DESCRJJ:PTION
The Tn-Valley Vouth Court IS an alternatIve JustIce program for the first tIme offender IdentIfied by local
law enforcement, Alameda County ProbatIon and/or school dlstncts Its miSSiOn IS to empower youth to
take an active role III thelT own rehablhtdtiOn by offenng them an opportumty to take responsIbJilty for
their own actIons The process educates youth about the court system, consequences oftheIr actIons, and
how these actiOns affect others mcludmg the ViCtIm, their famtly and the commumty SanctIons are based
on restoratIve JustIce prmclples
The MOD acknowledges the benefits of the Tn-Valley Youth Court, and commIts the City to appomt a
representatIve to serve on the Tn-Valley Youth Court Stakeholders Steenng CommIttee and, dIrects
Dublm Poltce Sen Ices to offer non-vIOlent youth offenders who COnunIt mIsdemeanors or ViOlatiOns and
admit theIr gUIlt, the opportumty to participate m the Tn-Valley Youth Court
WI th the growmg number of J u vemles entcnng the cnmmal JustIce system each year, there 1 s an
Increasmg need for an alternatIve for young people who have commItted a CrIme or offense The Tn-
V alley Youth Court IS an alternative to the traditIonal Juvelllle JustIce system, and school dIsclplmary
proceedmgs, whIch empowers the youth and commumtIes to take an actIve role III addressmg the early
~tages of youth delmquency The Tn-Valley Youth Court Will hold young people accountable for theIr
actIOns while allowmg them to understand the consequences of theIr behaVior Types of offenses heard m
a Youth Court Include cyber-bullymg, traffic, curfew, tobacco, disorderly conduct, vandalIsm, theft and
truancy The process mvolves the follOWIng
A "defendant" admIts the actIon of whIch she/he IS accused, and chooses to partiCIpate III the
Youth Court The case IS heard WIthm 2-4 weeks of the offense

3 The "Adult Judge Model" chosen for the Tn-Valley Youth Court has attorneys servmg as Judge,
and youth servlllg as clerk, defense attorney, prosecutor and Jurors
4 The defendant's case IS heard and gIven a SanctIon Plan (a sentence) by the JUry
5 SanctIons are based on restoratIve Justice prmclples dnd always contam JUry duty and
community service AddIttonal sanctIons can be oraUwntten apologies, essays, educatIOnal
workshops, anger management and/or some form of reimbursement
6 When the defendant completes their SanctIOn Plan, the case IS closed The mCldent will not go
on a cnmmal record
7 lfthe SanctIOn Plan IS not completed, the case goes back to the tradItIOnal Juvemle JustIce
system

Staff recommends that the CIty Council adopt a resolutIon approvmg a Memorandum of UnderstandIng
(MOD) With the Tn-Valley Youth Court, and authonzmg the CIty Manager to Sign the MOU

sign to slgn, on behalf of the City of Dub 1m, a Memorandum ofDnderstandmg, attached hereto as
Exhibit A, between the Center for DIspute Settlement & Tn-Valley Youth Court and the Clty of Dublm
appomtlllg a City representatIve to serve on the Tn-Valley Youth Court Stakeholders Steenng CommIttee

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DUBLIN
AND THE TRI-VALLEY YOUTH COURT
WHEREAS, the City of Dublin recognizes that with the growmg number of
adolescents gOing through the Criminal Justice system each year, there IS an
increasing need for an alternative for young people who have committed a cnme
or offense,
WHEREAS, the City of Dublin recognizes the Tn-Valley Youth Court IS an
alternative to the traditional Juvenile Justice system and school disciplinary
proceedings which empowers the youth and communItIes to take an active role
m addreSSing the early stages of youth delinquency,
WHEREAS, Tn-Valley Youth Court Will hold young people accountable for their
actIons while allowmg them to understand the consequences of their behaVior by
fOCUSing on their strengths and giving them an opportunity to take an active role
In making amends, and
WHEREAS, the City of Dublin recognizes the benefit of allOWing young people to
serve as the Judge JUry, prosecution, defense, and bailiff who hear cases from
other young offenders and deCIde on an appropnate sentence which can Include
community service, restitution, essays and letters of apology and JUry duty
The City of Dublin hereby agrees to
1 ApPOint a City representative to serve on the Tn-Valley Youth Court
Stakeholders Steenng Committee and
2 Instruct Dublin Police Services to refer non-Violent youth offenders who
commit a misdemeanor or Violation and admit their gUilt, to the Tn-Valley
Youth Court
