PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Introduction of New Employees: Dora Sotelo, Part-Time Office Assistant I and Henry Siu, Recreation Coordinator (Teens) in the Parks & Community Services Department and Jeri Ram, Planning Manager (File 700-10) 25.2 Mayor's Appointment of Student Member to Parks & Community Services Commission (File 110-30) Three applications were received for the student member to the Parks & Community Services Commission. The Council will consider the Mayor's recommended appointment of Catie Hootman to the Commission for a one-year term. STAFF RECOMMENDATION: Confirm Mayor's appointment. 3.3 Special Presentation to Dublin City Council by Dublin Unified School District (File 610-50) 3.4 Report on Computers For Our Schools Technology Project (File 515-60) ;}.5 Proclamation recognizing and congratulating Dublin High School Boys Varsity Volleyball Team for their 2001 North Coast Section Class 4 Championship (File 610-50) :}.6 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and state your name and address for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1 )(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of June 5, 2001 STAFF RECOMMENDATION: Approve 4.2 Amendment to Tract Developer Agreement, Tract 6925 (File 600-60) Due to the complexity of improvements and conditions beyond the control of the developer, required infrastructure improvements were not able to be completed within the one year specified in the Tract Developer Agreement and an extension of time is required. STAFF RECOMMENDATION: Adopt Resolution. 4.3 Spare The Air Banners (File 350-20) One of the adopted City Council goals for 2001 is to install "Spare The Air" banners during the summer and early fall. The Bay Area Air Quality Management District is able to provide the banners at no cost to the City. This item requests that the City Council approve the banner design and an installation schedule. STAFF RECOMMENDATION: Approve BAAQMD banner design and proposed installation of banners from mid-July through September, or provide other direction. 4.4 Revisions to Personnel System (File 700-20) The City Council will consider modifications to the City's Classification and Salary Plans, implementing a classification study that was conducted early this year. STAFF RECOMMENDATION: Adopt Resolution(s). 4.5 League of California Cities Proposed Bylaws Amendment to Increase Dues to Implement Grassroots Coordinator Network (File 140-20) The League of California Cities has proposed a Grassroots Network that would improve local government. lobbying efforts and has requested that cities approve an amendment to the League's bylaws relating to the establishment of the Grassroots Network and accompanying dues increase. The City of Dublin's dues would increase from $6,068 to $9,624 annually. STAFF RECOMMENDATION: Authorize the Mayor to sign the Ballot approving the Bylaws Amendment. 4.6 Authorize Expenditure for work scheduled at the Shannon Center for a Communications System Upgrade during Fiscal Year 1999-2000, but completed in FY 2000-2001 (File 210-30) Work on the communications system upgrade for the Shannon Center was funded in FY 1999- 2000; however, completion and payment for the project did not occur until November, 2000. The budget adopted for FY 2000-01 did not include the necessary funding in the current fiscal year to cover this carry over expense. STAFF RECOMMENDATION: Approve Budget Change of $18,719. 4.7 Request to Alameda County Mayors to Support New Voting System (File 630-10) The Registrar of Voters is requesting that entities in Alameda County which consolidate their elections, consider supporting the purchase of new electronic touchscreen voting devices. The City of Dublin's costs would be increased from $ .45 to approximately $ .75 per registered voter. As of the November, 2000 election, Dublin had 12,840 registered voters. STAFF RECOMMENDATION: Support Request. 4.8 Acceptance of Gifts to City (File 1:90-70) The Parks & Community Services Department is the recipient of gifts for both the playground and teen programs. The City Council will consider accepting these gifts on behalf of the City. STAFF RECOMMENDATION: Accept gifts; direct Staff to prepare formal acknowledgments to the donors; approve Budget Change. 4.9 Amendment to Agreement with Tri-Valley Janitorial for City Facilities Janitorial Services (File 600-30) The current 5-year agreement with Tri-Valley Janitorial expires on June 30, 2001. This amendment would extend the current agreement for an additional 5-year period, with minor adjustments in rates and scope of work. STAFF RECOMMENDATION: Adopt Resolution approving amendment to agreement. 4.10 Adoption of Resolutions Amending the City's Salary Plan for Fiscal Year 2001-02 (File 700-20) The City Council will consider amending the City's Salary Plan to adjust existing salary ranges to the market average for each City Classification effective July 1,2001. STAFF RECOMMENDATION: Adopt Resolution(s). 