meetmg, the City Council reviewed and approved WIth high pnonty the comprehensIve update to certam chapters of the Dublm MUnIcIpal Code (DMC) One chapter proposed for reVIew IS DMC Chapter 5 40, which proVides that 1) all hotels or other establIshments where lIvmg rooms or sleepmg accommodatIons arc rented shall keep a register of theIr guests WhICh mcludes their names, addresses, vehIcle IdentIficatIon and other mformahon, 2) the register shall be mamtamed for two years and be open for InspectIOn by the ChIef of Police, and 3) It IS unlawful for any guest to use a false name when reglstenng Staff has revIewed the chapter and recommends that the word "city' be capItalIzed where necessary to mamtam conSIstency With the rest of the DublIn Mumclpal Code, and that sectIOn 5 40040 be amended to make the reference to the ChIef of PolIce gender neutral Dublm Police Services has revIewed Chapter 540 and concurs WIth the recommended changes RECOMMENDA 'fION Staff recommends that TION *************** The City Council of the CIty of DublIn does hereby ordam as follows SectIOn 1 Chapter 540 of the Dubhn MUlllclpal Code IS revIsed as follows, WIth deletIOns mdIcated m stnkethrough and addItions mdlcated III underlme 5 40010 RegistratIOn reqUired All hotels, motels, lodglllg houses, roommg houses and other places or estabhshments m the City where hVlllg rooms or sleepIng accommodatIOns are rented shall keep a register m which shall be entered m a legIble fashIOn, the followlllg mformatlon the true names and resIdence addresses of all persons to be accommodated, the make, type and license number of any automobIle, traIler or other vehicle and the state III which such vehicle or vehIcles IS, or are, regIstered and the year of registratIOn The regIster shall show the day, month and year when such Information was entered, and the room or rooms to be occupIed by such persons It shall be unlawful for any owner, propnetor or lessee of a hotel, motel, lodgIng house, roommg house or other place or establishment In the City where hvmg rooms or sleepmg accommodatIOns are rented, to refuse or neglect to comply WIth the requIrements hereInbefore set forth 540020 IdentIfication reqUired The person provldmg the accommodatIOns as specified III SectIOn 540010 shall reqUIre IdentIficatIOn to be prcsented upon regIstratIon suffiCient to confirm the IdentitIes of the person to be accommodated, and shall set forth m the regIster the type of Identification so presented 5 40 030 RegIster-PerIod of retentIon Such register shall be kept for a penod of not less than two years by the person proVIdIng the accommodatIOns as specified m SectIOn 5 40 010 540040 RegIster-IuspectlOn Such regIster shall at all tImes be open for mspectIOn by the ChIef of Polrce or hIs/her au thonzed representative 540050 False mformatlon prohIbited It IS unlawful for any guest, roomer, or lodger III any place specIfied III Section 5 40 010 to use or allow the use of any name other than hIS true name m so reglstenng 540060 Postmg regulatIOns A copy of SectIOns 540010 through 540050 shall be posted III a conspICUOUS place In each place speCIfied III SectIOn 5 40 0 I 0 SectIOn 2 Severability The proVISIOns of this Ordmance are severable and Ifany proVISion, clause, sentence, word or part thereof IS held illegal, mvahd, unconstitutIonal, or mapplicable to any person or Circumstances, such Illegality, mvalidIty, unconstItutIonahty, or inapplicabIlIty shall not affect or Imp31r any ofthe remammg provISIOns, clauses, sentences, sectIOns, words or parts thereof of the ordmance or thclr applIcability to other persons or CIrcumstances SectIOn 3 EffectIve Date ThIs Ordmance shall take effect and be enforced thIrty (30) days followmg Its adoption SectIOn 4 PostIng The City Clerk of the City ofDublm shall cause this Ordinance to be posted m at least three (3) publIc places In the CIty of Dub 1m m accordance With SectIon 36933 of the Government Code of
