilities or including events sponsored by LARPD." As directed by Council, Staff has used the IOO-foot provision from this Ordinance in presenting the below recommendations to Council. Staff was directed by Council to present recommendations for creating a 100- foot barrier around park recreation areas and has put together the following list of park areas for the prohibition on smoking for Council's consideration: . Children's play areas; . Playgrounds; . Swimming pool areas; . Recreational trails and paths; . Walkways within parks; . Sports fields and courts; . Youth related events; . Skate parks; and . Picnic areas. If Council were to include all areas listed above, the effect may be similar, if not equal, to a complete smoking prohibition for the City's smaller to medium sized parks. For example, the play area may be within 100 feet of the sports court, which is within 100 feet of a trail, and so on until the whole park has a complete ban on smoking. This would be especially true if walkways are included in the prohibition. Thus, Staff would recommend that the Council consider placing the 100-foot prohibition on children's play areas, playgrounds, swimming pool areas, sports fields and courts, youth related events, skate parks, and picnic areas only. The three Attachments included show the impact of applying the Staff recommendation at a neighborhood square (Stagecoach Park), a neighborhood park (Ted Fairfield Park), and a community park (Emerald Glen Park) within the City. By applying the play area prohibition alone, Stagecoach Park will be a smoke free park. Ted Fairfield will have minimal space available to accommodate smokers. The open space area to the north of the baseball field may be used from time to time as a sports field, rendering the park smoke free during these times, but when it is not being used as such, will be an area to which smokers may go. Emerald Glen on the other hand is large enough to accommodate smokers being 100 feet from the areas prohibited. Smoke Free City Events In addition to the above, Staff was directed by Council to present recommendations for a prohibition of smoking at City events. The prohibition would be placed upon any events planned, coordinated, and/or financed by the City of Dublin, which are held upon City owned property and within the limits of the City. This would affect events such as Day on the Glen and Saint Patrick's Day Festival, but would exclude events such as the Golf Tournament as it is not held on City property. Indoor events would be subject to Page 2 of3 other sections of the Dublin Municipal Code. As part of the Ordinance Amendment, smoking areas may need to be designated and such verbiage would be included with the Ordinance. Such areas would have to be marked and comply with the reasonable distance restriction of 20 feet. RECOMMENDATION: Staff recommends that the City Council provide Staff with direction on items to include in a Draft Ordinance and that the City Council direct Staff to prepare the Draft Ordinance for Council's consideration.
