~oZ EXHIBIT "A" OF RESOLUTION -08 POLICY FOR THE CITY OF DUBLIN ANNU AIL SIDEWALK SAFETY IREP AIR PROGRAM FIscal Year 2007-2008 It IS the policy of the CIty of Dublm to cause repaIrs to be made to certam pubhc Improvements for the safety of the general public under the followmg gmdehnes Improvements Included Public Improvements mcluded under this program shall be limited to those Improvements WhICh may constitute a potential tnppmg hazard to pedestrIan traffic such as curbs, gutters, drIveways, and sIdewalks Need Where these Improvements have settled, heaved and/or cracked and offset such as to represent tnppmg hazards as Identified by the PublIc Works Director, or a representative, these Improvements shall be replaced Responsibility Where It ]S apparent that the damage to Improvements has been caused by natural causes, such as tree roots, uti hty trench settlement, or SOil heavmg, the City of Dublm will pay for the cost of repaIr Where It IS apparent that the property owner frontmg the damaged Improvement has caused the damage, such as dnvlllg vehIcles mto a sIde yard, the property owner shall be respons]ble for the repair The Pubhc Works DIrector shall establish a procedure whereby the property owner wIll be notified of the needed repan, and If not done III a specIfied reasonable time, the PublIc Works Director shall cause the repaIr to be made and the cost of the repaIr, together WIth reasonable admullstratIve costs, shall become a hen agamst the property Time LimIt ofPolIcv 1 hIS policy shall be m effect for FIseal Year 2007-2008 and thereafter be reviewed for extenslOn, modification, or replacement Legal ResponslbIlItv The City of Dublm, m adoptmg thiS polIcy, does so as an accommodatIon to property owners who find It difficult to hIre their own contractors to make these necessary SIdewalk repaIrs The City will let one contract for the 2007-2008 FIscal Year Jnd repaIr those defective SIdewalks which have been brought to the attentlOn of the City by the property owners (or others), and that have an offset of over three-quarters of an mch (3/4') measured vertIcally, wlthm the budget available to do so The eXIstence OfthIS program does not abrogate the responSibIlIty of the property owners to mamtam their frontage Improvements m d safe manner under SectlOn 5610 of the Cal1fomla Streets and HIghways Code Property owners and persons III possessIOn of property are reqUIred to mamtam adjacent pubhc SIdewalks In a safe condItlOn per Dublm MUlllcIpal Code Section 704420 of ArtIcle 4, Chapter 7 04 of TItle 7 G IClPISIDFW AI KI2G07 2008\pollcy FY 07 08 doc t ,0(. \-), b, -r A -to Re.scl u.:h~11
