HomeMy WebLinkAboutOrd 12-95 Bldg,Plumb CodeORDINANCE NO. 12- 95 AN ORDINANCE OF THE CITY OF DUBLIN AMENDING CHAPTERS 7.28, 7.32, 7.40, 7.44, and 7.48 OF THE DUBLIN MUNICIPAL CODE AND ADOPTING BY REFERENCE THE 1994 UNIFORM BUILDING CODE, UNIFORM PLUMBING CODE, UNIFORM MECHANICAL CODE, UNIFORM HOUSING CODE AND THE 1993 NATIONAL ELECTRICAL CODE AND DECLARING THIS ORDINANCE TO BE AN URGENCY ORDINANCE TO TAKE EFFECT JANUARY 1, 1996 The City Council of the City of Dublin does ordain as follows: SECTION 1 Section 7.28.120 of the Dublin Municipal Code is amended to read: Section 7.28.120 Existing Buildings, Structures, or Installations. A. Except as required by Section 310.9.1 of the Building Code, and Sections 7.32.280 and 7.40.130, buildings or structures, electrical, plumbing or mechanical installations in existence at the time of the adoption of this chapter may have their existing use or occupancy continued if such use or occupancy was legal at the time of adoption of the ordinance codified in this chapter and provided such continued use is not dangerous or substandard and does not menace health, life or property. B. Electrical, plumbing and mechanical systems installed in apartments, hotels and dwelling and in existence prior to January 1, 1975, shall be deemed to have conformed to applicable law in effect at the time of installation and to have been maintained in good condition of currently in good and safe condition and working properly. SECTION 2 Section 7. 28.170 of the Dublin Municipal Code is amended to read: Section 7.28.170 Appeals. A. Any person aggrieved with any decision of the Building Official in connection with the application or interpretation of the provislons of this chapter or in the approval of alternate materials or methods of construction may appeal to the City Council. Such appeal shall be in writing and filed within ten (10) days. B. The City Council may after hearing, interpret any provision of this chapter. C. The City Council may after hearing vary the application of this chapter in any specific case when in its opinion the enforcement thereof would be contrary to the spirit and purpose of this chapter or public interest. The City Council in granting a variance may impose requirements or conditions to mitigate any adverse effects that may result from granting a variance. D. In making any such interpretation or granting any variance the City Council shall make the following findings: 1. That the interpretation or variance is consistent with the purpose of this chapter; 2. That the interpretation or variance will not lessen the protection to the people of the city and the property situated therein. E. The City Council may approve alternate materials or methods of construction as set forth in Section 7.28.140 by overruling the decision of the Building Official. In approval any alternate materials or methods of construction the City Council shall make findings that the material, method or work proposed is for the purpose intended, at least the equivalent of that prescribed by this chapter in quality, strength, effectiveness, fire resistance, durability, dimensional stability and safety. F. The City Council may appoint a Board of Appeals to hear any specific appeal. The Board of Appeals shall consist of five (5) members qualified by training and experience to pass on matters pertaining to the subject matter of the appeal and to serve until the disposition of the appeal. The Board of Appeals shall have the same authority and duties as the City Council in interpreting this chapter, granting variances, or approving alternate materials or methods of construction. The Building Official shall be an ex officio member of the Board of Appeals and shall act as secretary to the board. The board of appeals shall adopt reasonable rules and regulations for conducting its hearings and investigations. The decision of the Board of Appeals shall be final. SECTION 3 Section 7. 28. 290, of the Dublin Municipal Code is amended to read: Section 7.28.290 Exceptions. A. No permit shall be required for the following; however, permits shall be required for electrical, plumbing and mechanical installations in any building or structure listed in subsections Al through A18 of this section, and permits shah be required for all new construction and substantial improvements that are located within an area of special flood hazard in which case a permit shall be required as set forth in Chapter 7.24: 1. Open wire fences not. more than sixteen (16) feet in height,; masonry fences not more than six (6) in height, and all othertype fences not more than eight (8). feet,in height; 2. Retaining walls which do not retain more than three (3) feet of earth when the earth retained is level or where there is no surcharge load, and retaining walls which do not retain more than two (2) feet of earth when the earth retained is sloping or which supports surcharge loads. See Section 2317.11 of the Uniform Building Code for requirements for treatment of wood used for retaining walls; 3. One-story detached accessory buildings used as tool and storage sheds, playhouses and similar uses, provided the projected roof area does not exceed one hundred twenty (120) square feet; 4. One-story buildings not .more than four hundred (400) square feet in area used exclusively for housing animals, poultry, livestock and similar animals and the storage of necessary food, hay or grain for the animals housed therein; 5. Agricultural buildings as defined in Section 202 of the Uniform Building Code on lots exceeding twenty (20) acres in area which are located in an A zoning district and where the principal use of the land is agriculture; 6. Lath houses and similar sun shade structure with roofs which do not shed water, which are not more than ten (10) feet in height and one thousand (1,000) square feet in area; 7. Awnings over doors and windows of a Group R-3 or Group U-1 Occupancy which are entirely supported by the building and do not project more than fifty-four (54) inches; 8. Temporary construction offices, and storage sheds which are used on a site where there is a valid building permit, grading permit, or which are used in connection with a construction project where no building permit or grading permit is required; however, this provision shall not apply to such building remaining on the site 30 days after the completion of construction; 9. Temporary construction offices and storage sheds when stored in a contractor's equipment yard; however, this provisions shall not apply if such buildings are used for any purpose whatsoever; 10. Raised decks which are less than thirty (30) inches above the ground at any point; 11. Treehouses or other structures which are designed to be used by children for play; 12. Flag poles, radio or TV antennas and towers, less than thirty-five (35) feet in height when not attached to a building and less than twenty (20) feet in height when attached to a bUilding, except permits are required for dish type antennas more than four (4) feet in diameter; 13. Swimming, bathing, and wading pools, and fishponds not exceeding twenty-four (24) inches in depth; 14. Prefabricated swimming pools, spas, or hot tubs not exceeding four (4) feet in depth if resting on the surface of the ground or a concrete slab on the ground; 15. Painting, papering and similar finish work; 16. Moveable cases, counters, and partitions not over five (5) feet nine (9) inches high; 17. Water tanks supported directly upon grade if the capacity does not exceed five thousand (5,000) gallons and the ratio of height to diameter or width does not exceed two to one; 18. Water storage tanks' of any size if resting on the surface of the ground or on a concrete slab on the ground when used only for watering livestock or irrigation;' 19. The replacement of lamps or the connection of portable electrical appliances to suitable receptacles which have been permanently installed; 20. Nonelectrical, signs less than eight (8) feet in height, nonelectrical signs which 'do not exceed three (3) pounds per square foot nor four (4) inches in thickness when fastened flat against the wall of any building and provided further that the sign does not extend above the top of the wall of the building. 