Clerk of the Board of Supervisors pf t '~ ' the County of Alameda Sta~e of California EXHIBIT C - 1394 ZU ZONING UNIT GENERAL PROVISIONS APPROVAL RECOMMENDED BY THE ALAMEDA COUNTY PLANNING COMMISSION ON APRIL 16, 1979 The final m(]p of Tract 4236 shall be filed with the County Recorder of Alamed(] County prior to commencement of on), improvement in the project~ with the exception of graCing. Prior to (]ny grading, o der(]lied construction grading plan and soil erosion and sedimentation control plan prepared by o Civil Engineer in accordance with mops and provisions of this reclassification and the project soils and geologic investigation report shall be (]pproved by the Director of Public Works. Grading shall be completed in accordance with this plan to the s(]tisf(]ction of the Director of Public Works. Along with filing the Final Mop, o Homes Association encompassing oll lots in this project shall be formed. The Homes Association shall be responsible for maintenance of the common portions of exteriors of units, fences, one tree planted on e(]ch lot by the subdivider, and special landscaping designated on Exhibit B. The Homes Association shall include on Architectural Review Committee which shall h(]ve approval (]uthority over exterior maintenance or and improvements of units. A current n(]me, address, (and phone number of the Homes Associ(]tion representative shall be provided to the Alamed(] County Planning Deportment. Prior to occupancy, project shall be completed in compliance with recommendations contained in the soil and geologic report, os approved by the Director of Public Works, which is made o port of this approval, and shall be done under the supervision of the Project Soils Engineer or Civil Engineer who shall upon its completion submit a declaration of such compliance to the Building Official and Director of Public Works. Prior to final inspection and occupancy of each lot and unit or group of lots and units in the project, the following shall be done: Required landscaping shall be installed in compliance with the plans required in Conditions of Approval, Tract 4236. Provide evidence to the Building Official from the Pacific Gas and Electric Company that the units meet P.G. & E.'s requirements of the "Energy Conservation Home Program" 100 point rating. The Project Architect or Civil Engineer shall provide a letter to the Building Official stating that water conservant toilets, shower heads, faucets, and automatic dishwashers with Iow flow cycles have been installed in the units. d. Utility meters shall be screened from public view. e. Automatic garage door openers shall be provided each unit. Prior to final inspection and occupancy of the last I0 units in the project, the Project Civil Engineer shall provide o letter or letters to the Building Official stating that the project, os built, complies with provisions of this District. Said letter or letters shall contain o report accompanied by o map indicating any authorized changes pursuant to General Provision #7. Exhibit (2 - 139z~th Zonin April 16, 1979 Page Two it During the construction stage of the project, changes in the provisions of the approved Land Use and Development Plan and beyond those required under provisions contained in Exhibit B, may be authorized through Zoning Approval to the following extent: a. Grade: Grades may be changed in elevation to two feet. be Unit type and Number of Bedrooms: Designated unit type, location, and number of bedrooms may be changed for any other unit type illustrated on Exhibit B. If the requirements of the approved plan ore specified os minimum or maximum, said minimums or maximums shall not be exceeded. Any other change may be permitted to the extent and in the manner specified under Section 8-31.18 of the Alameda County Zoning Ordinance. After the project has been completed, and subject to observing any minimum and maximum dimensions specified in the approved plan: Improvements may be added or modified in the individually owned lots provided that no rear yard be reduced below 20 feet deep, and no side yards are reduced without obtaining Zoning approval. Plant materials, arbors, fences, paving materials, and similar landscape features may be added, replaced or deleted. All permitted and conditional uses in the R-I District are permitted in this PD District subject to all procedures in the Alameda County Zoning Ordinance. This PD District is subject to all pertinent General Provisions of the Zoning Ordinance. Any other changes may be permitted to the extent and in the manner specified under Section 8-12.8 of the Alameda County Zoning Ordinance.
