DESCRIPTION: This assessment district maintains roadside and median landscaping associated with the Villages at Willow Creek development off Dougherty Road. As part of the review and approval of the 145-unÎt single family development (Ridgeereek) and the other multifamily Villages, certain landscaping maintenance was made a condition of approval. In lieu of forming a homeowners' association to perform landscape maintenance, the developer requested formation of this assessment district. Activities include litter pickup, maintenance of sound walls, and landscaping along Dougherty Road between Amador Valley Boulevard and Fall Creek Road; along Amador Valley Boulevard between Dougherty Road and Wildwood Road; and along Wildwood Road, Fall Creek Road, Shady Creek Drive and Willow Creek Drive. The City Council approved formation of this District on November 10, 1986, with the initial assessment in the 1987-88 tax year. This resolution authorizes the Public Works Directorl Assistant City Engineer to begin preparation of the required Engineer's Report for the Assessment District for FY 2005-2006. The procedure for establishing mmua] maintenance assessments requires that the City Council first authorize preparation of the report. The preliminary report is then brought back to the City Council for approval later in the year. Following the City Council's approval of the preliminary report, public hearings wi11 be scheduled as required. Staff recommends that the City Council adopt the resolution directing Staff to prepare the Engineer's Annual Report for Landscaping and Lighting Maintenance Assessment District 86-1. _w__.~_w______________________w___~~___________________w_~____ COPIES TO: g;\asses.sdisl\86~ 1 \staffreptinit \~I ITEMNO.~ IttJ~ RESOLUTION NO. -05 A RESOLUTION OF mE CITY COUNCIL OF THE CITY OF DUBLIN *******"'* DIRECfING PREPARATION OF ANNUAL RJt,PORT FOR CITY OF DUBLIN LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 86-1 (VILLAGES AT WILLOW CREEK) WHEREAS, on August 2, 1986, by its Resolution No_ 38-86, this City Council ordered the formation of and levied the first assessment within the City of Dublin Landscaping and Lighting Maintenance Assessment District 86-1 (Villages at Willow Creek) ("the District") pursuant to the provisions of the Landscaping and Lighting Act of 1972 (conunencing at Section 22500 of the California Streets and Highways Code) (hereinafter, "the Act"); and WHEREAS, Sections 22620 et seq of the Act provide for the levy of annual assessments after formation of the District; and WHEREAS, within said District, the existing and proposed improvements and any substantial changes proposed to be made to the existing improvements are generally described on Exhibit A attached hereto and hereby made a part hereof; NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby designate the Dublin Public Works Director/Assistant City Engineer as Engineer for purposes of preparing and filing with the Clerk a written report in accordance with Section 22565 et seq of the Act; said Engineer is hereby directed to apportion said assessments in accordance to the benefits received ftom said improvements by the lots, pieces and parcels of land within the District, and said Engineer is hereby directed to accomplish such preparation and filing forthwith.