21. Clearing stoppages or repairing leaks in pipes, valves, fittings or fixtures when such repairs do not involve the replacement or rearrangement of pipes, valves, fittings or fixtures; 22. Buildings and structures owned by a sanitary district used exclusively for storage, collection, conveying and treating sewage; 23. A permit shall not be required for demolition or exploration work that may. be necessary in order to determine conditions in connection with a proposed addition or alteration to an existing building if an application for a permit is on file and prior approval for the demolition or exploration work is obtained from the Building Official; 24. A permit shall not be required for small or unimportant work when approved by the Building Official; B. Exemption from the requirement of a permit shall not be deemed to be permissible to violate any provision of this chapter or any other law, ordinance, rule or regulation. C. Although permits are not required by this section, any person may obtain inspection services by applying for a permit for such work and paying the applicable fee. SECTION 4 SeCtion 7. 28. 410 of the Dublin Municipal Code is amended to read: Section 7.28.410 Building Official - Authority to Deny Permit. The Building Official may refuse to issue any permit where it cannot be demonstrated that: A. The hazards of land slippage, erosion or settlement will be eliminated; 2. The proposed work will not be located on a trace of an active fault; 3. The proposed work will conform to Chapters 7.20 and 7.24; 4. The placement of existing fills has not been subject to continuous inspection by a special inspector as required by Section 1701.5.13 of the Uniform Building Code; The private water supply will conform to Section 601.0 of the Uniform Plumbing . Code. 6. . The private sewage disposal system required by Section 713.0 of the Plumbing Code will conform to Section 7.40.140; Whenever a licensed contractor has failed to make corrections as specified in Section 7.28.540 through 7.28.580. SECTION 5 Section 7. 28. 590 of the Dublin Municipal Code is amended to read: Section 7.28.590 Special Inspections. A. In addition to the inspections required by sections 7.28.540 through 7.28.580, Special Inspections shall be provided in accordance with Chapter 17 of the Uniform Building Code. SECTION 6 Section 7.32. 030 of the Dublin Municipal Code is amended to read: Section 7.32.030 Adoption. Certain documents, a copy of which is on file in the office of the City Clerk, being marked as "Uniform Building Code," 1994 Edition, Volumes 1,2 and 3 including Appendix Chapters 3 Division II, 4 Division I, 12 Division II, 15, 18, 31 Division III and 33 published by the International Conference of Building Officials is hereby adopted by reference as the building code of the city pursuant to the provision of Section 50022.1 et seq. of the Government Code of the state of California except as hereinafter modified in Section 7.32.110 through 7.32.420 this chapter. SECTION 7 Section 7.32.110 of the Dublin Municipal Code is amended to read: Section 7.32.110 Chapter 1, Administration - Deleted. SECTION 8 Section 7.32.120 of the Dublin Municipal Code is amended to read Section 7.32.120 Section 3405, Chapter 34, Change in Use. Section 3405 is amended by deleting the third paragraph. SECTION 9 Section 7.32.130 of the Dublin Municipal Code is amended to read: Section 7.32.130 Section 504.6, Chapter 5, Area Separation Walls. Section 504.6 is amended by adding a new item 504.6.7 to read: 504.6.7 Area separation walls shall not be considered to create separate buildings for the purpose of automatic fire-sprinkler system requirements as set forth in Chapter 9. Exception: Buildings separated by continuous area separation walls of four-hour fire-resistive construction without openings. Buildings required to have automatic fire-sprinkler protection as set forth in Section 13113 of the Health and Safety Code are prohibited from using area separation walls in lieu of automatic fire-sprinkler protection. SECTION 10 Section 7.32.140 of the Dublin Municipal Code is amended to read: Section 7.32.140 Section 505.4, Chapter 5, Yard Restriction. A new subsection 505.4 is added to section 505.4 Yard Restriction. The increase in area permitted by Subsections 505.1 and 505.2 of this Section shall not be allowed unless or until the owner of the required yard shall file an agreement binding such owner, his heirs, and assignees, to set aside the required yard as unobstructed space having no improvements. Such agreement shall be recorded in the Alameda County Recorder's Office. SECTION 11 Section 7.32.150 of the Dublin Municipal Code is'deleted SECTION 12 Section 7.32.155 of the Dublin Municipal Code is deleted SECTION 13 Section 7.32.160 of the Dublin Municipal Code is amended to read: Section 7.32.160 Section 1617, Chapter 16, Part VI, Wind Design - Amended Section 1617 is amended to read: 5 Section 1617 Exposure. All portions of the City of Dublin have a basic wind speed of 70 miles per hour. Ail portions shall be exposure "B" except that all portions of the City of Dublin east of the easterly city boundary as it existed on December 23, 1986 and all portions of the City of Dublin west of the westerly city boundary as it existed on April 21, 1991 shall be exposure "C". SECTION 14 Section 7.3Z170 of the Dublin Municipal Code is amended to read: Section 7.32.170 Table 16-A, Chapter 16, Part VI, Uniform and Concentrated Loads Table 16-A is amended by adding a new footnote 10 to read: 10. Bridges for vehicular traffic shall be designed for H20 loading as designated by the American Association of State Highway Officials. SECTION 15 Section 7.32.180 of the Dublin Municipal Code is deleted. SECTION 16 SeCtion Z32.190 of the Dublin Municipal Code is deleted. SECTION 17 Section 7.32.200 of the Dublin Municipal Code is deleted. SECTION 18 Section 7.32.210 of the Dublin Municipal Code is deleted. SECTION 19 Section 7.32.220 of the Dublin Municipal Code is deleted. SECTION 20 Section 7.32.230 of the Dublin Municipal Code is amended to read: Section 7.32.230 Section 1503.1, Chapter 15, Special Requirements. Section 1503.1 is amended to read: 1503.1 Special Requirements. 1. Map of Fire Safe Roof Areas. Figure 15-1' is a map of Fire Safe Roof areas. Said map may be amended from time to time by including areas which are annexed to the City within one of the two roofing areas. Said amendments may be made by the Building Official a~er consultation, with the Chief of the Dougherty Regional Fire Authority. 2. Roofing Area 1. Any new roof and any alteration, repair or replacement for buildings housing R & U- 1 occupancies in Roofing Area 1 shall use roof covering material that conforms to Class B or better when tested in accordance with UBC Standard 15-2, or shall be made of concrete, ferrous or copper metal, clay, slate or similar non-combustible material. 