Chairperson Johnson called the meeting to order at 7:00 p.m. ROLL CALL Present: Commissioners Johnson, Musser, Jennings and Nassar; Eddie Peabody Jr., Community Development Director; Jeri Ram, Planning Manager; Janet Harbin, Senior Planner and Maria Carrasco, Recording Secretary. Absent: Cm. Fasulkey. PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Johnson led the Commission, Staff, and those present in the pledge of allegiance to the flag. The minutes from the June 26, 2001 Planning Commission meeting were approved as submitted. ADDITIONS OR REVISIONS TO THE AGENDA - None ORAL COMMUNICATIONS - None WRITTEN COMMUNICATIONS - None PUBLIC HEARING - 8.1 PA 99-032 SummerHill/Silveria Planned Development Prezoning and Stage 1 Development Plan. The applicant is proposing to place 230 single-family homes'on approximately 105 acres located south and east of the intersection of Tassajara Road and Fallon Road. Planning Commission Regular Meeting 4 6 July 10, 2001 Cm. Johnson asked for the staff report. Janet Harbin, Senior Planner advised the Commission that the proposed project is for a Planned Development Prezoning and Stage 1 Development Plan to construct 230 single family homes at the intersection of Tassajara Road and Fallon Road on approximately 105 acres adjacent to the existing development and boundary of Eastern Dublin Specific Plan area on the Silveria, Haight and Nielsen properties. Development is proposed only for the Haight and Silveria properties under the development plan. The Nielsen property has one dwelling unit and no further development is proposed on the property. Prior to annexation of a property, the City is required to "prezone" the property to an appropriate zoning district for future implementation of a development plan. As these properties are within the Eastern Dublin Specific Plan area, the appropriate zoning district to be applied to the land is a Planned Development District. She gave a brief explanation on the site area, proposed densities, size, area, and phasing plan of the project. The project is consistent with the Dublin General Plan and the Eastern Dublin Specific Plan. Staff recommends the Commission approve the Resolution recommending City Council adopt an Ordinance approving the Planned Development Prezoning and Stage 1 Development Plan for PA 99-032 Adam Tenant, Summerhill Homes thanked the Commission for their review of the project. He stated he does not have anything to add to Ms. Harbin's presentation but wanted to introduce himself to the Commission. He stated he was available to answer any questions. Cm. Musser asked Staff about sewer and water for the project because it is outside the existing Specific Plan area. Mr. Peabody said it is not outside the Specific Plan area. It will need water and sewer service and will require appropriate documentation from Dublin San Ramon Services District that water and sewer services will be available before it can be annexed. Cm. Johnson asked if there were any other questions from the Commission or the public; hearing none he closed public hearing and asked for a motion. On motion by Cm. Musser, seconded by Cm. Jennings, by a vote of 4-0-1 with Cm. Fasulkey absent, the Planning Commission adopted RESOLUTION NO. 01- 14 A RESOLUTION OF THE PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL ADOPT THE ORDINANCE APPROVING A PLANNED DEVELOPMENT (PD) REZONE AND STAGE ! DEVELOPMENT PLAN FOR FOR PA 99-032 SUMMERHILL/SILVERIA 7:17 P.M. - Cra, Nassar was not in attendance for the remainder of the meeting. ®(annintt Commission 4 9 .Tu[y 10, 2001 qOttufar $1eeting 8.2 PA 01-007, Montessori Plus Expansion, Conditional Use Permit for the expansion of the existing school from enrollment of 40 to 60 students within an existing 4,732 square foot tenant space located at 7234- 7240 San Ramon Road in the Stroud's Plaza Cm. Johnson asked for the staff report. Ms. Harbin advised the Commission that Montessori Plus is requesting a Conditional Use Permit to expand the number of students within their facility. The original Conditional Use Permit was approved on September 1, 1998, which allowed 40 students within the school. The children range between the ages of three and six. The hours of operation are from 7:30 A.M. to 5:30 P.M. Monday through Friday, during the calendar school year set by the Dublin School District. The daycare is within the San Ramon Road Specific Plan Area, which requires approval of a Conditional Use Permit prior to operation or expansion of their facility and is zoned C-1 Retail Commercial. The project proposes to enclose an existing gazebo area with a five-foot wrought iron fence to provide an outdoor play area for students. The primary issues associated with the expansion include on-site and off-site traffic and parking, compatibility with adjacent uses and the potential for creation of nuisances. City Staff prepared a traffic and parking analysis and determined that the expansion would add 69 traffic trips per day but will not have any negative effects to traffic and circulation. The Applicant agreed to voluntarily contribute $6,900 to mitigate impacts of any potential non-significant traffic impacts to the area. There are four existing parking and loading spaces for the school, which adequately accommodates their proposal. An Initial Study and Negative Declaration was prepared for the project, and will not propose any significant impacts to the environment. Staff recommends that the Planning Commission approve the resolutions adopting the Negative Declaration and Conditional Use Permit for the expansion of the Montessori Plus day care center in the Strouds Plaza. Cm. Jennings asked if the gazebo area would be enclosed. Howard Wong, Co- owner of the facility stated the gazebo is already enclosed. The State of California Licensing board has approved the gazebo area for a maximum of 94 children, which is above the proposed expansion. Cm. Jennings asked the square footage of the play area and the gazebo area. Mr. Wong responded the interior space is 4,000+ sq.ft, and the outdoor space is 7,090 sq.ft. The gazebo area is approximately 300 sq.ft., which is a small part of the entire play area. Cm. Johnson asked if there were any other questions or comments. Cm. Jennings said the Kindercare project near the shopping center would increase the traffic to that area. She asked the number of students approved for the Kindercare project. Cm. Johnson responded 90 students. He stated that his son's business is in the Stroud's Shopping Center and they have never experienced parking or problems due to the school. Cm. He asked if there were any other questions; hearing none he closed the public hearing and asked for a motion. On motion by Cm. Musser, seconded by Cm. Jennings, by a vote of 3-0-2, with Cm. Fasulkey and Nassar absent, the Planning Commission adopted RESOLUTION NO. 01-15 A RESOLUTION OF THE PLANNING COMMISSION APPROVING A NEGATIVE DECLARATION FOR PA 01-007 MONTESSORI PLUS SCHOOL EXPANSION - CONDITIONAL USE PERMIT RESOLUTION NO. 01 - 16 A RESOLUTION OF THE PLANNING COMMISSION APPROVING PA 01-007 MONTESSORI PLUS SCHOOL CONDITIONAL USE PERMIT TO EXPAND THE ENROLLMENT OF 40 STUDENTS TO 60 STUDENTS WITHIN THE 4,732 SQUARE FOOT TENANT SPACE LOCATED AT 7234-7240 SAN RAMON ROAD, STROUDS PLAZA NEW OR UNFINISHED BUSINESS Mr. Peabody discussed the upcoming Planning Commission agenda schedule.
