CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG - MATT PINNEY, First Class Scout & Senior Patrol Leader, Troop 920 3. ORAL COMMUNICATIONS 3.1 Presentation of Customer Service Award for Month of October 3.2 Introduction of New Employee, Richard "Bo" Barker, Management Assistant in the City Manager's Office At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Counci l Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of September 9, 1991 STAFF RECOMMENDATION: Approve 4.2 Award of Bid Contract 91-06 Annual Striping & Marking Contract The Chrisp Company was the low bidder for Dublin's annual street striping and marking contract. Their bid of $61,890 is approximately $5,000 below the budget and engineer's estimate. The Chrisp Company was also the low bidder for Dublin's 1990-91 program and successfully completed last years' work. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement. 4.3 Contract 91-01 Annual Sidewalk Safety Repair & Handicap Ramp Construction This contract will repair offset concrete curbs, gutters and sidewalks which are deemed to be pedestrian tripping hazards. It also includes the installation of handicap curb ramps to be funded through a $38,166 Transportation Development Act grant. STAFF RECOMMENDATION: Adopt Sidewalk Repair Program Policy Resolution and authorize Staff to advertise for bids. 4.4 National League of cities Finance, Administration and Intergovernmental Relations (FAIR) Steering committee Meeting Cm. Jeffery was appointed to the FAIR Committee by the President of the League of California cities. The Committee will be meeting in Washington, D.C., on October 4-6, 1991. The approximate cost is $800 and the City is eligible for reimbursement by the League of CA cities. STAFF RECOMMENDATION: Authorize Cm. Jeffery to attend meeting. 4.5 Resolution of Intention to Issue Bonds for the purpose of providing financing for certain public improvements This Resolution places the City in a position to utilize tax-exempt financing for future infrastructure costs in western Dublin. STAFF RECOMMENDATION: Adopt Resolution 4.6 Agreement with Bissell & Karn, Inc., for Consulting Engineering Services for widening Dublin Boulevard between Silvergate Drive and Hansen Drive and modifying its intersection with Silvergate Drive. The project to reconstruct the Dublin Boulevard/Silvergate Drive intersection was approved for design and construction in this fiscal year's Capital Improvement Program. Proposals were solicited from 4 local qualified engineering firms for the topographical design work for this project. Bissell & Karn was determined to be the best and most qualified firm to complete this project based on the proposal submitted. STAFF RECOMMENDATION: Adopt Resolution and authorize transfer of $28,850 from unallocated reserves to this project. 4.7 Warrant Register Dated September 23, 1991 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Oakland Scavenger Company (OSC) 1992 Rate Adjustment Request OSC has submitted a request to the City for review of a 1992 rate application. The City jointly reviews applications with other agencies serviced by OSC. Due to a proposed change in the methodology, the actual amount of increase cannot be determined until further analysis by the Joint Refuse Rate Review Committee. STAFF RECOMMENDATION: Receive Report and direct request to the Joint Refuse Rate Review Committee for further analysis. 6. PUBLIC HEARING 6.1 Chevron Conditional Use Permit/Site Development Review PA 90-066 The Applicant is requesting CUP and SDR approval to construct and operate a new 24-hour service station, drive through car wash facility and food mart at 5933 Dougherty Road. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions approving the Negative Declaration, Conditional Use Permit and Site Development Review for Chevron. 6.2 Rental Availability Ordinance This Ordinance, which was introduced at the September 9, 1991 City Council meeting, would allow fees to be paid in- lieu of a requirement that a percentage of units in large mUlti-family projects be rented for a specified time period. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive second reading and ADOPT Ordinance; adopt Resolution approving in-lieu rental fee. 6.3 JL Construction Planned Development Rezoning; Dublin Meadows Appeal PA 91-001 This planned development rezoning would amend Dublin Meadows' conditions to allow payment of a fee in-lieu of maintaining 10% (21) of the mUlti-family units as rental units for 5 years. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive second reading and ADOPT Ordinance. 6.4 Twenty-Minute Parking Zone-North Side of Penn Drive @ Wells Intermediate School This proposed 20-minute parking along the north side of Penn Drive is a result of a request by a representative of the Dublin Unified School District to improve the student safety at Wells School. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance on an urgency basis. 6.5 Density Bonus Ordinance This Ordinance would allow density bonuses and other incentives to developers providing housing for very low and lower income households and for senior citizens as required by State law. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive second reading and ADOPT Ordinance -OR- waive reading and reintroduce the Density Bonus Ordinance. 7. UNFINISHED BUSINESS 7.1 1991-92 Vector Control Services Presently, the City of Dublin is one of three Alameda County cities not participating in the Countywide Vector Control District. During the 1991-92 Budget deliberations, the City Council expressed interest in annexing to the County Service Area. City Staff has worked with Alameda County Staff to pursue joining the service area. The Staff Report presents an outline of the steps necessary to join the Service Area. STAFF RECOMMENDATION: Adopt Resolution requesting that the territory of the City of Dublin be annexed to County Service Area 1984-1 (Vector Control); review and approve the Plan for Providing Services. 8.