3. Roofing Area 2. Any new roof for buildings using roof covering material that conforms to Class C or better when tested in accordance with UBC Standard 15-2, or shall he made of concrete, ferrous or copper metal, clay, slate or similar non-combustible material. 4. Other Occupancies. Any new roof covering and any alterations, repairs or replacement of roof covering material for buildings housing all other occupancies shall conform to the requirements as set forth in Roofing Area 1. SECTION 21 Section 7.32.250 of the Dublin Municipal Code is deleted SECTION 22 Section 7.32.260 of the Dublin Municipal Code is amended to read: Section 7.32.260 Section 904.2, Chapter 9, Part VI, Automatic fire-extinguishing systems. Section 904.2. is amended to read: 904.2. Automatic Fire-Extinguishing Systems. 904.2.1 Where Required. An automatic fire-extinguishing system shall be installed in the occupancies and locations as set forth in this section. For provisions on special hazardous materials see the Fire Code. 904.2.2 All Occupancies Except Group R, Division 3 and Group U Occupancies. Except for Group R, Division 3 and Group U Occupancies, an automatic sprinkler system shall be installed: 1. In every story or basement of all buildings when the floor area exceeds 1,500 square feet (139.4m2) and there is not provided at least 20 square feet (1.86m2) of opening entirely above the adjoining ground level in each 50 lineal (15 240m) or fraction thereof of exterior wall in the story or basement on at least one side of the building. Openings shall have a minimum dimension of not less than 30 inches (762mm). Such openings shall be accessible to the fire department from the exterior and shall not be obstructed in a manner that firefighting or rescue cannot be accomplished from the exterior. When openings in a story are provided on only one side and the opposite wall of such story is more than 75 feet (22 860mm) from such openings, the story shall be provided with an approved automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an exterior wall of the story. If any portion of a basement is located more than 75 feet (22 860mm) from openings required in this section, the basement shall be provided with an approved automatic sprinkler system. 2. At the top of rubbish and linen chutes and in their terminal rooms. Chutes extending through three or more floors shall have additional sprinkler heads installed within such chutes at alternate floors. Sprinkler heads shall be accessible for servicing. 3. In rooms where nitrate film is stored or handled. 4. In protected combustible fiber storage vaults as defined in the Fire Code. 5. Throughout all buildings with a floor level with an occupant load of 30 or more that is located 55 feet (16 764mm) or more above the lowest level of fire department vehicle access. EXCEPTION: 1. Airport control towers. 2. Open parking structures. 3. Group F, Division 2 Occupancies. 904.2.3 Group A Occupancies. An automatic fire extinguishing system shall be installed in all Group A Occupancies (except of Type V construction) where the floor area exceeds 5,000 square feet and in all basements classified Group A Occupancy when the basement floor area exceeds 1,500 square feet. Group A occupancies that are of Type V construction where the floo{ area exceeds 3,000 square feet. 904.2.3.1 Drinking establishments. An automatic sprinkler system shall be installed in rooms used by the occupants for the consumption of alcoholic beverages and unseparated accessory uses where the total area of such unseparated rooms and assembly uses exceeds 5,000 square feet (465 m2) (except of Type V construction). For uses to be considered as separated, the separation shall not be less than as required for a one-hour occupancy separation. The area of other uses shall be included unless separated by at least a one-hour occupancy separation. Drinking2establishments that are of Type V construction where the floor area exceeds 3,000 square feet (279 m ) 904.2.3.2 Basements. An automatic sprinkler system shall be installed in basements classified as a Group A Occupancy when the basement is larger than 1,500 square feet (139 m2) in floor area. 904.2.3.3 Exhibition and display rooms. An automatic sp2r, inkler system shall be installed in Group A Occupancies which have more than 12,000 square feet (112 m ) of floor area which can be used for exhibition or display purposes. 904.2.3.4 Stairs. An automatic sprinkler system shall be installed in enclosed usable space below or over a stairway in Group A, Divisions 2, 2.1, 3 and 4 Occupancies. See Section 1009.6. 904.2.3.5 Multitheater complexes. An automatic sprinkler system shall be installed in every building containing a multitheater complex. 904.2.3.6 Amusement buildings. An automatic sprinkler system shall be installed in all amusement buildings. The main water-flow switch shall be electrically supervised. The sprinkler main cutoff valve shall be supervised. When the amusement building is temporary, the sprinkler water-supply system may be of an approved temporary type. EXCEPTION: An automatic sprinkler system need not be provided when the floor area temporary amusement building is less than 1,000 square feet (92.9 m2) and the exit travel distance from any point is less than 50 feet (15 240 nun). of a 904.2.3.7 Stages. All stages shall be sprinklered. Such sprinklers shall be provided throughout the stage and in dressing rooms, workshops, storerooms and other accessory spaces contiguous to such stages. EXCEPTIONS: 1. Sprinklers are not required for stages 1,000 square feet (92.9 m2) or less in area and 50 feet (1542 mm) or less in height where curtains, scenery or other combustible hangings are not retractable vertically. Combustible hangings shall be limited to a single main curtain, borders, legs and a single backdrop. 2. Under stage areas less than 4 feet (1219 mm) in clear height used exclusively for chair or table storage and lined on the inside with 5/8-inch (16mm) Type X gypsum wallboard or an approved equal. 904.2.3.8 Group B Occupancies. An automatic fire-extinguishing system shall be installed in C~oup B occupancies (except Type V construction) where the floor area exceeds 5,000 square feet (465 mL). An automatic sprinkler system shall be installed in Group B, of Type V construction where the floor area exceeds 3,000 square feet (279 m2). 904.2.4.1 Group E Occupancies. An automatic fire-extinguishing shall be installed in all Group E occupancies (except Type V construction) where the floor area exceeds 5,000 square feet.. An automatic sprinkler system shall be installed in all Group E Occupancies of Type V construction where the floor area exceeds 3,000 square feet. 904.2.4 Group E Occupancies. 904.2.4.1 General. An automatic fire sprinkle system shall be installed throughout all buildings containing a Group E, Division 1 Occupancy. EXCEPTION: 1. When each room used for instruction has at least one exit door directly to the exterior at ground level and when rooms used for assembly purposes have at least one half of the required exits directly to the exterior ground level, a sprinkler system need not be provided. 