City of Dublin, Alameda County Superior Court No. 2002049773 1. CAI,I, TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Presentation by Parks & Community Services Staff on Heritage and Cultural Arts in the City (File #910-80) The City of Dublin Parks & Community Services Department is organized into three divisions: Community Services; Heritage and Cultural Arts; and Parks and Facilities Devetop. Staff has prepared a presentation on heritage' and cultural arts in the City. STAFF RECOMMENDATIONS: Receive and accept Parks & Community Services Staff presentation. 3.2 Appointments to the Art Selection Committee - Senior Center Art Project (File # 110-30) At its September 17, 2002, meeting, the City Council approved the formation of a seven member Art Selection Committee for the Senior Center Art Project and directed Staff to advertise for openings. The City Council will consider the Mayor's recommended appointments to the Committee. STAFF RECOMMENDATION: Confirm Mayor's appointments to Art Selection Committee for the Senior Center Art Project. 3.3 Proclamation declaring October 20-26, 2002, Red Ribbon Week (File #610-50) 3.4 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2X3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action, Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Special Meeting of September 23, 2002, and Regular Meeting of October 1, 2002 STAFF RECOMMENDATION: Approve 4.2 Approval of Grant of Easement for Public Utility and Right-of-Way to Dublin San Ramon Services District (DSRSD)Across Parcel 2 of Parcel Map 7708 (Santa Rita Property, Fire Station 17) (File #670-40) This easement is required on Fire Station 17 (on Madigan Road) to allow DSRSD to maintain a District-owned fire hydrant and fire line located on the Fire Station parcel. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute Grant of Easement. 4.3 Construction Truck AcceSs Agreement with Windemere BLC Land Company (File #600-30) This item is intended to approve a construction truck access agreement with Windemere BLC to allow this developer to use Dougherty Road within Dublin to haul heavy aggregate base and asphalt materials to construct roadway improvements for "Phase lB" of the Windemere Ranch Project, located within Contra Costa County. STAFF RECOMMENDATION: Adopt Resolution and authorize the Mayor to execute Agreement. 4.4 Revisions to the Personnel System (File #700-20) The City Council will consider amending the City's Classification and Salary Plans to add the classification of Code Enforcement Officer. STAFF RECOMMENDATION: Adopt Resolutions amending the Classification and Salary Plans. 4.5 Budget Carryovers from Fiscal Year 2001-2002 to Fiscal Year 2002-2003 (File #330-20) As part of the process of reviewing the Final Financial Reports for Fiscal Year 2001-2002, Staff noted several Capital Projects line items that were originally anticipated to be completed in Fiscal Year 2001-2002, but are now scheduled for completion in Fiscal Year 2002~2003. Staff is recommending the adoption of proposed budget changes so that these projects are fully funded in Fiscal Year 2002-2003. STAFF RECOMMENDATION: Approve Budget Changes. 4.6 Adoption of Annual Investment Policy (File #320-30) The City's current investment policy, as well as State Law, requires that it be reviewed by the City Council on an annual basis. Staff has reviewed the City's current investment policy and determined that it complies with current State Laws regulating investments and continues to provide for adequate diversification of investments and controls over investment related activities. STAFF RECOMMENDATION: Receive report. 4.7 RequeSt for Proposals for the Eastern Dublin Properties Resource Management Plan (RMP) (File #600-30) This Request for Proposals will begin the process of soliciting and selecting a consultant to prepare a Resource Management Plan for the 1,120-acre Eastern Dublin Properties area. STAFF RECOMMENDATION: Authorize Staff to distribute RFP, 4.8 Financial Reports for the Months of August and September 2002 (File #330-50) STAFF RECOMMENDATION: Receive reports. 4.9 Request to Award Bid for Civic Center and Shannon Center PRI Telephone Service (File #600-30) As part of the 2002-2003 operating budget, funding exists for monthly telephone service. With the acquisition of a new telephone system, the desired telephone service will utilize a digital PRI line. This item requests authorization to award a three-year contract for telephone service to TelePacific Communications. STAFF RECOMMENDATION: Adopt Resolution awarding bid to TelePacific Communications and authorize City Manager to execute Agreement. 