FalT!i1y Combining District) EIR Status: Categorically Exe.mpt, Class 5 . - . ~ . ~ ". ~ Applicable Regulations: The Zoning Ordinance allows churc~hes to be built in single family residential zones when approved as a Conditional Use .(~~~ttQ~ 8~26.3). The intent of the District is, JI! part,to provide for appropriate community facilities (Section 8-26.0). . ~ "'. Section 8-94.0 of the Zoning O~di.nance states that conditional uses must be analyzed to determine:1) whether or not the, use. is required by the public need. 2) whether or n<<lt the use will be properly related tqot~..e.rland uses, transportation and service facilities in tl6e vicinity. 3) whether or nq~ ,~he use will materially affect the health or safety of persons residing or working in the vicinity. and 4) whether or not the use will be con- trary to the specific intent clauses or performance standards established for the district in which it is located. .- Section 8-94.4 states the apprq~a1_ of a Conditional Use Pennit may be valid only for a specified term, and may be made, ,contingent upon the acceptance and observanoo of specified conditions, including but not ~1~i_lT!i.te,4 to the following matters: a) Substantial conformity to .allprovedp.lans and Grawings. b) Limitations on time of day-for"the conduct of specified activities. c) Time period within which the allprova1 -shall be exercised and the proposed use brought into existence, failing wtilch the approval shall lapse and be void. d) Guarantees as to compliance with "the terms of the approval, including the posting of bond. . . - '" e) Compliance with requiremen~~ or 'other departments of the County Government. Background: The Parkway Baptist Church rece,i.ved a Conditional Use Permit from the Alameda County Zoning Administrator on Septemb.e~ 17, 1980. That permit allowed the use of a 8' x 40' trailer as a classroom for a period of two years. This application is a request to extend that Conditional Use Permit. The trai1~r is still in use. It is located to the rear of "-f'\L-IILnr,.&..,u ..JIMI. nI1M...I..>1..> Page 2 the church and in front of a drainage channel. The trailer CBn be seen to a limited degree by people driving south on Village Parkway and from the rear yards of single family residences on the opposite side of the channel. ANALYSIS The trailer is now serving as 'a needed classroom. It is hidden from most views and it has been maintained so as not to present an unsightly appearance. The trailer has two entrances which ~r4 directly off raised landings. These landings have railings on one side, but not the other side which creates a safety problem. There are some miscellaneous materials stored adjacent to the trailer which would best be stored out of sight from Vi11~ge Parkway. Findings: Subject to the recommended conditions of approval the following findings can be made: a) The use is required by the public need as applicatint states religious instruction classes require this additional space to serve the congregation. b) As a temporary use, it will be properly related to other land uses and transportation and service facilities in the vicinity. c) The use, if permitted, under all the circumstances and conditions of this particular case will not materially affect adversely the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injur- ious to property or improvements_ in the neighborhood. d) The use will not be contrary to the specific intent clauses or performance standards established for the District because it is an appropriate community facility. -iRE-HEARING RECOMMENDATION Approve the extentiODnof the Conditional Use Permit for two (2) additional years (Sep- tember 17, 1984) subject to the fon owi ng conditi ons: ,...- . . ~ 1. The landings of the stairs that l.eadtto the entrances of the trailer shall be provided with railings on the open slde.- These railings shall comply with the limitations on railrail spacing and stability as specified by the Alameda County Building Inspection De- partment. ..' - 2. The miscellaneous materiafs located near the trailer shall be removed so as to present a tidy appearance from Vll.1age Parkway. This approval shall remain revocable for cause in accordance with Section 8-90.3 of the Zoning OrdiBBnce. Attachment: Site Plan