2. When area separation walls, or occupancy separations having a fire-resistive rating of not less than two hours subdivide the building into separate compartments such that each compartment contains an aggregate floor area not greater than 20,000 square feet (1858 m2), an automatic sprinkler system need not be provided. An automatic fire-extinguishing system shall be in Group E, Division 2 and 3 occupancies (except Type V construction) where the floor area exceeds 5,000 square feet (465 m2). An automatic sprinkler system shall be installed in Group E, Division 2 and 3 of Type V construction where the floor area exceeds 3,000 square feet (279 m2). 904.2.4.2 Basements. An automatic sprinkler system shall be installed in basements classified as Group E, Division 1 Occupancies. 904.2.4.3 Stairs. An automatic fire sprinkler system shall be installed in enclosed'usable space below or over a stairway in Group E, Division 1 Occupancies. See Section 1009.6. 904.2.4.4 Group F Occupancies. An automatic fire sprinkler system shall be installed in all Group F occupancies (except Type V construction) where the floor area exceeds 5,000 square feet (465 m2) an automatic sprinkler system shall be installed in all Group F occupancies of Type V construction where the floor area exceeds 3,000 square feet (279 m2). 904.2.5 Group H Occupancies. 904.2.5.1 General. An automatic fire-extinguishing system shall be installed in Group H, Divisions 1, 2, 3 and 7 Occupancies. 904.2.5.2 Group H, Division 4 Occupancies. An automatic fire-extinguishing system shall be installed in Group H, Division 4 Occupancies having a floor area of more than 3,000 square feet (279 904.2.5.3 Group H, Division 6 Occupancies. An automatic fire-extinguishing system shall be installed throughout buildings containing Group H, Division 6 occupancies. The design of the sprinkler system shall be not less than the required under U.B.C. Standard No. 9-1 for the occupancy hazard classifications as follows: Location Occupancy Hazard Classification Fabrication areas Service corridors Storage rooms without dispensing Storage rooms with dispensing Exit corridors Ordinary Hazard Group 2 Ordinary Hazard Group 2 Ordinary Hazard Group 2 Extra Hazard Group 2 Ordinary Hazard Group 2~ Note: 1 When the design area of the sprinkler system consists of a corridor protected by one row of sprinklers, the maximum number of sprinklers that need to calculated is 13. 904.2.6 Group I Occupancies. An automatic sprinkler system shall be installed in Group I Occupancies. EXCEPTION: In jails, prisons, and reformatories, the piping system may be dR, provided a manually operated valve is installed in a continuously monitored location. Opemng of the valve will cause the piping system to be charged. Sprinkler heads in such systems shall be equipped with fusible elements or the system shall be designed as required for deluge systems in U.BC. Standard No. 9-1. 904.2.7 Group M, and S Occupancies. An automatic sprinkler system shall be installed in Group M and S occupancies where the floor area exceeds 5,000 square feet (except Type V construction). An automatic fire sprinkler system shall be installed in all retail sales rooms classed A Group M and S occupancies of Type V construction where the floor area exceeds 3,000 square feet. 904.2.8 Group R, Division I Occupancies. An automatic sprinkler system shall be installed throughout every apartment house three or more stories in height or containing 16 or more dwelling units in congregate residences three or more stories in height and having an occupant load of 50 or more and in hotels three or more stories in height or containing 20 or more guest rooms. Residential or quick response standard sprinkler heads shall be used in the dwelling unit and guest room portions of the building. 904.2.8.1 Group R, Division 1 and 3 Occupancies. An automatic fire-extinguishing system shall be installed where the total area exceeds 5,000 square feet (465m2). SECTION 23 Section 7.32.260 of the Dublin Municipal Code is amended to read: 904.2.9 All Group A, B, E, H, I, & R-1 & R-3 Occupancies. Automatic fire-exting~aishing systems shall be installed in all Groups A, B, E, H,. I, & R- 1 & R-3 occupancies located more than 1 lA miles from a fire station providing fire protection to that location. Said distance shall be measured in a straight line. For R-3 occupancies the sprinkler system may be a residential sprinkler system, type_NFPA 13. Buildings containing portions which are required to have an automatic fire extinguishing system because of the number of stories shall have the automatic fire extinguishing system installed throughout and area separation as set forth in Section 504.6 shall not be considered as creating separate buildings for the purpose of this section. 10 When the specific use of a building is not known at the time of design and installation of the automatic fire-extinguishing system the design shall be based upon Ordinary Hazard Group 2 as set forth in UBC Standard 9-1. Whenever an addition is made to an existing building automatic fire-extinguishing systems shall be installed if the existing building plus the addition exceeds the area or height limitation set forth in this section. Whenever the use of an existing building or portion thereof is changed in any manner so as to require the installation of an automatic fire-extinguishing system, said system shall be installed in that portion of the building housing the new use. SECTION 24 Section Z3Z270 of the Dublin Municipal Code is deleted SECTION 25 Section 7.32.270 of the Dublin Municipal Code is added to read: Section 7.32.270 Section 1806~ Chapter 18~ Footings. Section 1806 is amended by adding the following at the end of the first paragraph: A minimum of one top and one bottom continuous bars of 1/2" diameter reinforcing steel shall be required in all continuous concrete or masonry bearing foundations of Group R residential occupancies. SECTION 26 Section 7.3Z271 of the Dublin Municipal Code is added to read: Section 7.32.271 Section 1924, Chapter 19, Minimum Slab Thickness. Section 1924 is amended as follows: (a) General. The minimum thickness of concrete floor slabs supported directly on the ground shall be not less than 3-1/2". The slab shall be reinforced with not less than six inches by six inches ten- gauge wire mesh or an approved alternate installed at mid height of the slab. SECTION 27 Section 7.32.272 of the Dublin Municipal Code is added to read: Section 7.32.272 Section 2326.11.3, Chapter 23, Item 5 Deleted - Bracing. Section 2326.11.3, Item 5 is deleted. SECTION 28 Section 7.32.273 of the Dublin Municipal Code is added to read: Section 7.32.273 Section 2326.11.3, Chapter 23, Item 7, Amended Bracing. Section 2326.11.3 Item 7 is amended as follows: 11 Portland cement plaster on studs spaced 16 inches on center installed in accordance with Table No. 47-I. Limited to single story R-3 and U-1 occupancies. SECTION 29 Section 7.32.274 of the Dublin Municipal Code is added to read: Section 7.32.274 Section 3403.2, Chapter 34, Suspended Ceilings. Section 3403.2 is amended by adding the following paragraph at the end of the Section following exceptions. When a permit is issued for alterations or repairs, the existing suspended ceiling system within the area of alteration or repair shall comply with the lateral design requirements of UBC Standard 25-2 Part III. SECTION 30 Section 7.32.280 of the Dublin Municipal Code is amended to read: Section 7.32.280 Section 1023, Appendix Chapter 10, Building Security. Appendix 10 is amended to read: Section 1023 Residential Security Requirements. (a) Exterior doors. All exterior wood doors shall be of solid wood construction, no less than 1- 3/4 inches thick or hollow metal doors. Except for sliding glass doors, exterior