HomeMy WebLinkAboutPC Reso06-29 Appv 05-015 DevAgrmt Sonata Project RESOLUTION NO. 06 - 29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT FOR DUBLIN RANCH AREA F NORTH, NEIGHBORHOOD F-1 FOR STANDARD PACIFIC HOMES 'SONATA' PROJECT (TRACT MAP 7282, COMMONLY KNOWN AS PARCEL 3 OF TRACT MAP 7281) PA 05-015 WHEREAS, the Applicant, Standard Pacific Homes has requested approval of a Development Agreement for PA 05-015 to develop 119 medium density single family detached homes in Neighborhood F-l (Tract No. 7282) of Dublin Ranch Area F North on ::1:16.0 acres of land generally located north of Gleason Drive and east of Tassajara Road within the Eastern Dublin Specific Plan Area and within Planned Development Zoning District, PA 01-037; and WHEREAS, a Development Agreement is required as an implementing measure of the Eastern Dublin Specific Plan; and WHEREAS, on March 16, 2004, the City Council adopted Resolution No. 43-04 regarding P A 01-037, certifying an Addendum to the Eastern Dublin EIR, a program EIR, initially certified by the City of Dublin in 1993 (SCH#91103064); and WHEREAS, pursuant to Section 15182 of the California Environmental Quality Act (CEQA), residential projects which are consistent with a Specific Plan are exempt from further CEQA review; the Neighborhood F-l has been reviewed pursuant to CEQA and a determination has been made that the project is consistent with the Eastern Dublin Specific Plan of which the project is a part. The Eastern Dublin Specific Plan was the subject of an Environmental Impact Report certified in May 1993 by City Council Resolution 51-93 (SCH 91103064). That EIR, along with a subsequent Mitigation Negative Declaration certified in February 2000 by City Council Resolution 34-00 (SCH#99112040) adequately addresses project impacts for the purposes ofCEQA; and WHEREAS, a draft Development Agreement is attached to this Resolution as Exhibit A and addresses many items, including, but not limited to, timing and phasing, project and off-site infrastructure, and payment, waiver or credit of fees; and WHEREAS, the City of Dublin Planning Commission ("Planning Commission") held a public hearing on said application on August 22, 2006; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the Staff Report was submitted recommending that the Planning Commission recommend that the City Council approve the Development Agreement; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above set forth and used its independent judgment to evaluate the project; and 10f3 WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved. NOW THEREFORE BE IT RESOLVED that the Dublin Planning Commission does hereby make the following findings and determinations regarding said proposed Development Agreement: 1. Said Agreements are consistent with the objectives, policies, general land uses and programs specified in the Eastern Dublin Specific Plan/General Plan in that, a) the Eastern Dublin Specific Plan/General Plan land use designation for the subject site is Medium Density Residential and that the Standard Pacific Homes 'Sonata' project within Dublin Ranch Area F North, Neighborhood F-l is consistent with that designation; b) the project is consistent with the fiscal policies in relation to provision of infrastructure and public services of the City's Eastern Dublin Specific Plan/General Plan; c) the Agreements set forth the rules the Developer and City will be governed by during the development process which is required by the Eastern Dublin Specific Plan and the Mitigation Monitoring Program for the Eastern Dublin Specific Plan. 2. Said Agreements are compatible with the uses authorized in, and the regulations prescribed for, the land use district in which the real property is located in that the project is consistent with the General Plan Amendment, Eastern Dublin Specific Plan Amendment, Planned Development Rezone, Vesting Tentative Map, and Site Development Review which were approved in 2004. 3. Said Agreements are in conformity with public convenience, general welfare and good land use practice in that the Standard Pacific Homes 'Sonata' project within Dublin Ranch Area F North, Neighborhood F-l will implement the land use guidelines set forth in the Dublin General Plan and Eastern Dublin Specific Plan as proposed. 4. Said Agreements will not be detrimental to the health, safety and general welfare in that the development will proceed in accordance with the Agreements and any Conditions of Approval for the Project. 5. Said Agreements will not adversely affect the orderly development of the property or the preservation of property values in that the development will be consistent with the City of Dublin General Plan and Eastern Dublin Specific Plan. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Dublin Planning Commission does hereby recommend that the City Council approve the Development Agreement, in substantially the form attached as Exhibit A, between Standard Pacific Homes and the City of Dublin for PA 05-015, Dublin Ranch Area F North, Neighborhood F-1.