4.10 Warrant Register ($3,598,596.83) dated October 15, 2002 (File 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN coMMUNICATIONS 5.1 Oversized Vehicle Parking on Residential Streets (File #570-20) On September 10, 2002, the City Council received a letter signed by several Willow Creek residents expressing concerns attributed to the parking of recreational vehicles and other oversized vehicles in the area of Shady Creek and Alamo Creek Park. The letter requested that the City adopt a City Ordinance that would address the issue of recreational vehicle and oversized vehicle parking in the City of Dublin. Currently, Dublin Municipal Code §6.04.43a "On-Street Vehicle Storage Prohibitear' is the only existing enforcement statue that pertains to the parking of recreational or oversized vehicles in the City. The statue allows for towing of a vehicle parked for greater than 72 hours. The statue does not address how £ar the vehicle has to be moved to meet the 72-hour restriction, nor does it address the issues of traffic hazards that oversized vehicles cause in residential areas. STAFF RECOMMENDATION: Receive report and proVide direction to Staff regarding additional action or study on this issue. 6. PUBLIC HEARING 6.1 Ordinance Amending Section 1.04.070 and Adding Section 1.04.75 to the Dublin Municipal Code relating to Claims (File #170-10) This is the second reading of an Ordinance, which would require that each person (rather than a representative claimant representing all similarly situated person) seeking money or damages from the City, first submit a claim to the City. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2 Amendments to the Smoking Pollution Control Ordinance (File #560-90) This is the second reading of an Ordinance which would bring the existing provisions of Chapter 5.56 of the Dublin Municipal Code regulating smoking into conformity with recent changes in State Law and add additional permissible restrictions on smoking in,enclosed and unenclosed public places and places of employment. STAFF RECOMMENDATION: Conduct public heating; deliberate; waive reading and ADOPT Ordinance. 6.3 Assessment for Weed and Refuse Abatement (File #540-50) The City Council declared that there is a public nuisance created by weeds and combustible debris growing, accumulating upon the streets, sidewalks and property within the City of Dublin. The property located at and adjacent to 11481 Bloomington Way, Dublin, was posted with a Notice to Abate, and the property owners notified. A partial abatement was completed by the Owner and inspected by Fire Prevention Staff, who advised the Owner to complete the abatement process. The Owner failed to complete the abatement and bids for completion of the abatement were received, and a f'mn was hired to complete the abatement. The Property Owner was billed for the cost of the abatement. The Property Owner has not paid for the cost of the abatement and has been notified of the time and date of this hearing by certified mail. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution confirming the Report and Assessment List; and direct Staff to order the placement of a lien on the property to recover costs. 6.4 Facility Use Policy Revisions (File #200-10/210-10/250-10/280-10/260-10) One of the high priority City Council goals for Fiscal Year 2001-2002 was to "Review City Facility Rental Policies." Staff has completed a comprehensive review of the Facility Use Policies for the Dublin Civic Center, Shannon Community Center, Dublin Swim Center, Stager Community Gymnasium and Dublin Sports Grounds, and has proposed changes to each of the policies. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and adopt Resolutions establisl'dng Facility Use Policies and Fee Schedules for the Dublin Civic Center, Shannon Community Center, Dublin Swim Center, Stager Community Gymnasium and Dublin Sports Grounds. 7. UNFINISHED BUSINESS 7.1 Community Development Department, Planning Division Work Program Status (420-10) Staff will present the City Council with a summary o£the Planning Division's Work Program and Status. STAFF RECOMMENDATION: Receive Staff presentation. 8. NEW BUSINESS 8.1 Consultant Services for Landscape Architecture, Dublin Ranch Area G Neighborhood Park (File #600-30) As approved in the 2002-2007 Capital Improvement Program, design and construction of the 4.8-acre Neighborhood Park in Dublin Ranch Area G will begin in Fiscal Year 2002-2003 and be complete in Fiscal Year 2003-2004. The scope of work for professional services will include the development of three alternative designs, a preferred conceptual plan, design development, construction documentation, and building and construction administration. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement with Royston Hanamoto Alley and Abey. 8.2 Approval of Agreement for Landscape Maintenance Services in the Dougherty Assessment District #86-1 And Stagecoach Assessment District #83-2 (File g600-30) Entering into this contract will reduce the cost of landscape maintenance by approximately $15,200 for the Dougherty Landscape Assessment District. It would also replace landscape contractor for the Stagecoach Assessment District at a slightly increased cost. STAFF RECOMMENDATION: Adopt Resolution approving a one-year agreement with TruGreen LandCare; and approve an additional Appropriation from the Stagecoach Assessment District Reserves in the amount of $1,210. 9.