doors hall not have glazing larger than 2" unless glazing is 1/4" tempered glass. (b) Locking devices. Exterior swinging doors shall have a lock on the latching device and an auxiliary cylinder dead bolt. The dead bolt shall be hardened steel and have a 1" throw. If the cylinder of the lock protrudes from the face of the door it shall be fitted with a cylinder ring guard so it cannot be gripped with pliers or other wrenching devices. Double doors shall have the inactive leaf secured with flush bolts at top and bottom. The bolts shall be hardened steel 1/4" minimum in diameter and shall engage a metal strike plate to a minimum depth of 3/8". (c) Strike plates. Strike plates for wood jambs shall be the high security type and shall be secured with a minimum of two wood screws 3" long which shall engage the door studs. (d) Jambs. Inswinging doors with wood jambs shall have rabitted jambs. The jambs on the strike side shall have continuous solid shims above and below the strike plates and the opposite jamb shall have solid shims at the level of the strike plate. Both door studs shall be reinforced with horizontal solid blocking at the approximate height of strike. (e) Hinges. Exterior hinges and hinges of outswinging doors from the garage to the dwelling shall have non-removable pins. (f) Sliding glass doors. Sliding glass doors shall comply with Chapter 24. Sliding glass doors shall be fitted with a locking device that shall engage the strike sufficiently to prevent its being disengaged by any possible movement of the door within the space or clearances provided for installation and operation. The bolt and strike shall be reinforced by hardened material so as to prevent their separation by pulling, prying or similar attack. An auxiliary locking device shall be installed on the door which may be a pin, lock, or similar device of not less than 1/4 inch diameter. The pin shall be of a hardened material 12 and engage the metal portion of the sliding door. Doors with two sliding panels shall be locked at the meeting rails and shall have an auxiliary locking device as described above. (g) Entry vision. All main or front entry doors shall be fitted with a viewing device having a field of view of not less than 180 degrees. (h) Windows. All accessible dwelling windows shall be secure as follows: 1. Sliding glass windows shall be secured on the inside with a locking device capable of withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding window that prevents movement in the sliding track. 2. Louvered windows shall not be used within eight feet of ground level, adjacent structures, or fire escapes. 3. Casement type windows shall be secured with a metal to metal locking device contacting both frames of the window at the meeting edge. Auxiliary locks such as a pin that penetrates both frame structures shall be installed on casement and double hung windows. 4. Windows fitted with a crank type gear opening device shall be fitted with a positive window lock that engages metal to metal. Windows shall not be located within 40 inches of the locking device of any door unless protected by a steel grill with 1/4" minimum diameter bars not more than 2" on center or by a screen with 1/8" diameter wire mesh more than 2" on center mounted on the inside or glazed with 1/4" tempered glass. (i) Garage doors. Vehicle garage doors shall be secured with a metal to metal locking device that prevents the door from being pulled or pried up from the outside. No electric garage door openers shall be .permitted that will automatically activate when the door is forced open. Garage doors fitted with automatic openers shall be permitted with an alternative form of locking device activated from the interior of the garage. Other garage doors shall comply with all of the provisions of this section. (j) Storage areas. Any exterior storage area attached to a dwelling, apartment or condominium and enclosed by a door shall comply with this section or have a minimum 3/8" diameter hardened padlock hasp. Section 1024 Non Residential Security Requirements (a) Doors. Exterior doors which are located at the rear or side or away from the primary entrance shall be solid doors with no glazing and shall be installed in metal frames. Exterior wood doors shall be solid wood construction 1-3/4 inches thick or hollow metal doors. (b) Locking device. Exterior swinging doors which are exit doors as set forth in Chapter 10 shall have cylinder dead-bolt locks which' shall be openable without he use of key, special effort, or knowledge. In Group B occupancies, a double cylinder dead-bolt lock may be used on the main exit door if there is a readily visible, durable sign on, or adjacent, to the door stating, "this door to remain unlocked during business hours." The sign shall be in letters not less than 1 inch high on contrasting background. When unlocked the single door and both leaves of a pair of doors shall be free to swing without operation of any latching device. Doors which are not exit doors shall have a double-keyed cylinder dead-bolt. Double doors that are not exit doors shall have the inactive leaf secured with flush-bolts at the top and bottoms. The bolts shall be hardened steel 1/4" minimum diameter and shall engage a metal strike plate to, a minimum depth of 3/8 inch. The dead bolts shall be hardened steel and shall have a minimum of 1½ inch throw. If the cylinder of the lock protrudes from the face of the door it shall be fitted with cylinder ring geared so that it cannot be griped with pliers or other wrenching devices. Vehicle doors, overhead doors, and sliding doors shall be secured with metal to metal locking devices which prevent the door from opening. 13 (c) Strike plates. Strike plates for wood jambs shall be the high security type and shall be secured with a minimum of two wood screws 3" long which shall engage the door studs. (d) Jambs. Inswinging doors with wood jambs shall have rabitted jambs. The jambs on the strike side shall have continuous solid shims above and below the strike plates and the opposite jamb shall have solid shims at the level of the strike plate. Both door studs shall be reinforced with horizontal solid blocking at the approximate height of strike. (e) ltinges. Exterior doors shall have non-removable hinge pins. (f) Sliding glass doors. Sliding glass doors shall comply with Chapter 24. Sliding glass doors shall be fitted with a locking device that shall engage the strike sufficiently to prevent its being disengaged by any possible movement of the door within the space or clearances provided for installation and operation. The bolt and strike shall be reinforced by hardened material so as to prevent their separation by pulling, prying or similar attack. An auxiliary locking device shall be installed on the door which may be a pin, lock, or similar device of not less than 1/4 inch diameter. The pin shall be of hardened material and engage the metal portion of the sliding door. The primary locking device shall be operable by a keyed or code lock inside. Doors with two sliding panels shall be locked at the meeting rails and shall have an auxiliary locking device as prescribed above. (g) Windows. All accessible windows which are not located at the front or main entrance side of a non-residential building shall be made secure as follows: 1. Sliding glass windows shall be secured on the inside with a locking device capable of withstanding prying or wrenching. An auxiliary lock shall be installed on each sliding window that prevents movement in the sliding track. 