HomeMy WebLinkAboutPre-Hearing Staff Analysis PA82-012 Hackler Vet Hospital CUP PRE-HEARING STAFF ANALYSIS FROM: SUBJECT: Planning Director PA 82-012 Hackler Veterinary Hospgta1 Conditional Use Permit GENERAL INFORMATION Applicant: Russell Hackler Property Owner: Jim Lange Project Location: 6612 Dublin Boulevard APH 941-205-5-3 Zoning: C-2 (General Commercial) District EIR Status: Categorically Exempt, Class 5 Applicable Regulations: Zoning Ordinance Section 8-49.2 permits veterinary hospitals in General Commercial Districts if they first receive a Conditional Use Permit. Section 8-94.0 states that conditional uses must be analyzed to determine: 1) whether or not the use is required by the pubHc need; 2) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 30 whether or not the use wi 11 materially affect the health or safety of persons residing or working in the vicinity;aadd4) whether or not the use will be contrary to the specific intent clauses or performance standards established for the district in which it is located. Section 8-94.4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptabce and observance of specified conditions, including but not limited to th~ following matters:' a) Substantial conformity to appr~ve~ .plans and drawings; b) Limitations on time of day for the conduct of specified activities; c) Time period within which the approval ~sha11 be exercised and the proposed use brought into existence~ failing which the approval shall lapse and be void; d) Guarantees as to compliance with the terms of the approval, aic1uding the posting of bond. e) Compliance with requirements or other departments of the County Government. Background: The Hackler Veterinary Hospital received a Conditional Use Permit from the Alameda County Zoning Administrator on September 12, 1979 (Resolution #Z-3865 C-3671). The permit was granted for 3 years, expiring on September 12, 1982. To Staff's knowledge, no complaints about this use have been filed with either Alameda County or the City of Dublin. PRE-HEARING STAFF ANALYSIS 2age 2 ANALYSIS The Hackler Veterinary Hospital is located in a small shopping center which contains a number of varied uses. These uses range from the Chamber of Commerce to a restaurant to a shoe repair. The center is well maintained. The Veterinary Hospital has a rear service area which is kept c1e~n and free of debris. Ample parking is available. Findings: i a) The use provides a service to thA community. Twelve veteninary hospitals are now locatdd in the Dublin, San Ramon and P1easanton areas. T~is number is reasonable given the present plpu1atfon of the affected communities. b) The use is properly related to adjacent tand uses, transpqrtation and service faci- lities in the vicinity of the use. No co~laints have been filed, which indicates that this use is incompatible with its neighboring uses. c) The use is self-contained with no outdoor kennel, refuse qr waste handling areas. There is no apparent health or safety hazard. The use th~refore, does not present any detrimental impact that might affect people residing or working in the vicinity of the use. d) The use is not contrary to the specific intent clauses or 'performance standards of the C-2 District. PRE-HEARING RECOMMENDATION: Extend the conditional use for another 3 years (until Septembelr 12, 1982). This approval shall remain revocable for cause in ~ccordance with Section 8-90.3 of the Zoning Ordinance. A
