The site currently contains an office building and a truck repair business. The applicant proposes to adq a warehouse to the easterly parcel and a cafe to the westerly parcel. APPLICANT: Fred Houston 7045 Dublin Blvd. Dublin CA 94568 ASSESSOR PARCEL NUMBER: 941-550-4 PROPERTY OWNER: Fred Houston EXISTING ZONING: Industrial} sq. ft. per Planned development for M-l (Light and C-2 (General Commercial) uses with a 20,000 lot minimum EXISTING LAND USE: Office building, truck repair, cargo storage, and vacant SURROUNDING ZONING AND LAND USE: North - Lumber Yard - PD (for M-l and C-2) East - Flood Control Channel and Railroad South - Brake shop, Building materials, Vacant West - Bowling alley - C-2 ~ SITE/ZONING HISTORY.: On October 4, 1979, the Alameda County Board of Supervisors approved a rezoning of the property from M-l to PD, for M-l and C-2 uses. A 40,000 sq. ft. minimum lot size was also established. APPLICABLE REGULATIONS: TITLE 8, Ch. 1, ALAMEDA COUNTY SUBDIVISION ORDINANCE, AS ADOPTED BY THE CITY OF DUBLIN: 8-1.2 INTENT: It is the intent of this Chapter to promote the public health, safety and general welfare; to assure in the division of land consistent with the policies of the Dublin General Plan and with the intent and provisions of the Dublin Zoning Ordinance; to coordinate lot design, street patterns, rights-of-way, utilities and public facilities with community and neighborhood plans; to assure that areas dedicated for public purposes will be properly improved, initially, so as not to be a future burden upon the community; to preserve natural resources and prevent environmental damage; to maintain suitable standards to insure adequate, safe building sites; and, to prevent hazard to life and property~ ENVIRONMENTAL REVIEW: on this project. report. A Negative Declaration (NO) was prepared A copy of the NO is attached to this NOTIFICATION: Negative Declaration notices have been published in the Tri-Valley Herald, mailed to adjacent property owners and posted in public buildings. -1- ANALYSIS: This application is for a fairly straightforward subdivision of land. The three parcels will be useable and relate properly to the types of uses proposed for the site and being consistent with the PD zoning. The eastern portion of the site, as with adjacent property, has been prone to flooding and/or contributes to flooding of neighboring property. The associated problems can be resolved and do not present any significant roadblock to development. In reviewing the proposed Tentative Parcel Map, Staff does have one change in the design that warrants special mention: The applicant proposes to provide a 20-foot private street to provide access to his three lots. This has been a common practice in the area--a practice which has resulted in numerous independent lots, served by poorly maintained accessways, and which creates poor areawide circuation, as well as an unorganized and unattractive area. Staff is of the strong position that, in lieu of private roads, new development should be fed by public streets that provide access to multiple parcels; control car, truck and pedestrian traffic, improve traffic safety, and properly control drainage. For those reasons, Staff is recommending conditions of approval that require that 1/2 of a public street be provided by this applicant and that, when the property to the north develops, it's developer complete the other 1/2 of the street. PLANNING COMMISSION ACTION REQUIRED: The Planning Commission should hold a public hearing on this request; make a decision on the Negative Declaration, make a decision on the Parcel Map application, and make findings to support its decision. If the Commission approves the Negative Declaration and approves or conditionally approves the Tentative Parcel Map, a Resolution should be passed to support the decisions. PRE-HEARING RECOMMENDATION ~ It is recommended that Negative Declaration and Tentative Parcel Map 4008 be approved subject to the Conditions of Approval, and upon making the Findings contained in the attached Draft Resolutions. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ------------------------------------------------------------------ ADOPTING A NEGATIVE DECLARATION CONCERNING PA 83-016 WINNING ACTION TENTATIVE PARCEL MAP WHEREAS, the California Environmental Quality Act (CEQA), as amended together with the State's administrative guidelines for implementation of the California Environmental Quality Act and City Environmental regulations, requires that certain projects be reviewed for environmental impac~ and that environmental documents be prepared; and, WHEREAS, a Negative Declaration has been prepared by the Dublin Planning Department; and, WHEREAS, the Planning Commission did review the Negative Declaration and considered it at a public hearing on July 5, 1983; NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission finds that the Negative Declaration has been prepared and processed in accordance with State and local environmental law and guideline regulations and that it is adequate and complete.
