FINANCIAL STATEMENT:
A value of $62,189.97 has been negotiated for the sale
of this property based on 4451.68 square feet at
$13.97 per square foot.
DESCRIPTION:
At the City Council meeting of June 11, 1990, Staff was given approval to
begin negotiations for the sale of a small piece of surplus right-of-way on
the west side of San Ramon Road, just south of Amador Valley Boulevard. This
property fronts the parcel owned by the former Town & Country Shopping Center,
which is now known as Stroud's Plaza. Mr. Philip Smith, as agent for Stroud's
Plaza, requested to be allowed to purchase the property.
Staff has notified three housing and park and recreation agencies as required
by the Government Code, and has received responses declining interest from all
of them. In order to proceed with the sale, the City Council must adopt a
resolution of intention to sell City property, which additionally sets a time
and date for a public hearing regarding the sale. A minimum ten-day notice is
required.
If no protests are received at the hearing, or if any protests are overruled
by a four-fifths vote, the sale may proceed.
A blanket utility easement is being reserved, as there is a joint utility
trench (PG&E, PacBell, and Viacom) in this property, as well as DSRSD
facilities.
Staff recommends that the City Council adopt the resolution of intention to
sell. City property, setting a hearing date of December 10, 1990, at 7:30 p.m.
in the Council Chambers.

RESOLUTION NO. -90
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
STATING INTENTION TO SELL CITY PROPERTY AND SETTING HEARING
WHEREAS, Philip Smith, as agent for Stroud's Plaza (Town and
Country Shopping Center), requested the City to enter into negotiations to
sell approximately 4,451.68 square feet of City property adjacent to San Ramon
Road south of Amador Valley Boulevard, and more particularly described in
"Exhibit A" attached hereto, in conjunction with development of a new retail
building on and adjacent to the subject property; and
WHEREAS, on June 11, 1990, the City Council adopted Resolution
No. 65-90 establishing said property as surplus and directing Staff to notify
appropriate agencies; and
WHEREAS, all public agencies required to be notified have
declined interest in purchasing said property;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Dublin finds that it is in the public interest and convenience to sell the
subject property, and that the City Council intends to sell said property, and
that the City Council hereby fixes December 10, 1990, at 7:30 p.m. in the
Council Chambers, Dublin Civic Center, 100 Civic Plaza, Dublin, CA, as the
time and place for hearing protests to the proposed sale.
BE IT FURTHER RESOLVED that the City Council directs Staff to
publish notice of said hearing one time in the Valley Times and to post notice
of said hearing in at least three conspicuous places on or before December 1,
1990.

Dear Lee:
Enclosed are legal descriptions, plats and area survey for your
use in processing our request to purchase the described property.
As you know our new building was approved and working drawings are
being prepared. We should file for building permits in about six
weeks.
The price of $13.97 per square foot is acceptable to the owners
and they wish to proceed on that basis. We would like the escrow
to be with First American Title in Livermore, Tom Vargas. We will
need a title endorsement. We would like to close escrow when we
are notified that we can pick up our building permit. There will
be no financing involved.
Lee, I think this responds to what we have discussed. Please let
me know of any additional thoughts you have or any needs that I
have not responded to in the way of information.
