SUBJEC Resolution of Local Support -Jobs for Main Street Act of 2010 Funding

EXECUTIVE SUMMARY:
The City of Dublin has applied for a grant from the Federal Stimulus II (Jobs for Main Street Act
of 2010) Program to be used for the repair and resurfacing of Village Parkway and Scarlett
Court. This work also includes the upgrading of curb ramps along these two streets to ADA
Guidelines.
FINANCIAL IMPACT:
The request is for up to $822,000 in construction costs, which would aid Dublin in its Streets
Maintenance Program. The timing of the funding is uncertain as it must be approved by the
Federal Government. The project must be under contract within 90 days. At this time, the
proposed Federal Program has not been approved, nor has the amount of funds that could be
assigned to Alameda County been determined. If awarded the appropriation will be identified in
the appropriate Fiscal Year in the Capital Improvement Program. The City Council will need to
formally appropriate the funds prior to awarding a contract.
RECOMMENDATION:
Staff recommends that the City Council 1) Approve the Resolution of Local Support -Jobs for
Main Street Act of 2010 Funding; and 2) Authorize Staff to advertise for bids for this project
once funding has been acquired and the project bid documents have been completed.

DESCRIPTION:
The Metropolitan Transportation Commission (MTC) is anticipating the approval of the Jobs for
Main Street Act of 2010 (Federal Stimulus II program) which would provide federal funds for
local projects. In turn, the MTC will allocate these funds to cities in Alameda County for projects
that are "shovel ready" (to be under contract within 90 days). The City of Dublin has requested
$822,000 for the repair and pavement overlay of Village Parkway and Scarlett Court. The
upgrade of the curb ramps along each of these streets to current ADA guidelines is also part of
this proposed project.
One of the requirements for the Federal Stimulus II Program is that each local entity proposing
a project must state its support of its proposed project through a Resolution (Attachment 1)
adopted by its governing body, in this case, the City Council.
The Resolution includes the following three required statements:
1. That the sponsor understands that the Jobs for Main Street Act of 2010 funding is fixed at
the programmed amount, and therefore any cost increase cannot be expected to be funded
with additional Jobs for Main Street Act of 2010 or other MTC-programmed funds; and
2. That the project will comply with the procedures specified in the MTC's Regional Project
Funding Delivery Policy (MTC Resolution No. 3603, revised) and with all project-specific
requirements as set forth in the MTC's Regional Jobs for Main Street Act Program (MTC
Resolution No. 3943); and project as described in the application, and if approved, as
included in the MTC's TIP; and
3. That the project will comply with all the project-specific requirements as set forth in the
Federal Jobs for Main Street Act of 2010 and appropriate applicable regulations or
guidance.
In addition to recommending that the City Council adopt this Resolution of Support, Staff is also
requesting authorization to bid the project once funding has been obtained and the project bid
documents completed.
Staff has been processing the documents necessary to obtain approval in order to meet the
required timeline in anticipation of the Jobs for Main Street Act of 2010 going forward and the
City of Dublin being eligible for funding. The City's project is on a County-wide priority list and
may or may not receive funding, depending on the amount of funds finally assigned to Alameda
County.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
A copy of this Staff Report has been sent to the MTC, and if the Resolution is approved, it will
also be transmitted to the MTC. If funding is received and upon completion of bid documents,
the Notice to Bidders will be published twice in a local newspaper (Valley Times) to conform
with requirements contained in Government Code § 37901 et seq., which governs public
contract bids.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
RESOLUTION OF LOCAL SUPPORT
JOBS FOR MAIN STREET ACT OF 2010 FUNDING, AUTHORIZING THE FILING
OF AN APPLICATION FOR FEDERAL JOBS FOR MAIN STREET ACT OF 2010 FUNDING
AND STATING THE ASSURANCE TO COMPLETE THE PROJECT
WHEREAS, the City of Dublin (herein referred to as APPLICANT), is submitting an
application to the Metropolitan Transportation Commission (MTC) for approximately $822,000
in funding from the Federal Jobs for Main Street Act of 2010 for the Dublin Streets Overlay
Program (herein referred to as PROJECT) for the MTC Regional Jobs for Main Street Act
Program (MTC Resolution No. 3943); and
WHEREAS, pursuant to Jobs for Main Street Act of 2010, and any regulations and/or
guidance promulgated thereunder, eligible project sponsors wishing to receive Regional Jobs
for Main Street Act of 2010 funds for a project shall submit an application first with the
appropriate Metropolitan Planning Organization (MPO), for review and inclusion in the MPO's
Transportation Improvement Program (TIP); and
WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the nine
counties of the San Francisco Bay region; and
WHEREAS, the MTC has adopted a Regional Project Funding Delivery Policy (MTC
Resolution No. 3603, revised) applicable to Federal Jobs for Main Street Act of 2010 fund
delivery and has adopted (or is scheduled to adopt) in MTC Resolution No. 3943 such
additional requirements as are necessary or appropriate to meet the obligations/award
deadlines in the Jobs for Main Street Act of 2010; and
WHEREAS, APPLICANT is an eligible project sponsor for Jobs for Main Street Act of
2010 funds; and
WHEREAS, as part of the application for Jobs for Main Street Act of 2010 funding, the
MTC requires a resolution adopted by the responsible implementing agency stating the
following:
That the sponsor understands that the Jobs for Main Street Act of 2010 funding is fixed
at the programmed amount, and therefore any cost increase cannot be expected to be
funded with additional Jobs for Main Street Act of 2010 or other MTC-programmed
funds; and
2. That PROJECT will comply with the procedures specified in the MTC's Regional Project
Funding Delivery Policy (MTC Resolution No. 3603, revised) and with all project-specific
requirements as set forth in the MTC's Regional Jobs for Main Street Act Program (MTC
Resolution No. 3943); and PROJECT as described in the application, and if approved, as
included in the MTC's TIP; and

