Agreement between the Dublin Housing Authority and the City of Dublin for Analysis of Redevelopment of the Arroyo Vista Project RECOMMENDATION: L ø By Motion, authorize and direct the Mayor to sign the Agreement between the Dublin Housing Authority and the City of Dublin for Analysis of Redevelopment of the Arroyo Vista Project (Attachment I) Sufficient funding has been included in the Fiscal Year 2005-2006 Budget. FINANCIAL STATEMENT: BACKGROUND; The Dublin Housing Authority (the "DHA") manages the Arroyo Vista affordable housing project (the "Arroyo Vista Project"), an affordable housing project with 150 ownership units. Because the Arroyo Vista Project has design problems that created ongoing maintenance problems, especially in terms of sewer and water service, on April 15, 2003, the Dublin Housing Authority Commission (the "Commission") authorized the DHA staffto explore the feasibility of redeveloping the Arroyo Vista Project. In May 2003, the City Council of the City of Dublin (the "City") approved a $30,000 grant from the City to the DHA to analyze the feasibility of the redevelopment of the Arroyo Vista Project, including legal analysis and advice on the demolition and disposition process, preparation of the application, and coordinating the Housing and Urban Development ("HUD") approval process. Approximately $1,200 was used for the financial feasibility study. Approximately $28,000 remains unused. Although the DHA has a September 22, 1986 contract with the Alameda County Housing Authority (the "AHA") for management and administration of the Arroyo Vista Housing Project, the AHA lacks sufficient staff resources to provide all the work necessary to the DHA with this HUD approval process. On December 12, 2004, the Commission asked the City Staff, including the City Attorney, to proceed with certain actions regarding the possible redevelopment of the Arroyo Vista Project. The purpose of the proposed Agreement between the DHA and the City is to formalize the Commission's request that City Staff help with possible redevelopment of the Arroyo Vista Project. ANALYSIS: The Agreement will allow the City to devote both staff and attorney resources to the DHA for possible redevelopment of the Arroyo Vista Project. The City is legally allowed to provide both staff and legal services to the DHA. Health and Safety Code Section 34278(a) allows the DHA to employ agents as necessary, and Health and Safety Codc Section 34279 allows the City Attorney to work for the DHA at the DHA's request. RECOMMENDA nON: Staff recommends that the City Council by motion, authorize and direct the Mayor to sign the Agreement betwcen the Dublin Housing Authority and the City of Dublin for Analysis of Redevelopment of the Arroyo Vista Project (Attachment 1). 2 i5b 2-- IOCJ&' AGREEMENT BETWEEN THE DUBLIN HOUSING AUTHORITY AND THE CITY OF DUBLIN FOR ASSISTANCE WITH POSSIBLEOF REDEVELOPMENT OF THE ARROYO VISTA PROJECT This Agreement is madc and entered into as of the _ day of , 2005 by and between the DUBLIN HOUSING AUTHORITY, a public body corporate and politic (hereinafter referred to as the "DHA"); and THE CITY OF DUBLIN, a municipal corporation (hereinafter referred to as the "City"). RECITALS: WHEREAS, the DHA manages the Arroyo Vista housing project (the "Arroyo Vista Project"), an affordable housing project with 150 ownership units; and WHEREAS, the Arroyo Vista Project has design problems that created ongoing maintenance problems, including sewer and water main problems; and WHEREAS, Dublin City Council wishes to assist the DHA in exploring the feasibility of thc redevelopment of the Arroyo Vista Project by selling the property, demolishing the existing buildings, and building in their place more than 150 affordable housing units plus certain additional market-rate housing units, thereby not only addressing the maintenance issues but also crcating additional affordable homeownership opportunities; and WHEREAS, the DHA needs approval from the Department of Housing and Urban Development ("HUD'') before redeveloping the Arroyo Vista Project; and WHEREAS, pursuant to contract dated September 22, 1986, the Alameda Housing Authority manages and administers the Arroyo Vista Project for the DHA, but lacks sufficient staff resources to help the DHA with this HUD redevelopment approval process; and WHEREAS, the DHA has seven commissioners but no employees; and WHEREAS, the City has an interest in the increased number of affordable housing units made available by the potential redevelopment of the Arroyo Vista Project, as well as an interest in creating such affordable housing in better conditions with less maintenance required by the City; and WHEREAS, the City is able to provide both staff and attorney services to assist the DHA in obtaining HUD Approval to redevelop the Arroyo Vista Project; and 768656-) 6/24/2005 -7 - 5 - 05 ·-1....<1 f~TTACrH~~~r¡: 1 ?~ WHEREAS, Health and Safety Code Section 34278(a) allows thc DHA to employ agents as it requires, and Health and Safety Code Section 34279 allows the City Attorney to work for thc DHA at DHA's request. If the DHA detennines there is interest in the redcvclopment of the Arroyo Vista property, the DHA will use good faith efforts to obtain HUD approval of the demolition and disposition process and will ensure the redeveJopment ofthe Arroyo Vista Project includes more affordable units than are presently on the property.
