DESCRIPTION On December 18, 2007, the City Councd declared an emergency
relative to fire and water damage at the DublIn CIVIC Center and waIved the competItIve bId process for
necessary envIronmental remedIatIOn and bUIldmg restoration A Budget Change m the amount of
$100,000 was also approved to cover the cost of the remedIatIon and restoratIOn The process of
reImbursement from the CIty'S msurance carner has already begun
In 2004, carpet was mstal1ed m the PolIce Wmg of the CIVIC Center that matched the eXlstmg type and
color m the AdmmlstratIon Wmg The CIty made the deCISIOn at that tIme to purchase and store an
addItIOnal length of the carpet as thIS type and color are not always In stock There was a suffiCient
amount of stored carpet avaIlable to al10w the contractor to replace water-damaged carpet on the second
floor of the AdmmIstratIon Wmg, as wel1 as m the CIrcular hal1way on the first floor ThIS work was
completed dunng the week of January 28 - February 1, whIch enabled all of the publIc counter areas to be
reopened In addItIOn, the RegIOnal Meetmg Room and the PublIc Works Conference Room are agam
avaIlable for use Temporary carpet has been mstalled m the Plancheck area on the first floor, and once
the drywall and pamt Improvements have been completed, the remamder of the BUIldmg, Planmng and
Parks & Commumty ServIces workstations wIll be remstalled The permanent carpet has been ordered for
the Plancheck area, and when It amves, Staff wll1 coordmate the final mstallatIOn WIth the msurance
carner's contractor
Staff recommends that the CIty Councd adopt the resolution contmumg the emergency actIOn to the CIty
CounCIl meetmg of March 4, 2008

A RlESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

AlPlPROVIING CONTINUATION OF EMERGENCY ALLOWING WAIVER
OF COMlPETITIVE BID PROCESS AND EMERGENCY CONTRACT FOR
ENVIRONMENTAL REMEDIATION trN DUBLtrN CtrVIC CENTER
WHEREAS, the Dublm CiVIC Center sustamed fire and water damage on December 18, 2007, and
WHEREAS, It was found that several areas of the bUIldmg are not habItable as workspace, and It IS
necessary to remedlate thIS condltton m order to preserve the well-bemg of City Staff and to return the
bUlldmg to full operatIOn, and
WHEREAS, said remedIatIon IS so urgent as to preclude the time normally allotted for soliCitation
of bids, and
WHEREAS, the CIty CouncIl adopted ResolutIOn No 224-07, approvmg a findmg of emergency
allowmg waiver of competitive bId process and emergency contractmg for environmental remedmtIOn and
property restoratIOn m the CIVIC Center, and,
WHEREAS, the CIty CouncIl approved a contmuatIOn of the emergency actIOn at Its regularly
schedule meetIng on February 5, 2005,
NOW, THEREFORE, BE trT RESOLVED that the City CounCIl of the CIty of Dublm, pursuant
to PublIc Contract Code sectIOns 20168 and 22050, finds that there IS a need to contInue the actions
approved by the City Councll m ResolutIOn No 224-07
BE IT FURTHER RESOLVED that thIS Item IS contInued untIl the CIty CounCIl meetmg of
March 4,2008, at whIch tIme the CIty CounCIl WIll reVIew the emergency actIOn taken
BE IT FURTHER RESOLVED that the City CounCIl finds thIS project to be exempt from CEQA
as an emergency project, pursuant to CEQA GUldehnes, SectIon 15269
PASSED, APPROVED AND ADOPTED thIS 19th day of February, 2008, by the followmg vote
