Several tactical fcatures that have been used in previous July 4th activities continue to bc deployed this past year to ensure that citizens of Dublin as well as visitors were operating undcr the City sanctioned use of "safe and sane" fireworks in a safe enviromnent at either of the four authorized City parks (Dublin Sports Grounds, Shannon Community Center, Emerald Glen Park, Alamo Creek Park) or at their private residences and to controlling the use of illegal fircworks. However, on July 3, 2005 thcre was a wildland type fire in the area of Stagecoach but it was unclear as to whethcr it was fircworks related. On J uJy 5, 2005 there was call for services for a trash container fire that was related to fireworks. Thcre were complaints and concerns that were voiced to thc Fire Prevention Unit in the City of Dublin during the months of May, June, and the first week of July 2005 as it related to fireworks. Thc complaints and concerns varied and they includcd such itcms like the use of fireworks after 10:00 P.M.; parking being taken up by booths and fireworks containers; businesses in Dublin bcing allowed to have a fireworks booth; non-Dublin residents having a booth; the use of City funds for police, fire and public works enforcing the City Ordinance. A majority of these complaints and concerns were resolvcd through the education of the "Safe and Sane" Fireworks program in the City of Dublin. Citations Issued Thcrc were three citations issued for the violation of the City Ordinance DMC 5.24.020, Posscssion of Illegal Fireworks. The citations issued wcre for illcgal fireworks that did not fall into the category of "safe and sanc" fircworks. There were two felony arrests made involving illegal fireworks, both ofthc suspects were booked at Santa Rita Jail. In one case, the suspcct was in possession of profcssional grade pyrotechnics, which included a profcssional grade aerial display box, which contained 3 feet mortar type dcvises. Due to the large quantity of explosives lhe Alamcda County Fire Marshal had thc Alameda County Sheriff's Office Bomb Squad takc possession of these devises for destruction. The total volume of illegal fireworks seizcd cqualcd about fifty pounds. All the illegal fireworks were seized in neighborhood areas versus the designated City parks. All subjects issued citations or werc arrcsted were adult Dublin Residents. Activity Overview on the }-our (4) Desi!!nated City Parks Dublin Sports Grounds: There were approximately two to three hundred people in attcndance during the peak use (designated as 8:30 to 10:00 p.m.) of the park (the total munbcr was greater due to pcople coming and going as they expended thei.r fireworks). Thc dividing of the parking lot with use of ;)rIb 3 barricades that separated "safe and sanc" íÏrcworks and automobiles madc it a safer venue. There were no rcported injuries or damage to the facilities during the usc of thc park. Shannon Community Center: The authorized area for "safe and sane" fireworks was thc parking lot. There werc approximatcly two to three hundred people in attendancc during the peak use of the park (dcsignated as 8:30 to 10:00 p.m.). There were no report cd injuries or danJage to the facilitics during the usc of the park. Emerald Glen Park: This has become thc busicst of the designated parks. Thcrc were approximately five hundred people in attendancc during the peak use of the park (designatcd as 8:30 to 10:00 p.m.). Thcrc were no reported injuries or danJage to the facilities during thc use of the park. Alamo Creek Park: Thc attendance was less than 50 people at any given time. There were no reported injuries or damage to the facilities during the usc of the park. Rccommendation Staff recommends that the City Council receive this informational report on July 4, 2005 Public Safety Activities. 3<tó Title 5 PUBLIC WELFARE (&bl 5.24.020 Prohibitions. A. The manufacture of fireworks is prohibited within the jurisdiction. B. No person shall possess, sell, deliver, deal in, use, explode or fire, or cause to be used, exploded or fired, any form of fireworks designated as "dangerous fireworks" by Section 12505 of the Health and Safety Code of the state of California. C. The possession, sale, delivery, dealing in, use, exploding or firing of any form of fireworks designated as "safe and sane fireworks" by Section 12529 of the Health and Safety Code of the state of California is expressly permitted, except as limited by this chapter.
