PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of August 24, 1987 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending August 31, 1987 STAFF RECOMMENDATION: Approve 4.3 Financial Report for Period Ending July 31, 1987 - Pro-Forma STAFF RECOMMENDATION: Approve 4.4 Disadvantaged Business Enterprise Program 1987 Goals The recently adopted Surface Transportation and Uniform Relocation Assistance Act of 1987 requires local agencies to establish a single Disadvantaged Business goal to include both minority and woman-owned business. STAFF RECOMMENDATION: Adopt Resolution 4.5 Revised Public Works Maintenance Agreement - MCE Corporation The City Council approved an agreement with MCE Corporation to provide various public works services. The current agreement was based on budget estimates prior to the formal adoption of the 1987-88 budget. The proposed agreement will reflect the approved expenditure amounts and makes minor modifications to the agreement based on a legal review conducted by the City Attorney and legal counsel for MCE Corporation. STAFF RECOMMENDATION: Authorize Mayor to execute agreement. 4.6 Final Acceptance of Contract 87-4 Annual Sidewalk Repair Program Improvements constructed under this contract have been completed to the satisfaction of the City Engineer. STAFF RECOMMENDATION: Accept improvements as being complete in accordance with the approved plans, specifications and modifications; authorize additional appropriation in the amount of $12,369.07; authorize retention payment to Ambo Engineering in the amount of $3,973.25. 4.7 Warrant Register dated September 14, 1987 STAFF RECOMMENDATION: Approve 4.8 Full-Time Personnel Salary Amendments As part of an annual review with employees to evaluate conditions of employment, the City Manager has reviewed salary ranges. A proposed Salary Plan has been prepared based on market conditions determined by a survey of comparable positions in similar agencies. Also, recommended salaries for new classifications included in the 1987-88 Budget are contained in the Salary Plan. STAFF RECOMMENDATION: Adopt resolution; authorize budget transfer from Contingent Reserve to appropriate operating accounts. 4.9 Employee Benefit Plan A review and survey of employee benefits was recently conducted to determine whether benefits offered are competitive with other agencies. Several modifications are being proposed. STAFF RECOMMENDATION: Adopt Resolution Adopting a Benefit Plan; adopt Resolution fixing employer's contribution under the Public Employees' Medical and Hospital Care Act; authorize budget transfer from Contingent Reserve to various benefit accounts. 4.10 Dolan Park Improvements, Phase II Staff has received a proposal from Cardoza-Dilallo-Harrington for landscape architectural services for Dolan Park improvements, Phase II. STAFF RECOMMENDATION: Award contract to Cardoza-Dilallo-Harrington; authorize Mayor to execute agreement 4.11 Data Processing System Computer - Request for Bids With the adoption of the 1987-88 Update to the Capital Improvement Program, the Council allocated $320,000 for the three-year phased implementation of a data processing system. This request for bids would cover the first phase which would bring the Finance Department on-line. STAFF RECOMMENDATION: Authorize Staff to solicit bids 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Loading Zone and No Parking Zone, Scarlett Court at Curtiss Dodge This item was continued from the August 24th Council meeting. It entails adoption of an ordinance establishing loading and no parking zones on Scarlett Court at Curtiss Dodge. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance on an urgency basis. 6.2 Ordinance relating to Underground Utility Districts This ordinance, which was introduced at the August 24th Council meeting, provides a procedure and means for establishing underground utility districts within the City. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.3 Ordinance relating to Floodplain Management This ordinance, which was introduced at the August 24th Council meeting, regulates use of property and construction of improvements within flood hazard areas. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.4 Eminent Domain Proceedings, Northwest Corner Dublin Boulevard/Clark Avenue The City needs to acquire an 8' wide strip of property on Dublin Boulevard at Clark Avenue for road widening purposes. This action will allow the City Attorney to proceed to obtain possession through the courts while negotiations with CSAA continue. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution determining that public interest and necessity require acquisition of certain land and directing the filing of eminent domain proceedings. 6.5 Rafanelli & Nahas, Request for Variance to Section 22.12(c) of Ordinance No. 02-84 The Alamo Creek Village II project was graded in 1986. In June, 1987, some regrading occurred. One of the conditions of approval of building permits was to provide inspection reports. There is no assurance that fill was placed as required, but since the depth of fill is low, it can be deduced that fills were properly compacted. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution granting variance. 