The meeting was called to order at 7:03 p.m., by Mayor Lockhart. · ROU. CALL PRESENT: Councilmembers Hildenbrand, McCormick and Oravetz, and Mayor Lockhart. ABSENT: Vice Mayor Zika · PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the Council, Staff and those present. · ORAL COMMUNICATIONS Introduction of New Employee: Alameda County Sheriff's Technician Nancv Melanson 7:04 p.m. 3.1 (700-10) Commander Gary Thuman introduced Alameda County Sheriff's Technician Nancy Melanson. Recœtnition of Emplovee Award Recipients 7:08 p.m. 3.2 (720-20) Economic Development Director/Acting Planning Manager Chris Foss advised that Housing Specialist Julia Abdala had recently been honored as a recipient of the Tri - Valley Interfaith Poverty Forum's 2005 Community Service Award. Commander Gary Thuman advised that Deputy John Belfer had recently been honored as a recipient of the Mother's Against Drunk Driving (MADD) 2005 Deuce Award. Commander Gary Thuman advised that Community Safety Assistant Rose Macias had recently been honored as the recipient of the 2005 Northern California Crime Prevention Practitioner of the Year Award. The Council recognized and congratulated Ms. Abdala, Deputy Belfer and Ms. Macias on their community service awards. . AutoPulse Resuscitation System Presentation 7:15 p.m. 3.3 (150-70) Mayor Lockhart advised that the Alameda County Fire Department would provide a presentation on the AutoPulse Resuscitation System that the Dublin/San Ramon Women's Club had purchased and generously donated to the Cities of Dublin and San Ramon. Charlotte McCuen and Jean de la Montanya, Dublin/San Ramon Women's Club, advised that it was the Women's Club's goal to provide each Fire Station in Dublin with AutoPulse Resuscitation Systems. The Women's Club was here to ask for the Council's financial support. Assistant Chief Rich Brown, Alameda County Fire Department, outlined the ability of the AutoPulse Resuscitation System and its important role in saving lives. DUBLIN CITY COUNCIL MINUTES VOLUME 24 REGULAR MEETING November 1, 2005 PAGE 405 www.ci.dubliu.ca.us Members of the Alameda County Fire Department demonstrated the AutoPulse Resuscitation System. Cm. Hildenbrand confirmed that there was currently only one AutoPulse in Dublin, which was at Fire Station #16, and advised that it would be good to have one for every Station in Dublin. Assistant City Manager Pattillo advised that one of the Council's high priorities was to have Staff study the AutoPulse System and return to the Council with an evaluation of its findings. Staff was directed to wait for a year's perspective to provide due diligence studying the system currently located at Fire Station No. 16. Assistant Chief Brown agreed that due diligence study to make an educated decision was needed before more systems were accepted. Engineer Mark Pinto, Alameda County Fire Department, commented that the system allowed firefighters to remain seated and buckled during transport, which was important to their safety. Assistant Chief Brown advised that that type of information would be included in the study. Mayor Lockhart commended the Women's Club for having the foresight to bring this to our community, and thanked each member on behalf of the Council and the members of the community. After the evaluations come in, hopefully the City will become a partner in fundraising to put the system in throughout the community. . Hildenbrand and by majority vote (Vm. Zika absent), the Council took the following actions: Approved (4.1) Minutes - None; Adopted (4.2 600-60) RESOLUTION NO. 209 - 05 ACCEPTANCE Of DRAINAGE IMPROVEMENTS FOR TRACT 5926 (CALIFORNIA HIGHLANDS) Accepted (4.3 600-35) improvements under Contract No. 04~04, Traffic Signal at Amador Valley Boulevard and Starward Drive; and authorized the release of retention after 35 days if there are no subcontractor claims; Accepted (4.4 600-35) improvements constructed under Contract No. 04-14; and authorized final payment to Cal-Neva Environmental Systems, less retention to be paid in 35 days if no subcontractor or supplier claims; Approved (4.5 330-20) final Budget Changes for Fiscal Year 2004-05 in the total amount of $4,121,414; Approved (4.6 600-35) BudgefChange in the amount of $20,161; accepted work under Contract No. 05-05, 2004-2005 Annual Street Overlay Program and Dublin Sports Grounds Renovations "{Parking Lot); and released retention after 35 days if not, subcontractor claims; Approved (4.7 330-40) Budget Changes for Carryovers from Fiscal Year 2004-2005 to Fiscal Year 2005-2006 in the total amount of $2,940,285; DUBLIN CITY COlJNCIL MINUTES VOLUME 24 REGULAR MEETING November 1, 2005 PAGE 407 www.d.dublin.ca.us Approved (4.8 670-80/600-30) Agreement for Sale of Surplus Property along San Ramon Road and Authorized Mayor to sign Quit Claim Deed; Adopted (4.9 600-40) RESOLUTION NO.2 10,-·05 APPROVING MEMORANDUM OF UNDERSTAND BETWEEN THE CITY OF DUBLIN AND DUBLIN UNIFIED SCHOOL DISTRICT FOR SCHOOL RESOURCE OFFICER and authorized the City Manager to execute the Memorandum of Understandins; and Approved (4.10 300-40) the Warrant ReSister in the amount of $1,503,020.67. . WRITTEN COMMUNICATIONS - None . PUBUC HEARINGS Public Hearing East Dublin BART Parking Structure Sta'le Z Planned Development Rezonimt 7:34 p.m. 6.1 (450-30) Mayor Lockhart opened the public