3. That PROJECT will comply with all the project-specific requirements as set forth in the
Federal Jobs for Main Street Act of 2010 and appropriate applicable regulations or
guidance.
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin is authorized to execute
and file an application for funding under the Jobs for Main Street Act of 2010 for the Dublin
Street Overlay program.
BE IT FURTHER RESOLVED that APPLICANT, by adopting this resolution, does hereby
state that:
APPLICANT understands that the Jobs for Main Street Act of 2010 funding for the
PROJECT is fixed at the MTC-approved programmed amount, and that any cost
increases must be funded by APPLICANT from other funds, and that APPLICANT does
not expect any cost increases to be funded with additional Jobs for Main Street Act of
2010 or MTC-programmed funds; and
2. APPLICANT understands the funding deadlines associated with these funds and will
comply with the applicable provisions and requirements of the Regional Jobs for Main
Street Program (MTC Resolution No. 3943) and Regional Project Funding Delivery Policy
(MTC Resolution No. 3606, as revised); and
3. PROJECT will be implemented as described in the complete application and in this
resolution and, if approved, for the amount programmed in the MTC Federal TIP; and
4. PROJECT will comply with all of the project-specific requirements as set forth in the Jobs
for Main Street Act of 2010 and appropriate applicable regulations or guidance.
BE IT FURTHER RESOLVED that there is no legal impediment to APPLICANT making
applications for the funds.
BE IT FURTHER RESOLVED that there is no pending or threatened litigation that might
in any way adversely affect the proposed PROJECT, or the ability of APPLICANT to deliver
such PROJECT.
BE IT FURTHER RESOLVED that APPLICANT authorizes its City Manager, or
designee, to execute and file an application with the MTC for Jobs for Main Street Act of
2010 funding for the PROJECT as referenced in this resolution.
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the
MTC in conjunction with the filing of the application.
BE IT FURTHER RESOLVED that the MTC is requested to support the application for
the PROJECT described in the resolution and to include the PROJECT, if approved, in MTC's
TIP.