6.6 Rainbow Investment Company Rezone Request - Lands fronting Amador Valley Boulevard, northeast corner of Starward Drive and northwest corner of Donahue Drive. This request is to rezone a 1.3 + acre partially developed property at 7601 Amador Valley Boulevard. The Planning CommissTon's action from August 17, 1987 was a recommendation that the property be rezoned to a Planned Development District. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution adopting Negative Declaration; adopt Resolution regarding the Planned Development Rezoning request for PD 87-076; waive reading and introduce Ordinance amending Zoning Ordinance. 6.7 Dublin Kawasaki Conditional Use Permit - Appeal of Planning Commission's Denial On August 17, 1987, the Planning Commission denied PA 87-098, Dublin Kawasaki Conditional Use Permit request to allow outside storage and display of new and used motorcycles in a portion of the parking lot of an existing multi-tenant commercial center located at 6743 Dublin Boulevard, in the C-2, General Commercial Zoning District. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution denying CUP request - OR - continue the item to the City Council meeting of September 28, 1987 and provide direction to Staff and/or the Applicant for additional information. 6.8 Ordinance Amending Ordinance No. 7-82 Creating and Establishing the position of City Manager This Ordinance amends the current City Manager Ordinance by eliminating the requirement to have City Council approval for the hiring and firing of Department Heads. The revised Ordinance would vest that authority with the City Manager. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance. 6.9 Personnel Ordinance and Personnel System Rules Staff has prepared a revised Personnel System Ordinance which is based on model legislation developed by the League of CA Cities. This Ordinance would need to be consistent with the Ordinance Establishing the Position of City Manager. Staff has also prepared draft resolutions identifying personnel rules and designating management positions as exempt from competitive service. The draft resolutions are prepared for City Council review and it would be appropriate to adopt resolutions at the second reading and adoption of the proposed Ordinance. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance. 6.10 Public Employees' Retirement System (PERS) Amendment to Agreement The City provides retirement benefits through the Public Employees' Retirement System (PERS). The current agreement provides for a basic plan which does not provide for ongoing survivor benefits in the event of a member's death. The proposed amendment would add additional benefits in the event of an employee's death. The cost of the benefits is shared by both the employer and the employee. PERS requires that the City Council adopt a resolution of intention at a public meeting identifying the intent to amend the retirement agreement. STAFF RECOMMENDATION: Conduct public hearing; adopt Resolution of Intention; approve the agreement authorizing 1959 Survivor Benefit Pool & authorize Mayor to execute agreement; waive reading and introduce ordinance; continue the second reading to the meeting of October 12, 1987; authorize Staff to proceed with election requirements. 6.11 Ordinance Establishing Through and Local Truck Routes This ordinance enables the City to designate certain streets as through or local truck routes. No streets are being designated at this time. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance establishing through and local truck routes. 6.12 Ordinance Establishing Right-of-Way Lines This ordinance is part of the ongoing municipal code review. It provides a procedure for establishing right-of-way lines for future street widening, extension or creation, etc. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance establishing right-of-way lines. 7. UNFINISHED BUSINESS 7.1 Agreement for Consultant Services - Eastern Area Infrastructure Study The study outlined in this agreement is intended to identify needs, costs, methods and proportionate benefits for the extension of Dublin Boulevard and freeway interchange improvements east of dougherty Road. The cost of the study is being borne by the affected property owners. STAFF RECOMMENDATION: Approve agreement; authorize Mayor to execute same following receipt of funds from City of Pleasanton. 8. NEW BUSINESS 8.1 Selection of Underwriter and Bond Counsel for Refinancing of Civic Center Certificates of Participation The City Council previously authorized Staff to solicit requests for proposals for underwriting services associated with the refinancing of the Civic Center Certificate of Participation issue. Staff has conducted a selection process for the underwriters and has investigated references for special legal services necessary for this refinancing. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute Agreements. 8.2 Authorization to Advertise Contract 87-8 for Bids, Improvements to Northwest Frontage, Dublin Boulevard/Clark Avenue This contract provides for an 8' widening of Dublin Boulevard at the northwest corner of Clark Avenue to allow for emergency parking, bicycle traffic and an eastbound to westbound u-turn. STAFF RECOMMENDATION: Authorize Staff to advertise Contract 86-8 for bids. 9. OTHER BUSINESS 10. CLOSED SESSION - Pending Litigation, City of Dublin vs. Pet Prevent-A-Care, Inc., Government Code Section 54956.9(a) 11. ADJOURNMENT