4.11 Amendment to Agreement with MCE Corporation for Public Works Maintenance Services (Rate Schedule and Extension of Term) (File 600-30) The current agreement with MCE Corporation expires June 30, 2002. This amendment provides for a 5% labor rate increase and 6.7% vehicle rate increase, as well as adjustments for other equipment rates and subcontractor unit prices. The total proposed budget for activities performed by MCE Corporation for Fiscal Year 2001-02 is $1,927,852, including proposed higher service levels. STAFF RECOMMENDATION: Adopt Resolution approving amendment to agreement and authorize Mayor to execute amendment. 4.12 Request from Dublin Partners in Education (DPIE) for Student Art Reimbursement (File 140-50) On a recent trip to Ireland, Vice Mayor Lockhart presented a piece of student art to Dublin's Sister City. DPIE has valued that artwork, which was to be part of the recent annual Student Art Auction, at $300, and is requesting that the City of Dublin pay for the artwork. STAFF RECOMMENDATION: Approve $300 Budget Change to reimburse DPIE for artwork. 4.13 Approval of Improvement Agreement with Safeway for Improvements to Dublin Boulevard, Amador Plaza Road, and Required On-Site improvements (File 600-30) This action would guarantee the installation of public street improvements fronting the new Safeway site as required by the Conditions of Approval. STAFF RECOMMENDATION: Adopt Resolution. 4.14 Delta Dental Rate Renewal and Amendment to the Benefit Plan (File 720-40) The City Council will consider transferring the City's direct contract with Delta Dental to a Municipality Pool under ABD Insurance & Financial Services, resulting in a cost savings on premiums. STAFF RECOMMENDATION: Adopt Resolution and authorize City Manager to transmit a letter to ABD Insurance & Financial Services requesting membership in the Municipality pool under the Delta Dental Program and adopt 4.15 Amendment to Tract Developer Agreements, Tracts 6962, 6963 and 6964 (Dublin Ranch M-l, .M-2 and M-3) (File 600-60) The time for completion of improvements has expired under the original subdivision agreements, but there is still a small amount of work left to accomplish. This action would extend the allowable time limit for completion. STAFF RECOMMENDATION: Adopt Resolution. 4.16 Financial Report for the Month of May 2001 (File 330-50) STAFF RECOMMENDATION: Receive Report. 4.17 Amendment to Agreement for Consulting Engineering Services with PERMCO Engineering and Management (File 600-30) PERMCO has provided on-call consulting engineering services for Capital Improvement projects to include design and project management. This action would extend the existing contract for an additional year. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute amendment. 4.18 Amendment to Agreement with BSK & Associates for General Geotechnical Services (File 600-30) BSK provides on-call soils and materials testing services to the City, primarily for the City's Capital projects. This amendment would extend the Agreement for a two-year period and allow the Consultant to request a rate adjustment for the second year of the term. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute amendment. 4.19 Amendment to Agreement with Berlogar Geotechnical Consultants for General Geotechnical Services (File 600-30) Berlogar Geotechnical has provided Dublin with on-call peer review for private developments and soils engineering services for Capital projects. This action would extend the term of the contract for two additional years. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute amendment. 4.20 Citywide Street Lighting Maintenance Assessment District 83-1: Preliminary Engineer's Report (File 360-50) The Citywide Street Lighting Maintenance Assessment District funds the cost of street lighting energy and maintenance throughout the City, except for Dublin Ranch and Tract 7067, which are covered by a separate district. This action approves the preliminary Engineer's Report for this assessment district and sets the date and time for the required annual public hearing (August 7, 2001). The assessment is proposed to remain the same as last year's assessment. STAFF RECOMMENDATION: Adopt Resolution(s~ 4.21 Agreement with ACS Desktop Solutions, Inc., to provide Citizen Relationship Management (CRM) Services (File 600-30) This proposed agreement provides for access to a browset-based software program that will allow City Staff to track all forms of communication from the public (i.e. letters, faxes, e-mails, complaints, etc.) and provide for a more centralized citizen relationship management service. The cost will be $11,300 for the first year, and $6,450 for the second year. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement. 