The Maintenance Bond will guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance costs for the City storm drain improvements. DESCRIPTION: Pfeiffer Ranch Investors II, Inc. (dba Pinn Brothers Fine Homes, Inc.), recently completed the installation of storm drain improvements and necessary road reconstruction on Tassajara Road for Tract 7441, Phase I - Silvera Ranch. The project limits extended fÌom the northern boundary of Dublin Ranch, Phase 1, to the intersection with Silvera Ranch Drive. Tract 7441 is located in eastern Dublin on the cast side of Tassajara Road, immediately north of the Nielsen property. An Improvement Agreement off-site improvements was executed on May 4, 2004, via City Council Resolution No. 72-04, and included storm drain, sanitary sewer and water infiastruClure. The storm drain improvements have now been completed pursuant to the Improvement Agreement and to the satisfaction of the Director of Public Works, and are now ready to be accepted for permanent maintenance. The sanitary sewer and water infrastructure arc within Dublin San Ramon Services District's jurisdiction, and have been accepted by that agency. At the time the City and Pfeiffer Ranch Investors executed the Improvement Agreement, the developer provided a Performance Bond and a Labor and Materials Bond, each in the amount of $293,173, to guarantee performance of the work. Rd.doc (ý these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in an amount necessary to guarantee the work for a one- year period following acceptance. The developer has provided a Maintenance Bond in the amount of $73,294, which is 25% of the original Performance Bonds, and which is sufficient to guarantee the storm drain improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting off-site improvements to Tassajara Road for Tract 7441, Phase I - Silvera Ranch (Pfeiffer Ranch Investors 11, Inc.). RESOLUTION NO. - 05 A RESOLUTJON OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF OFF-SITE IMPROVEMENTS TO TASSAJARA ROAD FOR TRACT 7441, PHASE 1 - SILVERIA RANCH (PFEIFFER RANCH INVESTORS II, INC.) WHEREAS, the subdivider of Tract 7441, filed on March 11,2005, in Book 279 of Maps at Pages 68 - 82, previously entered into an Improvement Agreement with the City of Dublin to construct certain off·site improvements on Tassajara Road in accordance with plans and specifications on file with the Public Works Director, said Tract identified as follows: a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Agrcemcnt: e) City Street Affected: Pfeiffer Ranch Investors II, Inc. East of Tassajara Road, and north of Neilson property 254 Single and Multi-Family Lots No. 72-04, City of Dublin City Council Tassajara Road WHEREAS, the Silvera, Haight, and Nielsen properties, together with the abutting segment of Tassajara Road (formerly County Road 2568), were annexed to the City of Dublin and to the Dublin San Ramon Services District via Local Agency Formation Commission (LAFCO) Resolution No. 2003-01·A on January 9,2003 (recorded on May 5, 2003, in Book 264 of Maps at Page 34); and WHEREAS, the off-site improvements within the anncxed segment of Tassajara Road extending from the northern boundary of Dublin Ranch, Phase 1, to the intersection with Silvera Ranch Drive of Tract 7441, as governed by the Improvement Agreement, are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the Public Works Director; and WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the off-site improvements can be released, in accordancc with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: I. The storm drain improvements completed within Tassajara Road are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond in the amount of$293,173 (Bond No. 868816S) issued by Developers Surety and Indemnity Company be rcleascd; and 3.
