HomeMy WebLinkAbout4.13 WaterfordShopsMP7589 CITY CLERK File # D~[Q][Q]-~[C2J AGENDA STATEMENT CITY COUNCIL MEETING DATE: September 7,2004 SUBJECT: Acceptance of Improvements Associated with Parcel Map 7589, Waterford Place/[he Shops at Waterford, by Shea Homes Limited Partnership Report Prepared by: Melissa Morton, Public Works Director ATTACHMENTS: 1) 2) Resolution Location Map RECOMMENDATION: cI Adopt the Resolution accepting the improvements for Parcel Map /qJ'f 7589, Waterford Place/[he Shops at Waterford, and approving the regulatory traffic control device FINANCIAL STATEMENT: Shea Homes Limited Partnership has provided Maintenance Bonds in the amounts of $192,975 for off-site improvements and $82,500 for traffic signals, for a total of $275,475, to replace the Performance and Labor and Materials Bonds that guaranteed the improvements. Said Maintenance Bonds will guarantee against defects for one year. Once the improvements have been accepted, the City will incur maintenance and street sweeping costs for the widened segment of Tassajara Road along the project frontage and for the traffic signals installed at the following intersections: Glynnis Rose Drive at Central Parkway, Central Parkway at Tassajara Road, and Tassajara Road at The Shops driveway. Street light costs will be funded by Street Light Maintenance Assessment District No. 99-1. The Santa Rita Area Landscape Maintenance Assessment District 97-1 will fund the maintenance of frontage landscaping on Central Parkway, Dublin Boulevard, and Tassajara Road. DESCRIPTION: Shea Homes Limited Partnership recently completed the public improvements associated with Parcel Map 7589, Waterford Place/[he Shops at Waterford, a retail shopping center and apartment complex located at the northwest comer of Tassajara Road and Dublin Boulevard. The work was governed by an Improvement Agreement executed on December 4, 2001, pursuant to City Council Resolution No. 203-01, as amended by City Council Resolution No. 224-02 on - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - G:\DEVELOP\Waterford Place\Agstacpt PM 7589.doc COPIES TO: Robert M. The Conditions of Approval for Parcel Map 7589 required the developer to widen Tassajara Road along the project frontage and to install traffic signals at the following intersections: · Central Parkway at Glynnis Rose Drive · Central Parkway at Tassajara Road · Tassajara Road at The Shops driveway The developer was also required to landscape the parkstrip area between the curb and sidewalk along the property frontages on Dublin Boulevard, Tassajara Road, and Central Parkway. This landscaping is within the Santa Rita Landscape Maintenance Assessment District 97-1. Since the street widening, traffic signals, and landscaping have been constructed pursuant to the Improvement Agreement and to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. The following regulatory traffic control device will also be accepted and approved as part of this project and added to the City of Dublin Traffic Code: "No Parking Anytime" restriction has been installed on the west side of Tassajara Road between Central Parkway and Dublin Boulevard (Traffic Code Chapter 6.04.250). At the time the City and Shea executed the Improvement Agreement, the developer provided Performance Bonds and Labor and Materials Bonds totaling $2,994,000 ($771,900 for off-site, $330,000 for traffic signals, and $1,892,100 for private on-site improvements) to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with Maintenance Bonds in amounts necessary to guarantee the work for a one-year period following acceptance. The developer has provided Maintenance Bonds in amounts totaling $275,475 ($192,975 for off-site, and $82,500 for traffic signals). The Public Works Director has waived the Maintenance Bond requirement for the private on-site improvements because no City maintenance is required on private property. The submitted Maintenance Bonds are sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements for Parcel Map 7589, Waterford Place/[he Shops at Waterford, and approving the regulatory traffic control device. Page 2 lfb 2- lafP RESOLUTION NO. ~ 04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTANCE OF IMPROVEMENTS FOR PARCEL MAP 7589, (WATERFORD PLACEtrHE SHOPS AT WATERFORD BY SHEA HOMES LIMITED PARTNERSHIP) AND APPROVAL OF REGULA TORY TRAFFIC DEVICE WHEREAS, the subdivider of Parcel Map 7589, filed on December 26,2001, in Book 262 of Parcel Maps at Pages 42-47, previously entered into an Improvement Agreement with the City of Dublin on December 4,2001, to improve designated public improvements in accordance with plans and specifications on file with the Public Works Director, said Parcel Map identified as follows: a) Subdivider: Shea Homes Limited Partnership, A California Limited Partnership East of Glynnis Rose Drive, north of Dublin Boulevard, south of Central Parkway, west of Tassajara Road 18.7 acres; 3 parcels No. 203-01, City Council of Dublin Central Parkway, Dublin Boulevard, and Tassajara Road b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: WHEREAS, an amendment to the Improvement Agreement was previously approved by City Council Resolution No. 224-02 on December 3,2002, that extended the term until December 4,2003; and WHEREAS, the improvements associated with Parcel Map 7589 as governed by the Improvement Agreement are complete in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the Public Works Director; and WHEREAS, the developer has installed a certain traffic regulatory device as a part of the Parcel Map improvements; and WHEREAS, the original Performance Bonds and Labor and Materials Bonds that guaranteed the improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with Maintenance Bonds to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: 1. The improvements completed within said Parcel Map are hereby approved and accepted subject to a one-year guarantee period; and 2. The original Performance Bond issued by American Home Assurance Company in the amount of $330,000 (Bond No. 00-283-320) for traffic signals be released; and 6. The original Labor and Materials Bond issued by American Home Assurance Company in the amount of $1,892,100 (Bond No. 00255009) for designated on-site improvements be released; and 7. The original Labor and Materials Bond issued by American Home Assurance Company in the amount of $771,900 (Bond No. 00255032) for designated off-site improvements be released; and 8. The original Labor and Materials Bond issued by American Home Assurance Company in the amount of $330,000 (Bond No. 00-283-320) for traffic signals be released; and 9. The submitted Maintenance Bond issued by American Home Assurance Company in the amount of $192,975 (Bond No. 00-255-032-A) for off-site improvements be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 7th day of September, 2005; and 10. The submitted Maintenance Bond issued by American Home Assurance Company in the amount of $82,500 (Bond No. 00-283-320-A) for traffic signals be accepted as security for the aforesaid one-year maintenance period, said period to commence on this date and terminate on the 7th day of September, 2005; and PASSED, APPROVED AND ADOPTED this 7th day of September, 2004.