2. Louvered windows shall not be used within eight feet of ground level, adjacent structures, or fire escapes. 3. Casement type windows shall be secured with a metal, to metal locking device contacting both frames of the window at the meeting edge. Auxiliary locks such as a pin that penetrates both frame structure shall be installed on casement and double hung windows. 4. Windows shall not be located within 40" of the locking device of any door not located on the main entrance side of the non-residential building unless the windows are glazed with 1/4" tempered glass. (h) Openable transoms. Ail exterior openable transoms exceeding 8" x 12" which are not located on the front or main entrance side of a non-residential building shall be protected with a steel grill with 1/4" minimum bars not more than 2" on center or by a screen with 1/8" diameter wire mesh not more than 2" on center mounted on the inside. (i) Roof openings. Ail skylights on the roof of a non-residential building shall be protected by: 1. Iron bars 1/2" minimum diameter not more than 8" on center or; 2. A screen with 1/8" diameter wire mesh not more than 2" on center. All roof access hatches of a non-residential building shall be protected as follows: (1). If the hatchway is of wooden material, it shall be covered on the inside with at least 16 gauge steel or its equivalent attached with screws at 6"; (2). The hatchway shall be secured from the inside with a slide bar or slide bolts; (3). Outside hinges on all hatchway openings shall be provided with non removable pins when using pine-type hinges. Ail air duct or air vent openings exceeding 8" x 12" on the roof or exterior walls of any building or premise used for business purposes shall be secured by covering the same with either of the following: 1. Iron bars of at least 1/2" round or 1" x 1/4" flat steel material, spaced no more than 8" apart and securely fastened. 14 (j) Exterior ladders. Exterior ladders to the roof are not permitted. SECTION 31 Section 7.32.290 Dublin Municipal Code is deleted SECTION 32 Section 7.32.300 of the Dublin Municipal Code is amended to read: Section 7.32.300 or Demolition. Section 3303, Chapter 33, Protection of Pedestrians During Construction Section 3303.1 is amended to read: Section 3303.1 General. No person shall place or store any material or equipment necessary for the work authorized by any building permit on any street or alley or public sidewalk unless an encroachment permit is provided by Chapter 7.04, Dublin Municipal Code, has been secured. No person shall perform any work on any building or structure if by so doing it endangers pedestrians on the street that abuts the property, unless the protection of pedestrians as specified in this code is provided. No encroachment permit shall be required for the construction of any railing, fence, or canopy used for the protection of pedestrians if there is a valid building permit in effect for such work and the railing, fence or canopy does not extend beyond the curb or gutter if there is no curb. SECTION 33 Section 7.32.310 of the Dublin Municipal Code is amended to read: Section 7.32.310 Section 3303.2, Chapter 33, Temporary Use of Streets and Alleys. Section 3303.2 is deleted. SECTION 34 Section 7.32.320 of the Dublin Municipal Code is amended to read: Section 7.32.32 Section 3303.3, Chapter 33, Storage on Public Property. Section 3303.3 is deleted. SECTION 35 Section 7.32.330 of the Dublin Municipal Code is amended to read: Section 7.32.330 Section 3303.4, Chapter 33, Mixing Mortar on Public Property. Section 3303.4 is deleted. SECTION 36 Section 7.32.340 of the Dublin Municipal Code is amended to read: 15 Section 7.32.340 Section 3303.5, Chapter 33, Protection of Utilities. Section 3303.5 is deleted. SECTION 37 Section 7.32.350 of the Dublin Municipal Code is amended to read: Section 7.32.350 Section 3201, Chapter 32, General. Section 3201 is amended to read: Section 3201. No part of any structure or any appendage thereto shall project beyond the property line of the building site except as specified in this chapter. Structures or appendages regulated by this code shall be constructed of materials as specified in Section 705. The projection of any structure or appendage shall be the distance measured horizontally from the property line to the outermost point of the projection. No provision of this chapter shall be construed to permit the violation of other laws or ordinances regulating the use and occupancy of public property. SECTION 38 Section 7.32.360 of the Dublin Municipal Code is deleted Section 7.32.360 Section 3202, Chapter 32, Projection into Alleys. Section 3202 is deleted. SECTION 39 Section 7.32.370 of the Dublin Municipal Code is amended to read: Section 7.32.370 Section 3203, Chapter 32, Space Below Sidewalks. Section 3203 is deleted. SECTION 40 Section 7.32.380 of the Dublin Municipal Code is amended to read: Section 7.32.380 Section 3208, Chapter 32, Signs. A new Section 3208 is added to read: Section 3208 Signs. Signs when placed flat against the wall of a building shall not project beyond the front property line not more than 12 inches. SECTION 41 Section 7.32.390 of the Dublin Municipal Code is amended to read: Section 7.32.390 Section 2506.4, Chapter 25, Weather-resistive Barriers. 16 Section 2506.4 is amended to read: Section 2506.4. Notwithstanding the provisions of 1402.1 the weather-resistive barrier for exterior stucco shall be either Type 15 felt or Grade D craft building paper having a 60-minute water- resistance when tested in accordance with UBC Standard 14-1. Two layers of the weather-resistive barrier shall be applied over wood sheathing. SECTION 42 Section 7. 32. 400 of the Dublin Municipal Code is deleted SECTION 43 Section 7.32.420 of the Dublin Municipal Code is deleted SECTION 44 Section 7.36. 030 of the Dublin Municipal Code is amended to read: Section 7.36.030 Adoption. The "National Electrical Code 1993," published by the National Fire Protection Association, a copy of which is filed in the office of the City Clerk, is adopted by reference as the electrical code for the city pursuant to the provisions of Section 50022.1 et seq. of the Government Code of the state of California, except as hereinafter modified in Sections 7.36.070 and 7.36.080 of this chapter. SECTION 45 Section 7.36.090 of the Dublin Municipal Code is added to read: Section 7.36.090, Article 336-4 is amended by replacing it with the following: (a) Type NM or NMC. Types NM and NMC cables shall not be used (1) in any dwelling or structure exceeding three floors above grade; (2) as service-entrance cable; (3) embedded in poured concrete; or (4) in any non-residential occupancy. For the purpose of this article, the first floor of a building shall be that floor that has 50 percent or more of the exterior wall surface area level with or above finished grade. One additional level that is the first level and not designed for human habitation and used only for vehicle parking, storage, or similar use shall be permitted. SECTION 46 Section 7. 40.030 of the Dublin Municipal Code is amended to read: Section 7.40.030 Adoption. The "Uniform Plumbing Code" 1994 Edition, published by the International Association of Plumbing and Mechanical Officials, including Appendix Chapters A, B, D, E, H, and I, and all installation standards, a copy of which is filed in the office of the City Clerk is adopted by reference as the plumbing code for the city pursuant to the provision of Section 50022.1 et seq. of the Government Code of the state of California except as hereinafter modified in Section 7.40.075 through 7.40.150 of this chapter. 