hearing. Planning Consultant Mike Porto presented the Staff Report and advised that this was the second reading of an Ordinance which would approve Stage 2 Planned Development Rezoning for the East Dublin BART parking structure. This project consists of a 6- 7 level parking structure, surface parking and 7,500 square feet of ground floor retail on approximately +4.99 acres of land within the Dublin Transit Center. The parking structure would replace the majority of existing surface parking for BART patrons at the Dublin Transit Center. DUBLIN CITY COUNCIL MINUTES VOLUME 24 REGULAR MEETING November 1, 2005 PAGE 408 www.ci.dublin.CII.us Mr. Porto advised that, since the first reading of the Ordinance at the October 18,2005 Council meeting, the plan itself was updated to reflect that in Phase I there shall be no less than 1,706 parking stalIs provided and, in Phase 2, there shall be no less than 2,219 parking stalls provided. Other minor modifications were also made to allow flexibility in those numbers as to what was structure and what was surface to make them come out equal in the end. No testimony was entered by any member of the public relative to this issue. Mayor Lockhart closed the public hearing. On motion of Cm. McCormick, seconded by Cm. Oravetz and by majority vote (Vm. Zika Absent), the Council waived the second reading and adopted ORDINANCE NO. 28- 05 AMENDING THE ZONING MAP TO REZONE PROPERTY AND APPROVING A RELATED STAGE 2 DEVELOPMENT PLAN FOR THE PROJECT KNOWN AS THE EAST DUBLIN BART PARKING STRUCTURE WITHIN A PORTION OF THE DUBLIN TRANSIT CENTER (POR OF APN 986-0001-009 AND POR OF APN 986-0001-01 :~-02) PA 03-062 .. Public Hearing Ordinance Amending Section 5.56.050 of the Dublin Municipal Code, Relati~ to Smoking in Public Places 7:36 p.m. 6.2 (560-90) Mayor Lockhart opened the public hearing. City Attorney Elizabeth Silver presented the Staff Report and advised was the second reading of an Ordinance intended as a folIow~up to an Urgency Ordinance adopted by the City Council at its October 4, 2005 meeting, which prohibits smoking in all retail or wholesale tobacco shops and private smokers' lounges within the City of Dublin. Karen Seals, Dublin resident, thanked the Council for being proactive in protecting the health of Dublin citizens. DUBLIN CITY COUNCIL MINUTES VOLtJME 24 REGULAR MEETING November I, 2005 PAGE 409 www.ci.dublin.ca.us Bruce Fielder, Dublin resident, congratulated the Council tonight's action and urged them to continue efforts to clear the air in Dublin for ourselves and our children. Mayor Lockhart closed the public hearing. Cm. McCormick acknowledged the leadership Mayor Lockhart for leading the Council to tonight's decision, and thanked the resident Karen Seals for her community efforts. Mayor Lockhart thanked Karen Seals, who brought this issue to the Council's attention, as well as Serena Chin, with the American Lung Association. She felt confident that the Council was supporting the health and welfare of the community. On motion of Cm. Hildenbrand, seconded by Cm. Oravetz and by majority vote (Vm. Zika absent), the Council waived the second reading and adopted ORDINANCE NO. 29 - 05 AMENDING SECTION 5.56.050 or THE DUBLIN MUNICIPAL CODE, RELATING TO SMOKING IN PUBLIC PLACES + UNFINISHED BUSINESS - None + NEW BUSINESS DesÎ!mation bv City Council of An Ad Hoc Audit Review Committee 7:46 p.m. 8.1 (110-30) Administrative Services Director Carole Perry presented the Staff Report and advised that the independent auditors from the firm of Caporicci and Larson will soon complete the Comprehensive Annual Financial Report (CAFR) for the year ending June 30, 2005. City Council action will establish an Ad Hoc Committee to review the report with the Auditors, which included two Councilmembers, to serve for a limited time on the Ad Hoc Committee that will meet with the City Auditors to review and discuss the audit report for the period ending June 30, 2005. Zika absent), the Council appointed Cm. Hildenbrand and Mayor Lockhart to serve for a limited time on the AD HOC Committee that will meet with the City Auditors to review and discuss the audit report for the period ending June 30,2005. . OTHER BUSINESS 7:48 p.m. City Manager Richard Ambrose confirmed the Council's attendance on Friday, November 18, 2005 at 3:00 pm. for a special Council workshop regarding financing of recreational park facilities. Cm. Hildenbrand commended the Dublin school's which spontaneously participated in many fundraising efforts toward the Hurricane Katrina relief efforts. It was great to live in such a generous community. Cm. Hildenbrand advised that, prior to the next Council meeting on November 15th, the Dublin Housing Authority would be holding an extended meeting beginning at 5:00 p.m. to discuss plans for Arroyo Vista, and invited residents to attend. Mayor Lockhart advised that there will be a press conference on the morning of Friday, November 4th at regarding Livermore~Amador Valley Transit Authority's first of a series of " jve~time" bus stop kiosks that will be placed throughout the Valley for riders to get live time of where the buses are and what time they will be at each location. There will be one at the BART Station soon, but the first one will be at the bus stop on Greenville Road in Livermore. This will be a tremendous service for commuters. ..
