EXHIBIT C GENERAL PROVISIONS l~;g6th ZONING UNIT 3uly 20:1951 The Final Map of Tract t~719 shall be filed with the County Recorder of Alameda County prior to commencement of any improvement in the praiect, with the exception of grading and improvements related thereto and extension of Stagecoach Road. All conditions of approval for Tract g719 are incorporated by reference as General Provisions of this reclassification. Prior tO any grading, a detailed construction grading plan and soil erosion and sedimentation control plan prepared by a Civil Engineer in accordance with maps and provisions of this reclassification and the proiect soils and geologic investigatlon report shall be approved by the Director of Public Works. Grading shall be completed in accordance with this plan to the satisfaction of the Direr:or of Public Works. Grading transitions from natural slopes to graded slopes above Stagecoach Road shall be approved by the Planning Director and completed to the satisfaction of the Planning Director. Prior to filing the Final Map, the foliowing shall be done: a. A detailed landscape plan, prepared by a registered landscape architect, shall be approved by the Planning Director. All landscaping shall be maintained at the developer's expense until landscaping has been fully installed and established and fine morovements have been accepted by the Board of Supervisors. Transfer of maintenance responsibility to the homeowners association or individual homeowners shall not occur until requirements of this provision and the iandscaplng plan are met. b. A homeowners association encompassing all lots in this pro)ecl shall be formed. CC&Rs for each lot shall be approved by the Planning Director, CC&Rs for said Association shall require that: l) payment of dues and assessments shall be both a lien against the assessed land and a personal obligation of each property owner; 2) The.Association shall take fee title to Parcel 154. 3) The Assoclation maintain ali common areas in good repair, including d~alnage and erosion control improvements, fences, and andsca~lng. The Association shall rnaintain, through an appropriate easement, slope areas on individual lots. The Association shall maintain fire breaks to the standards of Dublin San Ramon Services District Fire Department. the Association shall keep the County Planning Department informed of the current name, address, and phone number of the Association's official representative; and d. Deve oper shall deposit one-half the cost of signalization at Stagecoach Road and Amador Valley Boulevard to requirements of the Director of public Works. EXHIBIT C - GENERAL PROVISIONS 1486th Zoning Unit - July 20, 1981 Page 2 Prior to issuance of Building Permits, the following shall be done: a. Developer shall submit for Planning Director approval a program for Incorporation of passive solar design features in homes to be built on subject ets to the maximum p(actical extent. Such features may ln.c~ude, but are not limited to: house-to-lot orlentation (m nar axis wLthin 22.5 of true south); maximization of southfacing glass~ overhang or awnings on south windows and exposures~ deciduous trees provLdLng summer shade on south~ southeast, or southwest facades (15 gal. mLnlmum)i and provision of heat collectors (such as concrete floors or water-filled contaln~r walls). b. The project shah be designed to the satisfaction of the Building OfficLaI to facilitate the curren{ or later addition of solar hot water systems, as follows: 1) Construction plans shall designate the location on the roof for the necessary number of collectors to achieve 60% solar dependency in an area free of plumbing or heating vents or other obstructions and with a structural capacLty to support the collectors~ 2) Construction plans shali designate the location Ln each building for an appropriately sized hot water storage tank or tanks; 3) Project plans shall include Installation of the following: a) MountLng brackets attached to the roof structure to facLlitate later installation of collectors without cutting roof membrane; b) Properly-sized piping between the storage tank location(s), the collector location and the location of the backup hot-water heater; c) Properly sized electrical conduit and pull w'ire between the storage tank location(s), collector locations and the location oi the backup hot-water heater to facilitate later installation of sensor wiresl d) Properly sized electrical outlet at the storage tank location to provide power for circulatory pumps; e) One model home with a fully operational solar hot water system; f) Dedicate solar access easements to assure that each lot shall have the right to receive sunlight across adjacent parcels Ln this project. Said easements are to be designed by the subdivider and approved by the Planning Director. Solar hot water systems shall be offered to buyers as an optional improvement. Final design drawings and improvemen~ plans shall be followed during development and construction, unless changes are authorized pursuant to General Provision 9. Prior to final inspection of each unit or groups of units, the following shall be der, e: a. Provide evidence to the Building Official from the Pacific Gas and Electric Company that the units meet PG&E's requirements of the "Energy ConservatLon Home Program." b. The Project Architect or Civil Engineer shall provide a letter to the Building Official stating that water conservant toilets, shower heads, faucets, and automatic dishwashers with low flow cycles have been installed in the units. During the constructionstage of the project, changes in the provisions of the approved Land Use and Development Plan and beyond those required under provisions contained in Exhibit B, may be authorized through Zoning Approval to the following extent: "' a. Grade: Grades on the construction grading plan may be changed a maximum of 5 feet from those shown on the grading plan in Exhibit B. b. Plant Materials: One variety of plant materials may be substituted for another o~ similar size and characteristics. c. Landscape Features: Arbors, mounds, benches, fences, and other landscape features may be added or modified in design, location and materials. If the requirements o~ the approved plan are specified as minimum or maximum, said minimums or maximums shall not be exceeded. Any other change may be permitted to the extent and in the manner specilied under Section $-31.Ig of the Alameda County Zoning Ordinance. All structures and roadways must be contained respectively within lot and right-of-way boundaries. i0. A~ter the project has been completed, and subject to observing any minimum and maximum dimensions specified in the approved plan: a. In the common areas, plant materials, arbors, fences, paving materials, and similar landscape features may be added, replaced or deleted. b. Any construction, repair or replacement which would occur in the normal occur subject to the securing of any permits or paying fees required by other ordinance. Any other changes may be permitted to the extent and in the manner specified under Section g-31.1 $ of the Alameda County Zoning Ordinance. 11. Lots designated for single family dwellings shall be subject to any and all restrictions of the Alameda County Zoning Ordinance pertaining to the R-1-B-E (6,000 sq. ft. minimum lot size) District, except that in case o~ conflict with these PD provisions, these provisions shall prevail. 12. Reclassification to a different PD (Planned Development) District shall be required at the time any Tentative Map is submitted for parcel 151. At least 2/3 oi the units to be proposed on Lot 15i must be attached and clustered. Densities may range from 6 to 14 units per acre. 13. Developer shall be responsible for connection of Stagecoach Road to Alcos:a Boulevard prior to Building Inspection Department framing inspection of any unit, constructed to its ultimate design conliguration beyond the limits oi any stage of development for which a Final Map is iited. However~ it must be constructed to specifications ol Dublin 5an Ramon Services District Fire Department. Notwithstanding the above, no more than 120 units shall be granted building permits prior to connection oi Stagecoach Road with Alcosta l~oulevard~ unless approved by the Planning Director. 15. Lot ~'1152 shall be dedicated to the Sunny Glen Adult Community, Inc. ig. Subdivider shall pay fees in lieu of park dedication to Dublin San Ramon Services District based on value of the number oi square feet of land in the tract required by the Subdivision Ordinance. Prior to 3uly i, 1953, and approximately every 2-1/2 years thereafter un:il completion of all construction, the Planning Director will review these General Provisions and report to the Planning Commission. The Planning Commission may, for cause, initiate a public hearing for the purpose of recommending to the Board of Supervisors that the Board add Provisions, modify existing Provisions, or eliminate Provisions at that time. lg. Prior to filing a Final Map, the Director of Public Works shall report on the feasibility of providing access and a bike lane to the site from Amador Valley Boulevard further to the east so as to avoid adding to traffic on the protion of Stagecoach Road upon which houses now front. Approval of access as shown on Exhibit B is given only insofar as alternative access is environmentally and/or economically infeasible.