17 SECTION 47 Section 7. 40. 075 of the Dublin Municipal Code is amended to read: Section 7.40.075 Section 311, Chapter 3 Prohibited Fittings and Practices. Section 311 is amended by adding a new subsection 311.9 to read: 311.9 Plastic piping shall not be exposed as a portion of the interior room finish in a building or structure if the piping has flame-spread rating exceeding 75 when tested in accordance with ASTM E 84- 77a Test for Surface Burning Characteristics of Building Materials. SECTION 48 Section Z 40. 090 of the Dublin Municipal Code is amended to read: Section 7.40.090 Section 401, Chapter 4, Materials. Section 401 is amended by adding a new subsection 401.3 to read: 401.3. Drainage piping shall be cast iron, galvanized steel, galvanized wrought iron, lead, copper, brass, Schedule 40 ABS DWV, Schedule 40 PVC DWV, extra-strength vitrified clay pipe, or other approved materials having a smooth and uniform bore, except that: (1) No galvanized wrought iron or galvanized steel pipe shall be used under ground and shall be kept at least six (6) inches (152.4 mm) above ground. (2) ABS and PVC DWV piping installations shall be limited to structures not exceeding three floors above grade. For the purpose of this subsection, the first floor of a building shall be that floor that has fifty (50) percent or more of the exterior wall surface area level with or above finished grade. One additional level that is the first level and not designed for human habitation and used only for vehicle parking, storage, or similar use shall be permitted. (2.1) ABS and PVC installations are limited to residential construction not more than two (2) stories in height and to relocatable public school buildings. (3) No vitrified clay pipe or fittings shall be used above ground or when pressurized by a pump or ejector. They shall be kept at least twelve (12) inches (304.8mm) below ground. SECTION 49 Section 7. 40.1 O0 of the Dublin Municipal Code is amended to read: Section 7.40.100 Section 503.0, Chapter 5, Materials. Section 503 is amended by adding a new subsection 503.1 to read: 501.1 Materials. Vent pipe shall be cast iron, galvanized steel, galvanized wrought iron, lead, copper, brass, Schedule 40 ABS DWV, Schedule 40 PVC DWV, or other approved materials having a smooth and uniform bore, except that: (1) No galvanized wrought iron or galvanized steel pipe shall be used under-ground and shall be kept at least six (6) inches above ground. 18 (2) ABS and PVC DWV piping installations shall be limited to structures not exceeding three floors above grade. For the purpose of this subsection, the first floor of a building shall be that floor that has fifty percent or more of the exterior wall surface area level with or above finished grade. One additional level that is the first level and not designed for human habitation and used only for vehicle parking, storage, or similar use shall be permitted. (2.1) AB S and PVC installations are limited to residential construction not more than two (2) stories in height. (b) Vent fittings shall be cast iron, galvanized malleable iron or galvanized steel, lead, copper, brass, ABS, PVC, or other approved materials, except that no galvanized malleable iron or galvanized steel fitting shall be used underground and shall be kept at least six (6) inches (152.4mm) above ground. (c) Changes in direction of vent piping shall be made by the appropriate use of approved fittings and no such pipe shall be strained or bent. Burred ends shall be reamed to the full bore of the pipe. SECTION 50 Section 7. 40.105 of the Dublin Municipal Code is added to read: Section 7.40.105 Section 609.3, Chapter 6, Water Piping in Slab Floors. Section 609.3, First paragraph, is amended by replacing it to read: Section 609.3 Water piping shall not be installed in or under a concrete floor slab within a building without prior approval of the Building Official. When approved, such piping shall be installed in accordance with the following requirements: SECTION 51 Section 7. 40.110 of the Dublin Municipal Code is added to read: Section 7.40.110 Section 710.1, Chapter 7, Backwater Valves. Section 710.1 is amended to read: Section 710.1 Drainage piping serving fixtures which have flood level rims less than twelve (12) inches (304.8mm) above the elevation of the next upstream manhole and/or flushing inlet cover at the public or private sewer system serving such drainage piping shall be protected from backflow of sewage by installing an approved type backwater valve. Fixtures above such elevation shall not discharge through the backwater valve, unless first approved by the Building Official. SECTION 52 Section 7. 40.115 of the Dublin Municipal Code is added to read: Section 7.40.115 Section 719.7, Chapter 7, Cleanouts. Section 719.7 is amended by adding subsection 7 to read: Section 719.7 Cleanouts shall be installed at the property line where the private sewer system connects to the publicly-maintained sanitary sewer lateral. All such line cleanouts shall be extended to 19 grade with materials and according to specifications approved by the Building Official and terminate within a concrete box. SECTION 53 SeCtion 7.40.120 of the Dublin Municipal Code is amended to read: Section 7.40.120 Section 807.2, Chapter 8, Condensate Disposal. Section 807.2 is amended by replacing it to read: Section 807.2 Condensate from air-cooling coils and comfort cooling equipment not intended to be used for the storage or holding of food or drinks shall be collected and discharged to a storm sewer or other approved points of disposal acceptable to the Building Official. Termination of such drains shall be made by an air break. Condensate drain lines in sizes I 1/4" and larger shall be assembled using approved drainage pipe and fittings. Condensate waste water shall not drain over or upon a public way, sidewalk, pedestrian ramp or the like. Condensate drains within the interior of a building shall not be connected to the building roof drain or overflow piping systems. The waste pipe shall have a slope of not less than 1/8 inch per foot and shall be of approved corrosion-resistant material not smaller than the outlet size as required below for air-cooling coils or condensing fuel-burning appliances, respectfully. Condensate wastes pipes from air-cooling coils shall be sized in accordance with equipment capacity as follows: Minimum Condensate Equipment Capacity Pipe Diameter Up to 20 tons of refrigeration 21 to 40 tons of refrigeration 41 to 90 tons of refrigeration 91 to 125 tons of refrigeration 126 to 250 tons of refrigeration 3/4 inch 1 inch 1 1/4 inch 1 1/2 inch 2 inch The size of condensate waste pipes may be for one unit or a combination of units, or as recommended by the manufacturer. The capacity of waste pipes assumes a 1/8 inch-per-foot slope, with the pipe running three-quarters full. Condensate drain sizing for other slopes or other conditions shall be approved by the Building Official. SECTION 54 Section 7.40.130 of the Dublin Municipal Code is amended to rea& Section 7.40.130 Section 608.7, Chapter 6, Water Pressure, Pressure Regulators and Pressure Relief Valves- Added. Section 608.0 is amended by adding a new subsection 608.7 to read: 608.7 Each riser or branch shall be provided with an accessible sectionalizing valve in hot and cold-water systems to permit servicing or replacement of piping or equipment. Stop valves shall be provided at each fixture. 