4.22 Release of Letter of Credit Securing Tract Developer Agreement for Improvements in Tract 7148, Dublin Ranch, Area G (File 600-60) Substitute securities have been received by the City for Tract 7148 (Dublin Ranch Area G) improvements from Toll Brothers Developers. It is appropriate to release the previous letter of credit provided by the Lin Family. STAFF RECOMMENDATION: Adopt Resolution. 4.23 Landscaping & Lighting Maintenance Assessment District 83-2 (Stagecoach Road) Preliminary Engineer's Report (File 360-20) The Stagecoach Road Landscape Maintenance Assessment District funds the cost of landscaping maintenance and utility costs for street-side landscaping along Stagecoach Road and on the interior slopes of Tract 4719. This action approves the preliminary Engineer's Report for this assessment district and sets the date and time for the required annual public hearing (August 7, 2001). The assessment is proposed to remain the same as last year's assessment. STAFF RECOMMENDATION: Adopt Resolution(s}. 4.24 Commercial Recycling Program Agreement Extension (File 600-30) In March of 1999, the City entered into an Agreement with Livermore Dublin Disposal (LDD), to develop and implement an Expanded Commercial Recycling Program. The initial Agreement was for a term of 16 months and was extended last year through June 30, 2001. LDD is seeking another extension through June of 2003. STAFF RECOMMENDATION: Approve the use of the City's mitigation grant funds to subsidize the Commercial Recycling Program and authorize the Mayor to execute the Agreement. 4.25 Warrant Register ($1,309,483.24) dated June 19, 2001 (File 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Request from Women's Club of Dublin for waiver of use fees for the Dublin Civic Center (File 200-20) The City Council will consider a request for a fee waiver for use of the Dublin Civic Center for a Community Leadership Education Workshop for Youth sponsored by the Women's Club of Dublin. STAFF RECOMMENDATION: Consider Request. 6. PUBLIC HEARING - None 7. UNFINISHED BUSINESS 7.1 Permanent street lane improvements to allow southbound vehicle access to existing land uses on the east side of Village Parkway (File 820-20) The City Council will consider two permanent improvement design alternatives to allow southbound vehicle access to existing land uses on the east side of Village Parkway between Davona Drive and Wineberry Way. STAFF RECOMMENDATION: Select improvement alternative and direct Staff to proceed with the development of a Capital Project for the implementation. 8. NEW BUSINESS 8.1 Consideration of Urgency Ordinance Establishing Moratorium on DonIon Way Area (File 410-20) The Council will consider a moratorium which would prohibit modification of properties within the area of Dublin Boulevard and Donlon Way for the purpose of completing a historical district designation study. STAFF RECOMMENDATION: Determine if proposed project on the Dublin Square property may negatively impact the desired historical district designation of the Donlon Way area and if so, adopt Urgency Ordinance. If the City Council determines that the proposed project will not have a negative impact, then take no further action. 8.2 Landscaping & Lighting Maintenance Assessment District 86-1 (Dougherty Road) Preliminary Engineer's Report (File 360-20) This assessment district funds the cost of landscaping maintenance and utility costs for street- side landscaping along portions of Dougherty Road, Amador Valley Boulevard, Wildwood Road, Fall Creek Road, and Willow Creek Drive. This action would approve the preliminary Engineer's Report for this assessment district and set the date and time for a required public meeting (July 17, 2001 ) and required public hearing (August 7, 2001 ). The assessment is proposed to be increased by approximately 54%, as the maintenance and utility costs have exceeded the assessment for a number of years, and the reserve has become depleted. Property owners would receive a mailed notice and ballot for the purpose of voting on the proposed increase prior to the time of the public hearing. STAFF RECOMMENDATION: Adopt Resolution(s). 8.3 Affordable Housing Implementation Program - Policies and Guidelines for Use of the City of Dublin Inclusionary Housing In-Lieu Fees Fund (File 430-60) The City Council will consider policies and guidelines for the use of the City's inelusionary housing in-lieu fees, consistent with the Affordable Housing Implementation Program. STAFF RECOMMENDATION: Adopt Resolution. 8.4 Amendment to Rules of Conduct for Meetings of the City Council (File 610-20) The Council has directed Staff to review the logisties and ramifications involved with changing the start time of regular Council meetings from 7:00 p.m. to 6:00 p.m. STAFF RECOMMENDATION: Consider issues and provide appropriate direction to Staff. 9.