20 SECTION 55 Section 7. 40.140 of the Dublin Municipal Code is amended to read: Section 7.40.140 Section 713.0, Chapter 7, Sewer Required. Section 713.0 Sewer Required. Every building in which plumbing fixtures are installed and every premises having drainage piping thereon shall have a connection to a public sewer. Except that where there is no available public sewer within 200 feet, measured along streets, alleys, or public right-of-way upon which a lot abuts, and when the size of the property is in excess of 40,000 square feet, drainage piping from any building or works may be connected to an approved private sewage disposal system. All such sewage disposal systems shall be designed, constructed, operated, and maintained in compliance with the Health Officer's regulations. Not withstanding the provisions of Section 320 and Section 11.8 of this Ordinance. Whenever a public sewer is extended so as to become within 200 feet of any premises having a private sewage disposal system, said private sewage disposal system shall be abandoned and the building sewer shall be connect to the public sewer. No permit shall be issued for the installation, alteration or repair of any private sewage disposal system or part thereof of any premises for which a public sewer is within 200 feet. On every lot or premises hereafter connected to a public sewer, all plumbing and drainage systems or parts thereof on such lot or premises shall be connected to such public sewer. SECTION 56 Section 7. 40.150 of the Dublin Municipal Code is amended to read: Section 7.40.150 Section 308.3, Chapter 11 3, Location. Section 308.3 is amended by adding a new subsection 308.3 to read: 308.3 It shall be unlawful to sell, transfer, divide, or set off any portion of any lot which in any way reduce the minimum areas set forth in Section 713.0 or reduce the minimum distances set forth in Table 7-7. SECTION 57 Section 7. 44.030 of the Dublin Municipal Code is amended to read: Section 7.44.030 Adoption. The "Uniform Mechanical Code" 1994 Edition, published by the International Association of Plumbing and Mechanical Officials and the International Conference of Building Officials, including Appendix Chapters A, B, C and D, a copy of which is filed in the office of the City Clerk, is adopted by reference as the mechanical code for the city pursuant to the provisions of Section 50022.1 et seq. of the Government Code of the state of California except is hereinafter modified in Section 7.44.070. SECTION 58 Section 7. 44. 070 of the Dublin Municipal Code is amended to read: 21 Section 7.44.070 Chapter 1, Administration - Deleted. Chapter 1, including Parts I, II, and Iii is deleted. SECTION 59 Section 7. 44. 080 of the Dublin Municipal Code is added to read: Section 7.44.080 Section 301.1, Chapter 3, Condensate Disposal. Section 310.1 is amended by replacing it to read: Section 310.1 Condensate from air cooling coils and comfort cooling equipment not intended to be used for the storage or holding of food or drinks shall be collected and discharged to a storm sewer or other approved points of disposal acceptable to the Building Official. SECTION 60 Section 7.48.030 of the Dublin Municipal Code is amended to read: Section 7.48.030 Adoption. The "Uniform Housing Code" 1994 Edition, published by the International Conference of Building Officials, a copy of which is filed in the office of the City Clerk is adopted by reference as the housing code for the city pursuant to the provisions of Section 5~)022.1 et. seq. of the Government Code of the state of California except as hereinafter modified in Sections 7.48.050 through 7.48.140. SECTION 61 Section 7. 48. 050 of the Dublin Municipal Code is amended to read: Section 7.48.050 Chapter 1, Title and Scope- Deleted. Chapter I on Page 1 is deleted. SECTION 62 Section 7. 48. 060 of the Dublin Municipal Code is amended to read: Section 7.48.060 Chapter 2, Enforcement - Deleted. Chapter 2 on Pages 2 and 3 is deleted. 22 SECTION 63 Section 7. 48. 070 of the Dublin Municipal Code is amended to read: Section 7.48.070 Chapter 3, Permits and Inspections - Deleted. Chapter 3 on Page 4 is deleted. SECTION 64 Section 7. 48. 080 of the Dublin Municipal Code is amended to read: Section 7.48.080 Section 505.8, 505.9, 505.10~ Chapter 5, Sanitation- Added. Section 505 on page 8 is amended by adding new subsections 505.8, 505.9, and 505.10 to read: 505.8 Garbage Receptacles. An adequate number of appropriate receptacles with close fitting covers for garbage and rubbish as may be considered necessary by the enforcing agency shall be provided for the occupant of every dwelling unit by the owner or operator of every apartment house, hotel, or combination thereof. Each receptacle shall be kept in a clean condition and good repair. 505.9 Bedding. In every apartment house or hotel every part of every bed, including the mattress, sheets, blankets, and bedding shall be kept in a clean, dry and sanitary condition, free from filth, urine, or other foul matter; and from infection of lice, bed-bugs, or other insects. The bed linen shall be changed before a new guest occupies the dwelling unit. 505.10 Caretaker. A manager, janitor, housekeeper, or other responsible person shall reside upon the premises and shall have charge of every apartment house in which there are sixteen (16) or more apartments and of every hotel in which there are twelve (12) or more guest rooms, in the event that the owner of any such apartment house or hotel does not reside upon said premises. If the owner does not reside upon the premises of any apartment house in which there are more than four (4) but less than sixteen (16) apartments, a notice stating his name and address, or name and address of his agent in charge of the apartment house shall be posted in a conspicuous place on the premises. SECTION 65 Section 7. 48. 090 of the Dublin Municipal Code is amended to read: Section 7.48.090 Chapter 11, Notices and Orders of the Building Official - Deleted. Chapter 11 on Pages 16, 17, and 18 is deleted. SECTION 66 Section 7. 48.1 O0 of the Dublin Municipal Code is amended to read: Section 7.48.100 Chapter 12, Appeal- Deleted. Chapter 12 on Page 19 is deleted. SECTION 67 Section 7. 48.110 of the Dublin Municipal Code is amended to read: 23 Section 7.48.110 Chapter 13, Procedures for Conduct of Hearing Appeals - Deleted. Chapter 13 on Pages 20, 21 and 22 is deleted. SECTION 68 Section 7. 48.120 of the Dublin Municipal Code is amended to read: Section 7.48.120 Chapter 14, Enforcement of the Order of the Building Official or the Board of Appeals - Deleted. Chapter 14 on Pages 23 and 24 is deleted. SECTION 69 Section 7.48.130 of the Dublin Municipal Code is amended to read: Section 7.48.130 Chapter 15, Performance of Work of Repair or Demolition - Deleted. Chapter 15 on Page 25 is deleted. SECTION 70 Section 7. 48.140 of the Dublin Municipal Code is amended to read: Section 7.48.140 Chapter 16, Recovery of Cost of Repair or Demolition - Deleted. Chapter 16 on Pages 26, 27, and 28 is deleted. SECTION 71 The provisions of this ordinance shall take effect on January 1, 1996 pursuant to Government Code section 36937 as an urgency ordinance. The urgency is based on the fact that the State published and adopted the 1994 editions of the model codes on July 1, 1995. Local jurisdictions must then adopt these codes within 6 months, which is January 1, 1996. This City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
